There being a quorum present, the meeting was called to order by the Chairman at
2s00 P. M. A motion was made for approval of the minutes as mailed, which was
seconded and passed -unanimously. -

There was no one present to represent this application. There were -no objectors. It
is the intention of the applicant to construct a bedroom on the rear of the existing
structure.
A motion was made that the application be as submitted provided the non -conform-
ing use (barber shop) shall not be expanded, and that upon completion of the construction
a building inspection be made to confirm this provision'. The motion Was seconded and
passed. Mr. Finley Williams abstained.

variance of -rear yard space so as -to line the proposed structure up with the house
which is 13.3 feet from the rear property line, otherwise it would extend beyond the
house in the f ront yard area.
A motion was made that the application be appr.;ved gran'ing permission for the proposed
structure to be constructed' 13.3 feet from the rear preperty line, and 3 feet from the
north property line. The motion was seconded and passed unanimously.

that they intend to construct a 100 X 121 addition to the existing non -conforming
structure which is too close to the side yard property line and that this would replace
a small structure now existing at the rear of the house.

that the property is occupied by Jerry Bordenet Shoes,, and next door (5715 Kavanaugh)
is a gift and florist shop (Friday's) which uses the basement in both buildings at the
present time. The tenant at 5713 Kavanaugh mould like to increase his sales floor area
and Mr. Fields said that he would put a stairway in the f rnr� t of the building to the
basement for this purpose, and build a storeroom at the rear of the property to replace
the storage area which world be Yost by converting the basement to a sales floor. The
florist shop mould also use the storage building at 5713 Kavanaugh. He stated that the
alley is not accessible for parking but that them, is plenty of parking area behind the
florist shop for delivery tracks, and that customers may park on Kavanaugh Boulevard.
Vhen questioned about property liness Mr. Fields stated that the building was constructed
in 1935 on the property line and that a filling station occupied the adjoining property
and it was not until two.or three years later that they discovered the discrepancy of
2 or 3 inches 1apover. Mr. Fields explained that the proposed building would be used
only for storage and that there would be no rear door or window.
A motion was made that the application be apaEoved rovided that the applicant leave
clear the land behind 5715 Kavanaugh to be used a�eliv;ery and trucking purposes for
5713 and 5715 Kavanaugh and that.all construction be in accordance with the building
code and that the plans and specifications be approved by the Department of Community
Development; and that all parking as required for this application be waived.
The motion was seconded and passed unanimously.

can now be stored inside the building rather than in the alley.

sidewalks are constructed on ihe'property located'on Asher and Washington Streets as

(Lot 1 ) adjacent on the north side of this prc?perty which is to be used for parking and
the lot shall 'be -surfaced in accordance, with the Zororsg Ordinance= all to be acceptable

detrimc-ntal to her hone, (2) that the enforcei-nt of the Code would not cause undue
hardship for the applicant since he has available now for his use as parking space
to other lots on B1All Street m 5117 and 5115 ® and believes more parking space is
unnecessary; (3) that it is extremely difficult to know wihat the applicant specifically
intends to do as he continues to revise original plans, and that if the Board grants

the Variance that some reasonable conditions be imposed upon the applicant requiring
that within a period of 60"to 90 days that he remove all existing structures and build-
ings from the property under consideration, (4)-and the parking facility comply with
the spirit and intention of the Zoning Chapter of the City Code.
A motion was made for anal of the Development Plan as fi nal ly sF bmi tted, and the
Variame provided that entry to these lots will not be firom "As' Street, and that parking
not be permitted in the north 25 feet of these logs nor against the east sides of the
easternmost lot; that screening of a type required by the Zoning Ordinance be erected on
the north and east sides of these lots where they abut or are across the street from
residential property; that curb, gusher,and sidewalks be constructed. where not now
existing on the B9A9' Street side of these lots and that the structures on Lots 2, 3, and
4 be removed within 6 months of the granting of the requested Variance or before any
construction on these lots is begun m whichever is sooner- or the Variance will become
null and void.
