Lyons, II STAFF PRESENT Julius Breckling, 4'lahner Melba Lawing, Secretary A quorum was found to be present and the Chairman called the meet- ing to order. An advertised public hearing was held on the following dockets: Docket No. 42-60 Applicant: Marjorie Schultz Location: 1711 Spring Street Description: The west 881 of lot 3, block 190, Original City Classification: "C" Two-family District Variance: From all applicable provisions of Section 11, Ord. No. 5420 to permit reconstruction of exist- ing building in order to allow two apartment unit. I�:r. Breckling presented the application and projected the plot plan on the screen. 14iss Schultz was present and said part of the house had been allowed to deteriorate, especially the roof. She said Pars, Brett, a property owner, is very enthusiastic about it being fixed up because it will no longer be an "'eye sore": She stated that her reafon for the request is that she needs the extra income and that she has a tenant who is ready to move in. She will, live on the first floor herself. She said she has an F. M. A. loan which she is bound to pay back whether the request is granted or not. In the big house she rents eight sleeping rooms with one community kitchen and living room. Her parents live next door. There were no objectors present at the meeting. In executive session r:r. Breckling reviewed the history of the ►r purahase of the building permit. It was purchased for repair and it was found that she was remodeling for a two-family dwelling. The Building Department ordered her to tear it down or repair it, as she was in violation of the zoning ordinance. Mr. Marak asked how far along the work was? i,ir. Breckling answered not very far along. Mr. leeks moved that it be postponed until the next meeting, Mr. Marak seconded and the motion carried unanimously. Docket. Alien Location: The NE corner of Tyler and "H" Streets Description: Lots 6, 7, and 8, block 16, Hollenberg Addition Classification: `A` One -family District Variance: From all applicable provisions of.Seatlon,ll, Ord. No. 5420, to permit extensidn of present school building No one was present to represent this application arfd Cherie were no objectors present at the meeting. In executive session Mr. Marak moved that it be approved, Mr. Anderson seconded and the motion carried unanimously. Docket -No. 3$-6D Applicant: Location: Description: Classification: Variance. Mrs. Virginia Snow 1001 Booker Street Lot 1, block 1. Jones and "A" One -family District Appeal from a decision of missioner in order to use dwelling purposes '-Forthen Addition the Building Com- a garage apartment for Mrs. Snow and her attorney, Yr. Cooper Jacoway, were present. Mr. Jacoway said this place has been Mrs, Snow's home for a number of years. About two years ago she fixed up a gara a apartment to rent on the back of her lot, which had been built in 1999 for her mother'to live in. She received notice that she was in violation of the zoning ordinance by renting the garage apartment. The details of the history of this case were written out in the application filed by Mr. Jacoway. The history of the base as reviewed by the staff and Public Uforks Department after checking the files showed that a permit was purchased by Mr, Snow on March 14, 1949 to "guild garage and servants quarters on rear of lot -- frame forservants.,quarters only, not to be rented or lived in by .the owner.", On Nov. 5, 1958 Mrs. Snow purchased a permit to "repair play room, no cooking facilities, sheetrock and paint." Mr. Jacoway filed a petition signed by fourteen families in the immediate neighborhood. Several men were present at the meeting to voice their approval of this application. One lady, Mrs. Fraley,_ was present to protest. The garage apartment is close to the rear.of her property and she has no privacy. She said several years ago she re- quested the same thing from the City Council and Mr. Snow fought her all the way and it was denied. She said at that time she was badly in need of income because she had eight adopted children. She had no ob- jection to the request, only the Yleighbdr involved; others in the neighborhood were not allowed to Ytave the same thing and she saw no �' reason why Mrs. Snow should. She said Mr, and Mrs: Snow had complained about her garbage cans for several years and had called the law on her several times. Mrs. Snow denied this. Mrs. Fraley said her dog was kept barking because of the activity near the garage apartment. Mr. Anderson explained to Mrs. Fraley that the Board had nothing to do faith these things. She answered that the apartment being rented would have something to do with them. Mr. Meeks asked Mrs. Snow if the entrance of the apartment is on the front? She answered yes, on Booker Street. In executive session Mr. Breckling went over the history of the case again. He said she has been in violation for about a year. The staff felt that the request should not be granted for economic reasons only, else the Board set a precedent. Anderson moved that it be postponed for one month to allow the City Attorney to familiarize himself with the case and in order to determine if all concerned are telling the truth that they be put under oath, Mr. Marak seconded and the motion carried unanimously.
