There being a quorum present, the meeting was called to order by the Chairman
at 3:45 P. M. A motion was made for approval of the minutes as mailed, which
was seconded and passed unanimously.

Applicant: Terra Properties, Inc.

Mr. Leonard Venable, President of Terra Properties, the applicant, was present.
He stated that thi°s is 'a church building at the present time which they have
purchased subject to various conditions, and their plans are: to remodel the building
into a 112 story office building using 11 feet the front 25 feet for parking which
is not normally permitted in an "E-111 District„ All remodeling will be done to the
interior of the structure, the existing porch will be removed, and a new roof added.
A motion was made 'that the application be approved pLolvided curb, gutter and side-

sidewalk on West Markham Street with appropriate screening along Markham Street,
and the north boundary line of the property. The motion was seconded and passed
unanimously.

Mr. James S. Binder, President of the organization, was present and made a lengthy
statement of the reasons for expanding this facility because of its worthy nature
and international recognition. He said the addition of the women°s dormitory
was necessary to further protect the handicapped persons OA o now must cross a
busy street for their meals, and would enable them to provide closer surveillance
and better supervision over travel and activities. Mr. Binder stated that they
are asking for a simple variance or the side yard on 29th Street in order that they
may construct the new building which will b� financed by Hill Burton Fund to the
extent of $228,000. They have plenty of parking area, he'said for the staff members
and further plans to provide more parking fir the Enterprise.
Mr. Guy Swaim, architect, stated that in order toget the square footage required
by Hill Burton, the Variance is necessary for -::+;e side yard requirements, and that
parking is adequate for the staff as well as for visitors. He added that the
residences which they own across the street at 29th & Tyler could be made available,
if necessary, when demolished, for parking area.
A group of adjacent property owners were present in oppositions among whom were
the following: Mr. and Mrs. George F. Williams, 2705 South Tyler; Mrs. J. D. Bullard,
2801 South Tyler; Mr. and Mrs. M. C. Duncan, 2805 South Tyler; Mr. and Mrs. Nelson
P. Elliott, Jr., 2815 South Tyler; Joe W. Vann, 2723 South Tyler; Mrs. Charles Pickens,
2823 South Tyler; C. E. Franklin, 2807 South Tyler, D. S. Clark, 2914 South Tyler;
Mike King, 7400 west Markham Street who owns property at 2901 Fair Park Boulevard;
and Emma Jean Golden, 2915 South Tyler Street. Their objections ranged from insufficient
parking area to changing the front yard area to a side yard area, litter, misconduct
in the neighborhood on the part of the trainees, devalFation of property values,
the traffic problems, offensive cooking odors frem the kitchen, and that the facility
if ncr utilizing areas that are available in the center of the property which is now
open space, and the fact that the two residences now being used are actually A1rooming
houses" and not residences as the present zoning requires, and other annoyances
created by this operation.
After a lengthy discussion concerning driveways, curbs and gutters and sidewalks

drainage and other aspects of the matter, a motion .ras made that action be deferred
until the August 21, 1967 meeting in order that fui=her study could be made by the
Staff and the Board, and all property owners withi-:the legal limits could be properly
notified of the next public hearing. The motion was seconded and passed unanimously.

Mrs. Ford, wife of the applicant, was present to represent the application for
Variances. She stated that her husband, who is out of town, usually attends to
all business matters of this type, but she would answer any questions that she
could, She stated that there are two buildings on the,prcperty which they want to
join together as the State Cosmetology Board has rewired them to add more classrooms.
The rear building is too far back and they would like to combine these buildings into
classroom space and the addition would not extend beyond The side yard line of the
existing building. Mrs- Ford stated that they purc:tased a building permit on June 6,
1967 for the purpose of repairing the roof and the eaves of their brick veneer residence.
(The structure is being used as a beauty school rather than a residence.)
Mr. Williams stated that the Board would need more information on this application
before it could be intelligently considered - such as,off -street parking available,
restrictions as to the Fire District, and its relation to this proposed construction,
the zoning compatibility, etc,.
A motion was made that action be deferred on.l`s ease until the Au ust 21,1967
meeting to enable the applicant to supply the necessary in orma on, which was
seconded and passed unanimously.
Mr. Taylor explained that the Board of Adjustment could grant a waiver of the rear
yard provisions, approve the parking, etc. but that there were other problems which
concerned the Building Code which the Board did not have jurisdiction over.
