City Attorney Jimmy Jones, Gazette Reporter There being a quorum present, the meeting was called to order by the Chairman at 2:00 P. M. A motion -was made for approval of the minutes as mailed, which was seconded and passed unanimously. Action was taken as follows: Tract No. 1 - Z-2116 Applicant: Moise Seligman, Jr. Location: 1900 Beechwood Road Description: The S% of Lot 132 and all of Lots 133 and 134, Shadowlawn Addition Classification:- "A" -One -family District Variance: Requests a Variance from the Yard Area Setback Provisions of Section 43-12 of the Code of Ordinances to permit construction of carport and covered walk in yard space Mr. Moise Seligman, Jr., the applicant, was represented by his son, Moise Seligman, III, who stated that the Variance was requested to eliminate traffic congestion, both on Beechwood Road and Echo Pass at the intersection of Beechwood Road, and to provide more parking space for the family vehicles and service vehicles. The existing garage, which is too small for modern cars, will be used for storage purposes. The new building will extend back further than the existing one. A motion was made to approve the Variance requested which was seconded and passed unanimously. Board of Adjustment Minutes - August 21 1967 Tract No. 2 - Z-2115 Applicant:- R. T. Holderness Location: 4415 "I" Street Description: E% of Lot 16, Block 17, Pulaski Heights Addn. Classification: "D"-Apartment District Variance: Requests a Variance from the Yard Area Setback Provisions of Section 43-13 of the Code of Ordinances to permit an addition to existing non -conforming structure. Mrs. Holderness was present in the interest of the application, and stated that they plan to add a bathroom on the east side of the house which will be 3' X 7' feet in size and would be an extension of an existing stoop. A motion was made that the application be approved, which was seconded and passed unanimously. Tract No. 3 - Z-2118 Applicant: or. John Samuel Location: 5813 "A" Street Description: Lot 17, and the South 40 feet of Lot 10, Block .2, Orlando Heights Addition Classification: "E-1" Quiet Business on Lot 17 - and "B"-Residence District on Lot 10 Variance: Requests a Variance fromthe Use Provisions of Section 43-3 of the Code of Ordinances to permit parking in residential zone and Section 43-20 (2-f) to permit parking in front yard space in "E-1" District Mr. Bob Beal, realtor, representing Dr. Samuel, was present and stated that Lot 17 (5813 West Markham Street) is zoned 11-1" Quiet Business and is only 126 feet deep. He said that Dr. Samuel proposes to build a clinic 30' X 67' on this lot and needs a minimum of ten parking spaces to meet the off-street parking requirements, and since he owns the lot immediately behind the Markham Street property at 5813 "A" Street, he would like to use the south 40 feet of Lot 10 for parking for the "E-1" zoning on Lot 17 immediately south. Mr. Beal also stated that Dr. Samuel wanted to retain the improvements on Lot 10 as it is a substantial brick house which would have approxi- mately 40 feet in the back yard space, and that they would have no objection to entering the parking area on Lot la from "A" Street if it would help the traffic situation on Markham Street, and that they would also construct a curb between the two lots to prevent through traffic from Markham to "A" Street. There were no objectors. A motion was made to defer action on this application until the next regular meetin so that there will be more members of the Board present to consider the case. The motion was seconded and passed unanimously. (This action was taken because the Board wanted a written legal opinion from the City Attorney, and the required number of votes could not obtained for any other motion.) Page -2- board of Adjustment Minutes - August 21,1967 _ Tract No. 4 - Z-2114 Applicant: Location: Description: Classification: Variance: Julia Brod 1810 South Grant Street The South 48 feet of Lots 1 and 2, Block 24, Bateman's Subdivision of Cherry and Cox Addn. "A" -One -family District Requests a Variance from the Yard Area Set- back Provisions of Section 43-12 of the Code of Ordinances to permit construction of carport in Side Yard Area. Mr. T. J. Whitfield, 1810 South Grant Street, son-in-law of the applicant, was present to represent the application. He stated that Mrs. Brod would like to build a double carport in length in the area adjacent to the southside of the existing residence which is part of a closed alley as they now have to use the neighbor's property in order to turn into thei r back yard for parking,, and that with the proposed addition they could park on the side. The present carport is part of the house and it will be used as a patio. There have been no objections from the neighbors, and Mr. Whitfield is of the opinion that this construction would enhance the appearance of the house. A motion was made that the request for Variance be denied, which was seconded and passed unanimously. The proposed construction eliminates entirely the required side -yard on the south side of the structure. The Board felt that the request violates the intent of the Zoning Ordinance and provisions of the Building Code, and that if the property owner to the south requested the same waiver, it could not be denied, and therefore the buildings would be touching each other. Tract No. 5 - Z-1090 Applicant: Arkansas Enterprises for the Blind, Inc. Location: 2800 Block Fair Park Boulevard Description: All of Block 3, C. 0. Brack's Addition Classification: "B"-Residence District Variance: Requests a Variance from the Main Structure Provisions of Section 43-2-(5) of the Code of Ordinances to permit more than one main structure on a lot, and approval of Develop- ment Plan. Mr. Stanley "rice, Attorney, for the applicant, stated that the reason for the waiver request is that they are planning the construction of an additional building that will tie into existing structures on the land. He said that they had applied for and had been given a 2/3 grant by the Department of Health, Education and Welfare which has set minimum floor space requirements which must be met as to construction, size'of rooms, etc. within the building. The block between Tyler and Fair Park Boulevard, 28th and 29th Streets is not square as are most city blocks and for that reason they are cramped for space and have not been able to meet the floor space requirement, he said. Mr. Price said that the proposed building would be located on the southeast side of the property and any construction would be totally inside of the existing brick wall on the corner of Tyler and 29th Streets; that the additional space would allow Page -3- Board of Adjustment Minutes - August 21 1967� the removal of students now housed across the street to the new facility, and that they propose to close the driveway on 29th Street about 1/2 way up the block and a new driveway opened off. Tyler on the corner, construct curb and gutter on 29th Street, pavement on Tyler Street as it extends south, and curb and gutter on the west side of Tyler Street. Mrs. Delbert S. Clark, 2914 South Tyler Street, was present and gave at length the history of the growth of that neighborhood and the rehabilitation facility,, a copy of which has been made part of the record. The petition was signed by four other adjacent property owners. Mr. and Mrs. Nelson Elliott, 2815 South Tyler Street, were present, and requested that questions included in a letter of July 13th be answered, which Mr. Price attempted to do. He filed a petition having 15 signatures of adjoining property owners in opposition to the requested variances. Mr. Elliott stated that the variances for further construction would devalue his property. Mr. Mike King, 7400 West Markham Street, who owns property at 2901 Fair Park Boulevard, 2923 South Tyler Street and 2924 Fair Park Boulevard, was present, stating that the bus does not have room to pull off the street and park which is quite a problem between 4 and 6 P. M.; that beer cans litter the yards of the neighbors, that odors from the kitchen are offensive, and that everyone in the neighborhood is objecting to the new addition. Mrs. Emma Jean Golden, 2915 South Tyler Street, stated that for a number of years the growth of the rehabilitation center has been slow and insidious, and that they are constantly uneasy as they have been promised several commitments which have not been met, and that they are disturbed over the requested variances. She said they are confused and don't really know what they are trying to oppose, and that for the good of the Center the neighborhood has been sacrificed. Mrs. Billy Elder, who lives on Tyler Street, and is a blind instructor at the Center, stated that she had recently purchased her property at 5317 West 29th and did not agree that property in that neighborhood had been devaluated as an FHA appraisal was even higher when made for her than it was three years ago. She also stated that she did not believe that this institution either would devaluate the surrounding property or inconvenience property owners in any major way. She said that beer cans and litter are common in any part of town, and that the service to blind people in helping them to become useful citizens again far outweighs any other aspects or complaints. After lengthy discussion in executive session, a motion was made for approval of the application and the Development Plan provided the curb and gutter is installed for 27 foot pavement width on 28th Street and.29th Street, and Tyler Street with width of Tyler Street to match that south of 29th Street, with required storm drainage on all street construction; that driveways comply with the City ordinances; and that on completion of the proposed dormitory that the three buildings on the southeast corner of 29th and Tyler be vacated and not used for student housing. The motion was seconded and passed unanimously. Page -4- Board of Adjustment Minutes - August 21 ,1967 _ Tract No. 6 - Z-2123 Applicant: Location: Description: Classification: Variance: George Cook 2021 Beechwood Road North 65 feet of Lots 222 23, and 25, Block 2, Country Club Heights Addition "All -One -family District Requests a Variance from the Yard Area Setback Provisions of Section 43-12 of the Code of Ordinances to permit an addition to existing residence. Mr. George Cook, the applicant, who lives across the street from subject property, was present, and stated that the requested variance would allow the construction of a dining room to be added on the west side of the property; that this property has been for sale for -eight or ten months and the principal objection is that there is no dining room. A motion was made that the application be approv_edwas submitted, which was secohded and passed unanimously. Tract No. 7 - Z-2015 Applicant: Location: Description: Classification: Variance: L. B. Sullivan 412 Rosetta Street .Lot 108 Block 5, C. S. Stifft's Addn. "B'l-Residence District Requests a Variance from the Use provisions of Section 43-3 of the Code of Ordinances to permit an addition to existing non -conform- ing duplex This application was withheld because the applicant failed to properly notify adjacent property owners. The Boarddirected the case be placed in the file and no further action taken. Tract No. 8 Z-2111 Applicant: Clarence Ford Location: 7201 Asher Avenue Description: Lot 20 West Acres Addition Classifications "F"-Commercial District Variance: Requests a Variance from the Rear Yard Setback Provisions -of -Section 43-15 to permit addition to structure which projects into rear yard space. Mr. Ford was out of the country and could not be'present. Before he left, he contacted Mr. Taylor of the Community Development Department and agreed to conform to whatever requirements the Board of Adjustment propounded.
