boa_10 19 1959LITTLE ROCK BOA -SO OF ADJUSTMENT MINUTES OCTOBER 19, 1059 The Little Rock ibard of Adjustment met in the'Board of Director Chamber, City Hall, on October 199 1959, at 2100 P. M. The following members were presents Mr. William R. Meeks, JrI&M%airman Mr. Bruce Anderson Miss Emily Penton Mr. Stocks represented the City Attorneys Office. A public hearkng was held on the fallowing docketss Docket No. 5 -59-- Cyril E. Deese, 5,521 Cantrell Boa$, described as the west one-half of lots nine and ten, block 20, Mountain Park Addition, zoned "A" One -family plstrict, requesting a variance from front and side yard provisions of section 11 of that ordinance to permit construction of a carport. Mr. Dee.sa was present, Mr. Breckling explained the request. Mr. Deese satd,he was requesting this in order to make an entrance to his property from Taylor street instead of Cantrell Road. He ._,salad in the pr000ss of widening Cantrell Road, a retaining wall is being placed in front of his property. He is trying to avoid backing his car out onto Cantrell Road.. The carport will come to within 11 feat of the west property line and 22,6feet from the front line to line up with his house. No objectors were present at the meeting. 3,,executive session -it was decided to de�r action and ask Mr[ Deese to revise his plan in order that the carport would not come too close to the side property line. Mt. Breckiing explained that the Health Departmen% suggested this in order to get the noise and odors out of ltho nursiag home. Mr. Breckiing asked Mr. Dishong if the existing frame buil4,4ng could be torn down? Mr. Dishong said he would prefer not to as h* is short of storage space. The staff and Board members thought it should be torn down and extra footage added to the pro- posdd kitchen for needed storage `;space. The contractor for Mr. Dishong, said the building would be concrete, fire proof and the sprinkler sy t ;em in the nursing home *111 be con- tinued en into the new construction. No objectors were present a.t the meeting. In executive session the dipcussion of tearing down the frame building was continued. Mr. Stocks said the Board could approve cony ditionel to tef.r*#g the building down. Mr. Anderson moveat that this be granted provided they tear down the 50' frame building gn the rear of.. lot 10 and build the kitchen 20" further book on the lot away from the existing two-story frame resi- dence in order to give more space on -the lot,, Diiss Penton seconded the {� the motion and it carried unanimoslyr (See attached -sketch.) Docket_ No_ 5;-59 - W. as Jones by Aai Moore, 420 McAdoo Bt*— 4__ described as lot i?, Shannon Rills Add;Ltio41 zoned "A" -One -family` District, requesting a variance from the side yard provisions of Section 11 of that ordinance to permit construction of resid-enoek Mr. Hal Moore, agent for Mr. W. B. Jones, was present. dig. Breckling explained that because of a low easement the house cannot be built anywhere else on the Iota Mr. Moore said if this waiver was not granted, the owner would have to abandon his plans for construction. In executive session, Miss Penton moved that it be approved, Mt. Anderson seconded and the motion carried unanimously. (See attached sketch.) Docket No, 54-59 - Mr. W, T. Little, 5610 West 18th Street, described as lots 11 and 12, Oak Forest Addition, zoned "B" Residence District,.requesting a variance from all applicable provisions of 80ction 11 of' that ordinance to permit construction of a single family house across the two lots. Mr. W* T, Little WAs present. Mr. Breckling explained the request. page 3 of 4 There were several property owners in thq+Vicinity who objected because they felt it would lower the -value .of ;.their property if Mx, Little was allowed to build another house o,ti this lot and rent the one already there, Mro. Little reminded the objectors that he had two lots. The objectors mentioned violatic" of-tbq Hill ©f Assurance. Mr. Meeks told them the Board had no control over this. They agreed that the mistake was made years ago when Mr. Booker, the owner before Mr. Little, was allowed to build the garage and add a house to it: It was brovrbt out that the property was not inside the City at the time the garujo was built and no one objected since the all! of Assurance was not violated. The property owners also objected because they felt other people In the area might want'io make the same request and ruin the one -family residential area. Mrs, A, L. Anders, 1509 8 Filmore Street, objector, said Mr. Little told her if he was not allowed to build his house, the pro- perty might be put into the hands of someone who would sell it to aolored people. Mr. Little said the stories about what he told Mrs* Anders varied somewhat from what he meant. He stated that he had said this piece of property is big enough for someone to bUlXd a nice house on and it might possibly. get into the hands of someone who would sell to a colored person. Mr. Lloyd Richards, 1601 $,, Taylor Street, said as far as tech- nicalities were concerned, he could not see why granting this request would harm anyone and he could not see why anyone would object. Mr. B. L. Freeman, objector, said Mr. Little knew he was going to have trouble doing this when he purchased the property because he called him and talked it over with him and he advised him not to try It, He said Mr. Richard*s property would not be harmed as much as his becatuse both garages would be close to his property line. The objectors present who gave their names and addresses are as follows: Mr. E. L. Freeman, 1600 S. TaylorlAr. V* H. Clergit, 1513 S. Filmore; Mr, Ed. Ferguson, 1303 S. Taylor; Mrs. A. L. Anders, 1509 S. Filmore; Moore, 1508 S., Taylor, and Mrs. Thompson. These people filed a petition objecting to this request signed by thirty-three people.* Mr. Dave Witt, attorney, arrived just before the executive meet- ing to represent Mr. Little. Ur-*' Longstreth, attorney, later filed a 'petition signed by thirty-seven people, stating they had no objections to this request. page 4 of 4 In executive session the possiblilty of Mr. Little asking the Planning Commission to replat his lots was discussed• Mr. freckling said the Planning Commission had already denied a similar request for another owner. It was suggested that perhaps Mr. Little could add to the existing house and move into it. Mr. Anderson moved that the request be denied, Miss Penton seconded and the motion carried unanimously.
