boa_10 18 1954MINUTES OF THE MEETING OF THE BOARD OF ADJUSTMENT The Board of Adjustment met in the Council Chamber on Monday, October 18, 1954 at 2:00 p. m. with the following members present: Mr. Bruce Anderson, Vice -Chairman Mr. W. H. Marak Miss Emily Penton Docket No. 53-54 - Mrs. Charles K. Lincoln, described as southwest of Booker Housing Pro- ject, Pt. NE4, Sec. 23, T1N1 R12W, zoned "A" One -Family; requesting permission for Delta C. & S. Air- lines, Adams Field, to erect a trans- mitter house as permitted under Section 180 Ordinance No. 5420 Mr. Marak moved that this be granted, Miss Penton seconded, the move carried. Docket No. 54r-54 - Lawrence Downs, 3123 Kavanaugh Boulevard, described as the west 47' of Lot 1, Block 461 Pulaski Heights Addition, zoned "A" One -Family; requesting waiver of front, side, and rear yard space for new building. Mrs. Downs was present to represent her son, Lawrence Downs. She explained that she needed a waiver of yard space in order to build on this parcel. Those present objecting or interested in the matter were as follows: Mr. Sam Coco, 3115 Kavanaugh Xr. and Mrs. D. W. Forbes, 813 N. Jackson Mr. L. J. Brown, 815 N. Jackson Mr. L. L. Conkrit, 3201 Kavanaugh Mr. A. L. Endrilin, 809 Jackson Mr. J. E. Isbell, 3124 Kavanaugh Nr. Stephen Breyel, 3111 Kavanaugh There was a great deal of discussion as11ir. Anderson and Mr. Stephens ex- plained the request to the protestors. Mr. Stephens explained that the request was for a waiver of six inches on Jackson Street, since the lot is a reverse corner lot and only requires 12.51 on the Jackson Street side. The applicant is requesting permission to build to within 12' of the property line on Jackson. The other waiver is on Kavanaugh Boulevard where, because of the sharp slope, the applicant is asking to build to within 5' of the property line there. This would be 7' back of the front of the next residence to the East and Mr. Stephens isn't sure that a waiver would be needed, but for safety sake included it in the re- quest,& Mr —Anderson there gave the dimensions of the proPOseci building and the Page 2of2 requested set -backs to those present. Everyone on Jackson Street to the south voiced their objection to any waiver on the Jackson Street side. Mr. Flarak moved that the application be granted on condition that the build- ing remain within the requirements of Zoning Ordinance No. 5420, which would re- quire 12.5' aide yard space on Jackson Street and a 4.71r'°side yard to the east. This would give a waiver on Kavanaugh to allow construction to within 5' of the property line. Miss Penton seconded the move and it was carried. Docket No. 55-54 - H. F. Buhler, 1204 Adams Street., de- scribed as the south 50' of Lots 23, 24, and 25, Block 71 Buhler's Ninth Addition, zoned "F" Commercial; re- questing waiver of front yard space and permission to erect a new build- ing on the rear of the above lots. Mr. Bu.hler was present and stated that he planned to sell this property to a man who wishes to erect a building with an office front. He stated that this man said that he would build his building 25' from the front property line as required, but that it had been about two weeks since the tian expressed his desire to buy and that he did not know if someone else he should sell it to would do the same. He had talked with the surrounding property owners and there were no ob- jectors present. Mr. I4arak moved that the application be granted for waiver to build a com- mercial building across the rear of the three lots on condition that there be no waiver of front yard space from the required 251, Miss Penton seconded the move and it was carried. Docket No. 56-54 - 123 North Gaines Street; request for variance from terms of Zoning Ordinance No. 5420 in order to relocate Iron Works on that portion of Lots 5 and 6, Block 122, original City of Little Rock, lying south of River front Drive. Miss Penton moved that this application be granted, Mr. Marak seconded the move and it was carried. There being no further business the meeting adjourned.
