MINUTES OF THE MEETING
-OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the "Mayor's Conference Room, City
Hall, Monday, January 18, 1954, at 2:00 n.m., with the following members
present:
Mr. Warren Baldwin, Chairmam
Mr. Paul Parks
Mr. W. H. Marak
Miss Emily Fenton
Docket No. 76-53 - Dr. Ben Means, 1124 West llth Street,
described as Lot 12, Heckler's Sub of Block 3 Jansen's
Addition, zoned "F" Commercial District; requesting a
waiver of front and side yard space and permission to
face doctor's clinic on Lewis Street.
Dr. Means was not present to represent his petition. The owner of
the lot adjoining Dr. Means property was present to object to the set-
back. He reviewed the facts involved when the lot owned by Dr. Means
was rezoned. At the time the lot was rezoned for "F" Commercial, an
old non -conforming grocery store existed on the property and was built
up to the front property line, thus obstructing the view of the homes
next to it. Be continued that he and the other property owners were
in favor of the rezoning, since the owner planned to rebuild a. nice
store in its place which would be setback 25' from the front property
line. In the mean time, however, the owner sold the lot to Dr. Means
and now he is proposing to construct a Doctor's Clinic closer than 25'
from the property line on West llth Street. The prod estant presented
a letter of protest from Mr. Lawrence another property owner in the
block. He further explained to the members that Dr. Means had informed
him that he was requesting to build his clinic closer to West llth
Street in order to give him ample room for expansion of the building
should it become necessary. At the present time Dr. Means is proposing
to face his clinic on Lewis Street and use the remainder of the lot for
narking facilities at the rear. The protestant told the Board that he
would much rather see a few cars parked on West llth Street rather than
build the clinic closer to llth Street in order to provide room for off-
street .narking on the rear of the lot. He pointed out that the alley
on this block is not open. He also stated that if Dr. Means sets his
clinic back 25' from the property line on West llth Street, there will
still be room for some off-street parking. The protestant added that
since the parking lot for Safeway's is across the street, then the
patients could probably use that space on which to park. /He stated
that he had no objections to the clinic facing Lewis Street but did
object to the structure being constructed closer than 25' from the
property line on West llth Street.
Miss ''enton made a motion that Dr. Means be allowed to face his
clinic on Lewis Street provided that it is not constructed closer than
25' to the property line on West llth Street; seconded by Mr. Parks.
The motion carried.

Docket No. 77-53 - Norman Baxter, 807 W. Markham Street,
described as the middle 50' of Lot 12, The middle 50' of
the north 26.6' of Lot 11, Block 140, Original City of
Little Rock, zoned "G-1" Commercial District; requesting
a waiver of front yard space and lot area requirements
in order to construct a new building on said property.
Mr. and Mrs. Norman Baxter were present to represent this
application. Mr. Baxter explained that he proposed to construct a
brick veneer commercial building on the property.
Mr. Amis Gutheridge was present to represent an adjoining property
owner. He checked the plans for the building and said that he did not
think his client, Mrs. Webb, would object to the application.
Mr. Marak asked Mr. Baxter if a hardship would be involved should
the Board deny the application. Mr. Baxter replied that it definitely
would since he needs to drive around his building in order to lead and
unload in the rear of his building. He plans to enter on one side of
the lot and circle around the building. Mr. Baxter explained that he
will operate an anpliance and service business in the building.
Mr. Humbered,aanother property owner in the block was present in
interest of the petition. He explained that he ownes the remaining
vacant lots on the block. Mr.. Baldwin showed the plot plan to him and
explained exactly what Mr. Baxter proposed to construct on the lot.
Mr. Humbered said that he had no objections to the application.
Mr. Marak made a motion that the application be approved; seconded
by Miss Penton. The motion carried.
Docket No. 75-53 - C. F. Edwards, 1415 Rock Street, de-
scribed as the north 43' of Lot 4, Block 54, Original
City of Little Rock, zoned "D" Apartment District; request-
ing a waiver of yard space and permission to remodel an
existing garage apartment.
Mr. Edwards was present and stated that a two room servants quarters
and a two car garage now exists on the rear of his lot. He is proposing
to remodel the servants quarters and garage converting them into a garage
apartment. He does not plan to add onto the existing structures in any
way whatever. Mr. Edwards pointed out that he plans to paint the build-
ing and fix it up so that it will be an improvement to the neighborhood.
No one lives in the structure at the present time. Mr. Marak asked if
a hardship will be involved in his case. Mr. Edwards replied that there will
not be a hardship involved in the matter.
The members explained that garage apartments are consistantly denied
by the Board of Adjustment and Planning Commission.
Miss Penton made a motion that the application be disapproved;
seconded by Mr. Marak. The motion carried.
Docket No. 1-54 - N. P. Alessi, 3023 North Grant Street,
described as Lot 12 and the north 25' of Lot 11, Block 5,
Park View Addition, zoned "A" One Family District; request-
ing a waiver of front and rear yard space in order to face
house on Scenic Drive.

Mr. Pat Harding was present to represent this application. He
explained that the only variance involved is facing the house on Scenic
Drive. 14r. Harding explained that Mr. Alessi lives across the street
from this property himself. In fact, he has constructed most of those
houses on that block. There were no objections.
Miss Penton made a motion that the application be approved; sec-
onded by Mr. Parks. The motion carried.
There being no further business, the meeting then adjourned.
