OTHERS PRESENT Perry Whitmore, Asst. City Attorney Jimmy Jones, Gazette Reporter There being a quorum present, the meeting was called to order by the Chairman at 2.dOO P. M. A motion was made for approval of the minutes as mailed, which was seconded and passed unanimously. Action was taken as follows: Tract No. 1 - Z-2084 Applicant: Sammie Estep Location: 1912 Main Street Description: Lot 9, Block 426, Duvall's Addition Classification: "E=1" Quiet Business District Variance: Requests a Variance from the Side Yard Setback Requirements of Section 43-14-3 to permit addition to existing structure Mr. Estep was present and explained that he desired to reroof the back part of his house eliminating a flat roof and installing a gable roof and extend the back wa l l adding 4 feet to the back part'of the structure. He stated that this is his home which is a two-story house. There is one room upstairs which is not used as living quarters. When questioned he stated that the metal shed on the southwest corner of the building has been there for seven or eight years; that an old well on the property has been filled in, and that the building on the adjacent property (which he owns) to the south does not have an over -hang on the metal shed. He said he would not object to Board of Adjustment minutes - May 22,1967_ -2- moving the carport farther back, but it would necessitate digging out about 4 feet of earth, and cutting down a tree. Mr. Williams informed Mr. Estep that'the survey vhich he submitted with his request for a building permit was dated in 1955 and that he could not properly evaluate the case since it did not include all the information on the survey. A motion was made that the matter be deferred until the June meeting (19th) at which time an up-to-date survey of the property and adjacent property should be filed in order that the Board could see the relationship of these structures one to the other and to prevent taking action which might constitute a fire hazard or a breach of the general building code above and beyond what they are intending to do to this structure at this time. The motion was seconded and passed unanimously. The applicant then volunteered to tear the carport down if this was the reason for the case being deferred. An amended motion was then made that the application be approved subject to the removal of the metal carport, which was seconded and passed unanimously. (The members of the Board after much discussion of this matter resolved that the Staff contact Mr. Estep and advise him that if he still desires the carport that the Board will accept a letter requesting reconsideration of the matter at its next meeting provided Mr. Estep furnished a current plot plan which includes both his and the adjacent structure on the south. Also, Mr. Estep should be advised that the carport will have to be located a minimum of 3 feet from the house including the addition which is to be allowed by this Board action.) A variance of the 25 foot setback requirement is to permit Mr. Thomas to build within the 25 foot setback line in He was questioned about the encroachment on the southwest corner and he stated that if the title could not be quieted in relation tract that they did not contemplate actually building on that the property in any event. Mr. Matthews said that provisions had been made for entrances and exits to the rear of the building for trash pickup; that they plan to have a'steel door on the rear; 5 foot concrete walkway and recessed trash shoots which would come back into the building and protrude outside which plan has been approved by the Fire Marshall. There will be two entrances to off-street parking - one from Broadway and one from 23rd Street, and screening will be provided for the receptacles for trash. A motion was made for approval of the variance re uested subject to com liance with all parking ordinance requirements. The motion was seconded and passed unanimously. Board of Adjustment Minutes - May 22,1967 -3- Tract No. 3 - Z-2086 Applicant: James M. Smith Location: 1712-14 South University Avenue Description: Lots 3 and 4, Block 6, Cox°s Subdivision of Taylor it Bodeman's Addition Classification: 'IF" -Commercial District Variance: Requests a Variance from the Rear Yard Setback Provisions of Section 43-15 of the Code of Ordinances to permit construction of new building There was no one present to represent this application. Mr.Taylor stated that the building would possibly have to be moved back to the rear more to allow more room for parking. A temporary building permit has been issued and the footing has been poured. It was pointed out that the north driveways would have to be changed to make the radius wider, and acceleration and deceleration lanes were discussed, but it was explained that since this property is in the middle of the block this would be difficult, if not impossible. A motion was made for approval of the requested variance and that the curb cuts and driveways meet the approval of the Community Development Department. The motion was seconded and passed unanimously. An amendment was added that the sidewalk be reduced to 6 feet in width which -would create two additional feet in the parking area. It was seconded and passed unanimously. Tract No. 4 - Z-1805 Applicant: Don McCorkle Location: 5100 Block "AB° -Street Description: Lots 3 & 4, Block 7, Pfeifer°s Addition Classification: 0°Ba'-residence District Variance: Requests a Variance from the Use Provisions of Section 43-3 of the Code of Ordinances to permit use of,area for off-street parking for apartment hotel Mr. McCorkle was present and stated that the Variance is requested to permit him to extend the parking facilities of -his hotel. At the present time, he is using the adjacent two lots on "A"-S,treet to the west. It is his intention to finish paving Lot 2 and pave Lots 3 and 4 and screen the area as required by the code. Mary Powell, 5109 "A" Street was present in opposition stating that this would bring his property half -way up the block within one door of her home. It is her understanding that Mr. McCorkle proposes to build a restaurant on his property which is the reason he needs more parking area. Board of Adjustment Minutes - Ma 22 1967 After some discussion as to the sidewalk alignment for the property on Markham Street in that immediate area, several inaccuracies in the plot plan which was filed, a motion was made that prior to the Board rendering a'decision on the Variance request, that complete intention be indicated on a development plan showing (1) existing improvements and including the new building; (2) required parking ratio for the total area, and (3) all driveways, sidewalks, curb cuts, green space, screening, etc. pertinent to the parking layout. The motion was seconded and passed unanimously. Mr. Williams was very critical of the practice of applicants not submitting current plot plans relating to property under consideration for variances, and the fact that the Board of Adjustment i s 'hampered in its determi ni ations for lack of sufficient and reliable information being furnished by engineers and architects.
