An advertised public hearing, was held on the following dockets: DOCKET NO. 30-6 Applicant: Mri d. P. Mc5waln Location: 1823 South Maple Description: Lot 7, Block 1, Braddoek's Addition Classification: Zoned 4'B" Residence District Variance: From the front and side -yard provisions of Section 11 of that ordinance to permit construction of a carport, bedroom, and half bath. Mr. Breckling explained the application and projected related maps on the screen. He said the house was constructed too close to the line, actually on the right-of-way line of West 19th Street, Mr. Mcswain was present. Mr. Meeks asked how long the house had been there? He answered that he had been there since 1955; he did not know when the house was built. Mr. Lyons asked if he was already excavating on the lot? The answer was yes. In executive session the Board said they saw nothing wrong with this; that the mistake had been made twenty years ago. Mr. Anderson moved that it be approved, Mr. Lyons seconded and the motion carried unanimously. DOCKET NO. 31-60 Applicant: J. D. Walthour & Leon Flake by Conner & Baldwin, Agents Page two of seven Location: 1408 Louisiana Street Description: S. 42,511 Lot 2, all Lots 3 and 4, the Be 60.52 Lot 5, and E. 60e51 of N. 11.0' of Lot 69 Block 659 Original City of Little Rock,. Arkansas Classification ;Zoned "E" Apartment District Variance: From the rear yard requirements of provisions of Section 12 of that ordinance to permit the construction of carports. Aire Brecklin; explained that the request is to construct three car ports on the rear of the lots on the east. bars. Glen Woodruff was present and stated she objected to the one to the north, but not the others, because it is a very narrow driveway and it would be difficult for her to get into hers, which joins the alley on the other side. Mr. Warren Baldwin represented the applicants. He said the purpose of the request was to provide more parking space, actually it to being used at the present, they just want to put & metal top on them; the concrete slabs are already there. He adde,c) that Mrs, Woodruff is parking on land belonging to his client. blr. Lyons asked if this would increase the number of parking spaces? The answer was no. Mr. Baldwin said if the car ports were constructed it would not make it impossible for Urse Woodruff to use her car ports. In executive session Mr. Lyons moved that it be approved if the posts and tops were constructed of some non-combustible material, Mr. Anderson seconded and,t-he motion carried unanimously. DOCKET NO. _Z-60 Applicants Mre We L. Harris Location: 35 Scenic Drive Description. Lot 35 Classification:Zoned "A" One Family District Variance: From the front yard provisions of Section 11 of that ordinance to permit construction of a single family house. Mr. Harris was present. Mr. Breckling explained the request and the maps. He said when this subdivision was approved by the Little Rock Planning Commission, some of the lots were allowed a 15 foot building line. At one point the house will come to within 13 feet of the property line, at another 8.5 feet on the front. Mr. Thurston Runyan, 25 Scenic Point was present and spoke against this request. He felt if this waiver were granted the same request would come for the rest of the lots along this street. Page three of seven Mrs. Z, Benskys 23 Scenic Points objected because she felt that it would depreciate the value of her property, She said Scenic Drive Is a narrow street now and it is hard for two cars to pass on it. Mr. H. W. Tinson, Jr., 21 Blue Ridge Circle, said his property backs up to Mrs. Bensky's. He repeated that Scenic Drive is very narrow and that any deviation from the setback would lower the value of his property as well as all the other property in the area. Mr. Meeks asked the reason for the waiver. Mr. Breckling answered that it is a sloping lot. Mr. Lyons asked if the lot had been fined in? Mr. Harris answered yes and that a retaining wall is already built and that there will be nothing resting on the wall. Mr. Harris remained for the executive session to talk with the Board. Mr. Meeks asked if there was any other way he could' construct this -house? Mr; -Ha-rris said h® did riot think soq After considerable discussion of Mr. Harris' plans, Ar-, -Meeks asked If he would mind if thi-s portion of the meeting -were -contAm- ued ,the next morning at the location of the request? Mr. Harris answered that he would be glad for -them to do this. The Board agreed to handle this application in this manner. The Board members considered this request on August 16, 1960 and after thorough investigation and discussion with all concerned they voted unanimously to deny this application. DOCKET NO. 33-60 Applicant: Mrs. James Reid Jones Location: 5336 "C" Street Description: Lots 20 and the W half of 19, Block 20s Pfeifer's Addition Classification:Zoned "B" Residence District Variance: From the front yard provisions of. Section 11 of that ordinance to permit enclosure of existing porch. Mrs. Jones was present. She said if this request is granted she plans to spend about 189000 dollars on the house. She said there Is a vacant lot between her house and the next house; she owns half of it and her neighbor owns the other half. She had signed a sworn statement that there would never be another house there and that this one would remain one -family. In executive session Mr. Lyons moved that it be approved, Mr. Anderson seconded and the motion carried unanimously. DOCKET NO. 34-60 Applicant; Mr. L. K. Austin Location:. 3719 Cantrell Road Page four of seven Description: That part of the NJ, NJ, SWj, NEJ Section 32, T-2-N, R-12-W, lying south and west of Cantrell Road Classification: Zoned "G" Commercial District Variance: From all the applicable provisions of Section 14 of that ordinance to permit relocation of a building. Mr. Breckling presented the request and explained that the applicant wants to move the building 4 feet from the rear property line and that a retaining wall will have to be built. Mr. J. W. Barron, Jr., attorney, was present. He said this request was made necessary by the proposed condemnation of property because of the widening of Cantrell Road. He added that this is the only place on the property that the building can be placed. Mr. Lyons asked if the use would be the same? Mr. Barron answered yes, he thought it would be. He said the Housing Authority is taking all of their parking space. The owner was told at first that they would not need to take any of their parking space or property, but later they decided it would have to be. taken. Mr. Dowell Naylor, Executive Director of the Housing Authority, was present to speak in favor of this application. He said the condemnation of this property had been necessary and he felt it would be in the best interest of all concerned to grant this request. In executive session Mr. Meeks disqualified himself for reason that he had made the appraisal. It was his opinion that this would actually be an improvement In the area. The staff reported that they had checked the plans and that there were no problems of access. Mr. Lyons moved that it be approved provided the present building is removed. Mrs. Lawing was instructed to cont4ct Mr. Marak for his approval or disapproval. This was done on August 16, 1860 and Mr. Marak:Voted to approve. DOCKET NO. 35-60 Applicant: Bob Cohen Sy, Frazier Smith Estate Location: 3720 Cantrell Road Description: Part .of plot "W" Riverside Addition to the City of Little Rock, Pulaski County, Arkansas,( described as: beginning at a point in the northerly right-of-way line of State Highway #1 0 common to Lot 8 and Plot "W" of said Addition, thence easterly 234.19 along said right-of-way line, thence, northerly 151.20 to the BE corner of Lot 119 thence westerly 759 along the south line of said Lot 11 to the BE cornet of Lot 10, thence westerly Page five of seven 75.21 along the south line of said Lot 10 to the SE corner of Lot 9p thence westerly 75.95' along the south line of said Lot 9 to the SW corner of said Lot 9, thence southerly 33.6" along the east line of Lot S to the point of beginning Classification:Zoned "G" Commercial District Variance: From the rear yard requirements of Section 14 of that ordinance to permit construction of a service station. Mr. Dewey 'Thompson, representative of the Texaco Company and Mr. Cohen were present.. Mr. Cohen and Mr. Breckling explained the application. He said the applicant plans to save as many of the trees as possible. The staff had suggested a screen planting along the rear of the station. Mre Anderson asked if there was a retaining wall on the back of the lot and if so, how deep is it? The answer was that there is a retaining wall about 3 to 4 feet high with a guard rail on top of the wall; Pair. Lyons asked if it could be built facing the east? Mr.. Cohen said there were two reasons for placing it on the property as they did - (1) They could utilize the property,better - more room for parking and the pump islands; (2) It would be facing the relocated No. 10, Highway. Mr. Breckling asked if they would be willing to provide the screen planting? Mr. Thompson said he believed they would. No objectors were present. In executive session Mr. Anderson moved that it be approved if they. provide: (1) a 4' chain link fence along rear property line; (2) broadleaf evergreen planting adjacent to the fence; (3) retain trees along the east and north property lines, wherever possible, and (4) construct trash disposal building,adjoining building, Mr. Lyons seconded the motion and it carried unanimously. DOCKET NO, 36 _60 Applicant: Stowers & Boyce, and Louis Cohn, Location: 15141 1512 W. 3rd Street Description; Lots 9 and 10, Block 69, Deaf Mute Addition Classification:Zoned "E-1" Quiet Business and Institutional District Variance: From the front and side yard provisions of Section 12-A of that ordinance to permit - constructioncC office buildings to within 15 feet of the front property line and on the side property line. Mr. Louis Cohn, Mr. Stowers, and Mr.. Boyce were presene They plan an office building at this location. Mr. Cohn said the property was included in some area rezoning by the Little Rock Page six of seven Planning Commission, which changed the classification from 0-1 Commercial back to "E-1" Quiet Business and Institutional. He said he was not aware of it until he was ready to build. If the request is granted he plans to have some parking under the building and some out in the open which will provide for 12 to 14 cars. He said there would be no parking on the 15' front setback, that it will be strictly beautified with lawn grass, and shrubs. Mr. Cohn said there were three houses removed from their two lots. He added that other property owners on the block want to improve their property and the two on the east side are already for sale. In executive session the staff and the Board members felt that it would be be better if the building was set back 201 instead of 15'. Mr. Lyons moved that it be approved with a setback of 20', Pair, Anderson seconded and the motion carried unanimously.. The staff was instructed to inform the applicant of this and if they are not willing to do this the Board can reconsider. DOCKET NO. 37-60 Applicant: Mrs. Ruth B. Harvey Location: 1522 Louisiana Street Description: Lot ?, Block 187 Original City Classification:Zoned "E" Apartment District,, Variance: From all applicable provisions of Section 12 of that ordinance to permit occupanc9r and rental of storage building. Mrs. Harvey was present. She explained that a garage was torn mown on the back of her lot and she had moved a three room building from her property which was taken by the Highway Department for the expressway. She has been using it as a storage building, but now she wants to fix it as an apartment and rent. She explained that her husband left her and she needs this badly for additional income. She said she had been given permission to move this to use for storage. She has ample off-street parking and a big double driveway. She felt it would not be too crowded. There are two apartments upstairs and one down in the main structure on the lot. In executive session the staff said that this would be a violation of the zoning ordinance and that her application to move the building plainly stated "for storage only." The Board felt that this would make the lot too crowded. Par-. Anderson moved that it be denied, Mr. Lyons seconded and the motion carried unanimously. Ur, Meeks asked about the status of the trailer court ordinance. Page seven of seven Mr. Hreckling said that the Health DepartmeAt plans to start enforcing its according to information reviaed- by the Planning staff. The meeting adjourned at 4:15 Pi M.
