Meeks STAFF PRESENT: Mr, Henry De Noble, Director of Planning and Traffic Mr, Julius Brecklings Planner Mrs, Melba Lawing, .Secretary Miss Penton called the meeting to order. She at4nounced that she would not be present at the June and July meetiABB, but possibly would be in August. An advertised public hearing was held on.the following dockets.: Docket No. 21- 0 Applicant** Mrs. M. A. Jenkins Location: SE corner of 17th and HASh Streets Descriptions. N. 75' of lots 4, 59 & 6, block 39, Centennial Addition C-lassification: Zoned "C" Two-family District Variance: All applicable provisions of Section 11, Ordinance 54208 in ord,6k to permit the present house to be reloc,ted. Request: This application was necessary because of the non -conforming beaut,I shop located within the houssti Mrs. Jenkins was presents Mr6,8re4kling presented the appli- cation and explained the -request. In executive session Mr.d 'Breckling ' said he had talked wkth the Housing Authority about this and he felt that she was doing this at the suggestion of the Housing Authority. It was his on;inion that wham she proposes to do'would be better than what she now has. Mr. Meeks moved It be approved, Mr. Anderson seconded and the r►otion carried unanimously. c f 3 Docket No. 22-60 Applicant: Locations Description: Classification: Variance: Request: 411liam Jones 1811 Peyton Street Lots 7 and 8, block 231, S-, J. Johnson's Addition Zoned 'W' Residence District Front & side yard provisions of section 11, Ordinance 5420 Application filed in order to re- construct present house. Mr. Jones was present. Mr. Breckling explained the request and gave the reason for the application. The Health Department had condemned this building since:it did not comply with the standards of the housing code. Part of the building is in the alley (about V ). He plans to tear off three rooms and make an upstairs to the house. He wants to make a five room house, part of which is in the =eyton Street right-of-way. Mr. Breckling asked _him if he plans to tear off the porch? He answered that he could if the Board requires him to. Mr. Meeks asked him if he is still paying on the house? He answered yes. Mr. Breokling showed the vicinity map and explained that' some of the houses are in good shape and some of them are new. The lot is 50 x-1001. Ten feet of the big building could be taken off in the front, but he still would not conform to the zoning ordinance according to setback. In executive session Mr. Breckling told the Board that this property is in very bad condition. He said the staff spends a good part of their time discouraging these owners of condemned houses not to try to do anything but tear down and start over. It,was believed that he is renting out part of it, therefore, it would come under ownership and rental, also. Mr; Anderson roved that it be denied, Mr. Marak seconded and the motion carried unanimously. Docket N.. 23-60 Applicant: Warren Cobb Location: 5821 Kavanaugh Description: Lots 11 and 12, block 7, Mountain -ark Addition Classification: Zoned IT" Commercial District Variance: All applicable - (1) more than one building on the lots, (2) side, front, rear and off-street parking, Section 13 and 2-tA. Request: Application filed, in order to permit extension to present building. gage 3 of 5 Mr. Grant, who owns a dress shop at this location, was present. He explained that he needs the proposed extension for a storage and stock room. The crowded conditions in the alteration room works a hardship on the employees. He has an option to lease enough parking space for two cars. Mr. Meeks asked if the extension will be tied on to the,present structure? He had talked with the neighbors and they were in accord with his plans. He does not own the property, he only leases it. Mr. Lyons asked him if this addition is put on, will the present storage shed be torn down? The answer was yes. In executive session Par. Lyons said if this business was moved away in th;e future, the next tenants might not have the same access to the parking space, lilr. zMarak moved it be approved, Mr. Anderson seconded and the motion carried unanimously. Docket No. 24-60 Applicant: Amos Nickerson Lbeation: 409 Fletcher Street Description: Lots 12 and the Ei of 11, block 11,. Garlands -Addition Classification: Zoned "C" Two-family District Variance: Rear and side yard provisions of Section 11 Request: Application filed in order to permit construction of a bedroom and living room. No one was present to represent this application. Ur. $.reekling presented it in executive session. Mr. Breckling said the Soar®t might provide that the small building not shown on the plot"�plan be removed. Mr. Lyons moved that it be approved provided they move this building, Mr. Anderson seconded and the motion carried unanimously. Docket No. 25-60 Applicant: O. L. Smirl Location: 701 N. Van Buren Description: Lot 6, block 40, 2ulaski Heights Addition Classification: Zoned "A" One -"family District Variance: Front and side yard provisions of Section 11 Request: Application filed 174 order tq ..perfiiu:- enalosure of a front porch. + . gage 4 of 5 Mr. 6mirl was present and explained his request. He said he wants to enclose the front porch to make a room• The porch is in bad condition and he felt he would rather spend money to make a room and a better looking entrance to his house than to repair the porch. He stated that when he contacted the neighbors they said they thought is was a good idea and that they might like to do the same thing in the future. The extension will not come any closer to the'prop- erty line than the existing porch. In executive session the staff recommended that the owner tear down the porch and start over. The Board asked about the possibility of the house to the north ever wanting; to build onto their house. The staff said that was not likely since there is already a garage apattment on the back of the lot. Mr, Leeks moved it be approved if a five foot clearance is left on the north sides Mr. Marak seconded and the motion carried unariy.moysiy. C ,''NTINUED MATTERS Docket No. 15-60 Applicant: B. L. Murphree Location: 423 5. Booker Street Description: Lot 7, block 4, Hicks Subdivision Classification: Zoned "C" Two-family District Variance: Side and front yard Request: Application filed in order to permit an extension to the present building. No action was taken on this application at the meeting on April 18, 1960. It was delayed until the building plans could've presented to the Board. Ur. I.Iurphree was not present and had not brought in his glans, therefore, no action was taken at this meeting. 'RJTEUT ETITIUN A protest petition was filed in cori6ection with the application approved, -'for the Arkansas Lnterpi'ises for the Blind Int'i Bars. Nelson: Blliott, a protesting property owner, said she was present to try to clear up the situation and to apologize to Mr. Breekling. She asked Miss Penton if she received her letter. Miss enton answered yes. She asked Mr. Breckling to show the original of the letter to the Board. Uri, Breekling complied with her request. A lengthy discussion followed about the plans of the applicants. Pars. Elliott felt that the sAme plans she had seen had not been presented to the Board. She alsa said that she had put up her property for sale because of this matter. At the request of Page 5 of 5 Mr. 1-Iarak, Mr. Breckling went over the application briefly and explained it. Mrs. Elliott was of the opinion that the service ,,entrance for deliveries, garbage trucks, etc. would be an Tyler Street] in front of her house. She added that one plan she looked at showed the kitchen facing the co4rtyar'd and another showed it facing 29th Street. Ghe wanted to know which way it would face. The Board examined the, plans before them and Mr. Anderson said it looked as if the service entrance would be on 29th :street. Mr. Breckling went to the office to get the building plans.. Mr. Anderson and Mr. b2eeks said these plans showed' ­the entranc4 to be on 29th Street and that they had been filed with the City Engineer's office and that they could be relied upon, Mr. Anderson told Mrs. Elliott he did not believe the delivery an& garbage tricks, etc. would bother her on 29th Street. Mrs. ;�liott withdrew her objections again and apologized again. In executive session Mr. Lyons suggested that the staff write a letter to the Arkansas Enterprises for the Blind, Inc. telling them that we assured Mr-s-. Elliott that the service entraIRge will be in the center of the -block on 29th Street and send a gopy to Mrs. 411iott. This letter was written on May 17, 1960 and a copy sent to Mrs, Elliott.
