Meeks STAFF PRESENT: Mr. Henry De Noble, Director Mr, Julius Breckling, Planner Mrs. Melba Lawing, Secretary OTHERS PRESENT: Mr. Bill Stocks, Assistant City Attorney order. A quorum was found to be present and the chairman called the meeting to An advertised public hearing was held on the following dockets: Docket No. 44-60 Applicant: Royce Staley by Jack Rice Location: 7017 Burton Drive Description: Lot 41, Maryton Park Addition Classification: "A" One -family District Variance: From the side yard provisions of Section )V, Ord. 5420 to permit existing building to remain where constructed Mr. Rice was present. Mr. Breckling presented the application. There were no objectors present at the meeting. Mr. Rice had a letter from the Su3'— rounding property owners stating that they had no objection. The bill of assurance had been amended. Mr. Breckling explained that several mistakes had made in the past, concerning the purchase of the building permit when this house was con- structed, consequently, a aide yard space for a "B" .Residence district was observed instead of an "A" One -family district, for which the property in question is zoned. In executive session the Board agreed that since the mistakes had already been inadvertently made, the request should be granted. Mr. Anderson was con- tacted the following day and he agreed with this decision. Docket No.. 45-60 Applicant: Christ Pentecostal Church by Roosevelt Buckner Location: 1617 South Martin Street Description: The east 37.5feet of the west 75 feet of lots 16,17,and 18, and the east 37.5 feet of the west 75 feet of lot 19 except the south 10 feet thereof,blook 31 of Jones and Worthen Addition and the east 130 feet of lot 18 block 31, Jones and Worthen Addition Classification: "B" Residen" District Variance: From all applicable provisions of Section 11 of Ord. 5420 to perk t extension of frame building for kitchen facilities Two men represented the church a4d explained that they wanted the waiver in order to have a kitchen and dining ar6a so as to be able to accommodate 'their Council when it met at their church. Th-py said they felt it woula help their church and that the frame building is already there on a concrete foundation. It will not be connected to the church itself. They thought their building would seat 450 people; their membership is 60. In executive session the sta-ff reported that they had been to this location} and that the church is in bad condition. They also reported that the applicant hack not turned in the notice of hearing, therefore, no action was taken at this time, Docket No. 46-60 Applicant: C. D. Snell Location: 1117 Bannockburn Street Description: Lot 12, block 13, Clinton Park Addition Classification: "B" Residence District Variance: From the rear yard provisions of Section 11 of Ord. No. 5420 to permit construction of an apartment house. Mr. Snell was present. The staff reported that the survey and sketch were in error, Some additions had already been made to the south and east sides of the house several years ago. Miss Penton and Mr. Meeks thought this should be denied Mr. Anderson was contacted the next day and he agreed, Docket No. 47-60 Applicant: W. D. Rogers, Jr. Location: 2121 Kavanaugh Boulevard Description: The west 90 feet of lots 17 and 18, block 2. Pulaski Heights Addition Classification: "D" Apartment District Variance: From the side and front yard provisions of Section 11 of Ord. 5420 to permit construction of an apartment house. Mr. Breckling explained the request and said it would make the proposed apartment house closer to the property line than the other buildings on Kavanaugh Boulevard. Mr. Granahan, 519 Cedar Street, was opposed to the waiver because if he is allowed to build -to within 12 feet of the property line the fromt of his house will be in the back of the apartment house. Mr. Rogers said he wanted to build 39 feet from the rear lot line in order to provide as much off-street parking as possible. He said it W(Aild be a two-story building. He plans to wreck the existing one and build a brick one. The existing building is 25 feet from the Cedar Street side. Mr. McGranahan said he had no objection to the building, only to the 12 foot building line. He said this would be the only building on the block which is not set back 25 feet, In executive session the staff suggested an 18 foot setback on Kavanaugh Boulevard, They can build to within 5 feet of the property line on Cedar Street and still comply with the ordinance. They will have to put a screen planting around the parking lot. The staff said they would like for it to be set back 25 feet on the Cedar Street, but that it is not required by the ordinance. Miss Penton and Mr. Meeks approved this application with an 18 foot setback from Kavanaugh Boulevard, Mr. Anderson was;eontacted the following day and gave his approval. Docket No. 48-60 Applicant: A. R. Hoover Location: 7806 West Markhar! Street Description: Lot 8, Wingate-':ddition Classification: "A" One -family District Variance; From the rear yard provisions of Section ll of Ord. No. 5420 to permit cot.istruction of open carport Mr. Breckling explained this request. Mrs. Hoover was present. In executive session, Mr. De Noble thought it could be granted if a turn around is provided so that they will have to go onto Markham Street forward. He said this would be for their own safety as well as the sdfety of others.. The Board agreed to approve the application on this condition. Mr. Anderson was contacted later and agreed to approve, also. Docket No. 49-60 Applicant: Doctor Charles Fowler and Doctor C. R. Haynie by William R. Meeks, Jr. Location: Northeast corner of North Tyler and Idest Markham Streets Description: Lots 1,2, and 3, Block 9, Pfeifer Addition Classification: "B" Residence District Variance: From the rear yard provisions of Section 12-A and 18-4 of Ord. 5420 to permit construction of a doctorrs clinic Mr. Breckling explained the request. He said if this is granted, the three lots on Markham Street, zoned "B" Residence District, will be used for off»street parking for the clinic. Mr, T. E. '.pare was present to object to the clinic being placed here. He felt that it would depreciate the value of his property. The Bid explained to him that the property upon which the clinic is to be placed is zoned for that Purpose and that there is no question about it. The request is for a variance of the rear yard provisions of the three lots to be used for off-street parking, and for permission to locate a parking lot. Mr. Meeks said he had talked to the property owner in the vicinity about the parking lot and they did not object. The Staff said the parking lot would have to conform to the ordinance and the suggested that as many trees as possible be left and that it be made as attractige as possible. It will be a 250,000 dollar project; there will be eight or twelve doctors in it. Mr. De Noble asked what they plan to do with the drainage ditch? Mr. Meeks answered that the ditch would be covered over. Miss Penton agreed that the application should be granted. Mr. Breckling contacted Mr. Marak and Mr. Anderson and they agreed to approve it W-Uh the following conditions: That the screen planting for the parking lot and the parking layout be approved by the staff. Docket No._42-60 Applicant: Marjorie Schultz Location: 1711 Spring Street Description: The west 88 feet of lot 3, block 190, Original City Classification: "C" Two-family district Variance: From all applicable provisions of Section 11, Ord, No. 5420 to permit reconstruction of F existing building in order to allow two apartment units Mrs. Schultz was present. Mr. Breckling briefly reviewed the case as it was presented at the last meeting. Mr. Meeks asked Mrs. Schultz if she had any objections to making a legal instrument agreeing not to sell any of this property? She said she was willing to make this concession as sham had no intentions of selling ary-part of it. Mr. Weldon pP W63rthen's Bank vras--present to `speak :. for Mrs. Schultz. ' - In executive session there was a long discussion about this application. It was agreed that she Would not be changing the looks of the buildings. Miss - Penton had been to the location and Mrs. Schultz explained to her in detail what she planned to do if the request is granted. Miss Penton was not in favor of allowing her to continue. The staff felt that it would definitely be a future problem for the expanding downtown district. Mr. De Noble asked if the building would be fire proof? Mr. Breckling answered no. Miss Penton and Mr. Meeks agreed that it should not be granted and Mr. Breckling contacted Mr. Anderson and they agreed to deny also. Docket No. 38-60 .applicant: Mrs. Virginia Snow Location: 1001 Booker Street Description: Lot 1, block 1, Jones and Worthen Addition Classification: "A" One -family District Variance: Appeal from a decision of the Building Commissioner in order to use a garage apartment for dwelling purposes The case was reviewed briefly. The staff felt that Mrs. Snow was aware of the fact that she was in violation when she purchased her permit. Miss Penton said it had been the policy for several years to disapprove garage apartments and that she felt this one should be.denied. Mr. Meeks agreed. Mr. Breckling contacted Mr. Anderson and Mr. Marak at a later date and they agreed to deny it. Docket No. 36_60 Applicant: Capitol Building Investment Corporation Location: 7th and Bishop Streets Description: Lots 5 and 6, block 413, Compton's Addition Classification: 'IF" Commercial District Variance: From the height and a"ea provisions of Section 13 of Ord. No. 5420 to permit construction of a seven story builds. ing, 75 feet in height Mr. Claude Carpenter, attorney, was present. The Board had received a letter from the applicant requesting an amendment to the waiver for tiiv south side yard requirements in order to provide a smoke proof stair tower which would be . remote from the other required stair. The letter is on file with the original application. Miss Penton and Mr. Meeks agreed to approve this request. Mr. Anderson was contacted the following day. and gave his approval.
