boa_02 24 1959LITTLE ROCK BOARD OF ADJUSTMENT MINUTES OF CALLED MEETING FEBRUARY 249 1959 The Little Rock Board of Adjustment met in the office of Mr. Joseph Kemp, City Attorney, at 1:30 P. M. on February 249 1959 for the purpose of reconsidering their decision on the following docket: Docket No. 34•-58 - James IAT. Means, by Conner Baldwin and Farris, 209 Victory Street, described as the west 75 feet of lot 3, block 334•, Original City of Little Rock, zoned "G-1°' Commercial District, requesting a special exception to Section 6 of that ordinance to permit a public garage in a "G-1" Commercial District. The following members were present: Mr. Wm. R. Meeks, Chairman, Mr. Bruce Anderson, Mr. Lloyd R. Pearce, and Miss Emily Penton. Mr. Farris, the applicant, was not present. It was stated that the garage building is now being used as a radio repair shop. It was Mr. Kemp°s opinion that the Board had, in effect, rezoned the property when they gave the right to use this build- ing as a garage permanently and that it is questionable whether or not the Board had the authority to grant the permit. Mr. Pearce said that due to the size of the building no organization would be able to carry on a public automotive garage. The Railway Express Company, for whom the building was originally built, used it only as a private garage to repair their trucks and did not invite the public to use as a garage. Miss Penton could not see much difference in the amount of noise made by the Express Company working on their trucks and the amount which would be made repairing the amount of cars the shall amount of space available would permit. After a lengthy discussion of the application as originally pre- sented and others similar to it, Mr. Julius Breckling, Planning Adminis- trator, said: "According to information we have received we find that the building on the property described in Docket No. 34-58 is being used as a radio repair shop. This use is in keeping with the use permitted in the "G-1" Commercial District, which this area is zoned." Mr. Pearce moved as follows: "Due to the fact that the property in question is now being occupied by a business which comes under the classification allowed in "G-1" zoning, that the hardship case shown, upon which our decisions in November and December 1958 were based, is no longer in existence, that the righta_•granted at those two meetings are hereby rescinded." Mr. Anderson and Miss Penton seconded the motion and it carried unanimously. The need of the Board for legal advice and counsel was discussed. Mr. Kemp said the services of his office are available to the Board anytime they are in need of it. The Board asked that a member of Page 2 of 2 Mr. Kemp's staff be present at the March meeting for advice on Docket No. 35-58, which is scheduled to be discussed again at that meeting.
