There being a quorum present, the meeting was called to order by the Chairman at 2:00 P.M. Action was taken as follows: - Tract No. 1 - Z-1661 Applicant: Mrs. Bruce Thalheimer Location: 5420 Kavanaugh Boulevard Description: Lots 8, 9, 10 and 11, Block 23, Newton's Addition Classification: "E-1" Quiet Business District Variance: Requests a Variance from Provisions of Section 43-21-(H_b) of that ordinance to permit parking in front yard space - Requests a Variance from the Front Yard Setback Provisions of Section 43-14 of that Ordinance to permit building in yard space Mr. Sam Strauss, Sr:, was present representing the applicant. Mr. James W. Swaim, real estate officer for the Post Office Department, was present. He stated that -for full utilization of this site, the Post Office Depart- ment requests the Board of Adjustment for a 10 foot variance of the front yard space, which would mean that there would be a 15 foot green space between the property line and the building proper in front. Page -1- Board of Adjustment Minutes S vcial Mee$ October 2 1967 Mr. Swaim said that -this variance had been discussed at the time of their acceptance of an "E-1" classification for this site, but since the actual develop- ment of the property had been delayed so long, the Staff thought it best to make a new application, properly notify all adjacent property owners and have the assur•anc� that there would be no difference of opinion about it. To utilize this site over the period of time that they expect to use it, he said, this variance becomes necessary to them. Mr . Meek explained that this Variance became necessary because the en'gineer's survey was in error 10 feet showing the depth of the lot to be 150 feet instead of 140 feet which -it act-ually is. Mr. Farrell requested' Mr. Swaim that as many trees be preserved as possible, especially along Kavanaugh Boylevard as it is extremely important to keep these trees. Mr. Swaim agreed to comply with this requirement. A motion was made that the application be a22roved as submitted, which was seconded and passed unanimously. Tract No. i - Z-2083 - Not Advertised Applicants Madison Cadillac Employees Retirement Trust Locations 1220 Scott Street DescriptionLots- 7 and-8, Block 13, Original City Classifications "E"-Apartment District Variances Requests a Variance from the Use Provisions of Section 43-5 of the Code of Ordinances to permit parking lot in residential zone. Mr. Leon Catlett, attorney for the applicant, was present and stated that they had asked for approval to park new and used automobiles at this location and had asked for a variance in order to blacktop the two lots and to park new and used automibiles as well as automobiles of the employees of the ctmpany. He said that no wrecked cars will be parked on the property. A motion was made that the application be , p-oved, which was seconded and passed. Tract No. 2 - Z-1874 Applicants George Cook Locations 3815 Kavanaugh Boulevard Description; All of Tracts "A" and "B" Allsopp Valley Subdivision Classification: "D"-Apartment District Variances Requests a Variance from the Main Structure Provisions of Section 43-2-(5)-of the Code of Ordinances to permit more than one main structure on a lot Mr. George Cook, the applicant was present. There were no objectors. Mr. Cook stated that he had met with the Staff and the Fire Chief in regard to the driveway on the east end of Building #5, the southernmost building, and were in agreement on an 18 foot driveway and a 20% grade. Mr. Taylor pointed out that building #3 (the northeast building) is 31 feet from the property line to the building; that the driveway itself is 18 feet wide with a radius of about 7'2 feet or a total of 25 feet from the edge of the building to the outside of the driveway. Mr. Cook agreed to decrease the length of building #5 by 2 feet as suggested. He also said that the dri vewaymoul d be asphalt and that the grade for the new buildings would be no worse than the existing buildings. The Fire Chief will inspect the grade prior to the time the pavement is laid to be certain that fire trucks can negotiate the final grade. A motion was made for approval of the Variances requested subject to the following. (a) that building #5 shall be no closer than 31 feet (clear) to the property lines (b) that all driveways have a minimum width of 20 feet. (c) that two additional fire hydrants be installed where indicated on the plot plan and as required by the Fire Chief (d) that fire lanes be provided around buildings 1, 3, and 5, as required by the Fire Chief (e) that curb and gutter be provided on North Lookout Street (f) that grades and turning radius of the driveway be checked out and physically verified by the Fire Chief and the Department of Community Development just prior to the construction of the base or any permanent construction (g) that a report be made to the Board as to the final determined grades.
