City Attorney There being a quorum present, the meeting was at 2:00 P.M. A motion was made for approval as mailed, which was seconded and passed. Action was taken as follows: - Tract No. 1 - Z-1143 called to order by the Vice Chairman of the minutes of the last meeting Applicant: G. L. Dishongh Location: 1506 Cumberland Street Description: East 107 feet of Lot 7, the East 107 feet of -Sh of Lot 8, N�j -of Lot 8,and all of Pots 9 and 10, Block 19, Original City of Little Rock Classification: "E-1 A" Nursing Home, Lodging, Undertaking District Variance: Requests a Variance (1) from off-street Parking requirements of Section 43-21 to permit less than required parking spaces (2) from the Yard Area Provisions of Section 43-14 (1) of Code of Ordinances to permit addition to existing nursing home The applicant, Mr. G. L. Dishongh, was present as was Mr. Floyd J. Wilson, his agent. Mr. Dishongh said there is an old apartment building at this location which they intend to demolish and to construct an additional unit which would add 17 beds to his .present operation for intensive care patients, He informed the Board that they ha?be no parking problem as they have visiting hours, and most of the Staff either use the bus or live in the vicinity. The nursing home is one of the older facilities of its kind in the City, having been at this location for 14 years. Board of Adjustment Minutes - Seotember 16,1968 Mr. Dishongh stated that in order to meet competition he needs this new addition to upgrade his present operation. There are three exits on Cumberland Street and three on 16th Street and patio, he said. Mr. Wilson stated that he had been working with the Permits and inspection Division of the City on some of the problems of the building, and with the State and City Health Departments. A motion was made that the Variances requested be approved subject to off-str_ect parking beiniky rovided at the rate required by Section 43-21 (A) (2) of theCity Code of DrdinancWTand further that arking be provided prior to the initiation of the propo,ed construction, and that the ro er authorities check the exist?.',, - buildings to see if there is a necessity for _updating exits presently prov:;.dcd in that structure and. the proroseO adds ion. The motion was seconded and passed. Tract No. 2 - Z-2213 Applicant: Joe A. Forrester Locations 8624 Chicot Road Descriptions Lot 2, Vinson's Addition Classification-. "A" -One -family District Fd'ariance: Requests a Variance from the Use Provisions of Section 43-3 of the Code of Ordinances to permit addition to non -conforming service station. Mrs John Dodge, an employee of Mobil Oil Company, was present representing Mr. Joe A. Forrester, the applicant. He stated that he felt the station heeded a canopy which could not be built without waiver of yard space. The pump island does not have the required set back, but the station was built before that area was annexed to the City and these improvements were there at that time. There is only 17 feet between the building platform and the edge of the pump island which is a minimum required for operation. Mr. Grundfest said that when Chicot Road was widened to 80 feet, the pump island would be taken completely, to which Mr. Dodge replied that the station could not be operated without the island. A motion was made that the canopy be allowed to extend to the street side of the pump island; and construction of curb and gutter be installed, and that the pavement be widened for a 48 foot pavement width. The motion was secondL-d and passed, with Mr. Grundfest'voting in opposition. Tract No. 3 - Z-2038 Applicant: Robert E. Orgain g,ocation: 6300 Baseline Road Description: Lot "N" of Taylor's Replat of Tract 16, Arnold's Highland Acres Classification: "E-1" Quiet Business District Variance: (continued on next page) Page -2- Board of Adjustment Minutes - _. Variance: Requests a Variance from the Main Structure Provisions of Section 43-2-(5) of Code of Ordinances to permit more than one main structure on a lot Requests a Variance from the Yard Provisions of Section 43-14 of the Code" of Ordinances to permit an addition to an existing building Mr, Robert B. Orgai.n explained that his petition for Variances was necessary because he proposed to construct two main buildings on one tract of land, and the setback on the east property line was insufficient. n; motion was made that the application be approved subject to the building bein', shortened to provide the proper turning radius for fire apparatus, and that the plot be further studied by the Fire Chief to ascertain whether or not he wanted the 25 ftet to run completely through the property or only at the point of turn; and that the construction provide all required parking space as required by City ordinance, and that the applicant further submit to the City a letter of commit- ment that would read in this fashion: that he would when and if the City provided or constructed curb, gutter and/or street widening that he would at that time instal]. the required curb, gutter and sidewalks. The motion. was seconded and passed. (Subsequent to the meeting, the Staff had verified with Fire Chief Davis that a minimum of a 25 foot radius for the turn around the northeast corner of the building is required which may be obtained by cutting off the corner of the building, and that a 20 foot yard space on the east side of the buildings of Phase II and Phase III is a minimum.) Mr. Farrell asked that he be allowed to explain to Mr. Orgain what he meant by "a ]otter of commitment". "Under normal circumstances the City requires all construction to provide for proper curb, gutter, storm drainage, sidewalks, etc. In this particular area -it is within the City - but the City has not yet constructed curbs, gutters and/or street widening: In an effort to be completely fair with all previous applicants, we feel that a letter of commitment on your part stating you would install these items when the City provides their widening or storm drainage would be in keeping," Mr. Grundfest then added that he would like to suggest that the Board of Adjust- ment make a motion to the Board of Directors of the City of Little Bock that a system be devised for future developments of this type where the improvements have not yet been made by the City whereby the individual property owner could be required to make these improvements at the time the City desires it. This is the policy that has been followed in the past. He said he was familiar with it as it was followed on his property on Forbing Road, and in his opinion there should be set up a uniform method of doing that, and would like to recommend that the Board of Adjustment ask the Board of Directors to consider that, and indicate how they would like to have it done. M]r., Taylor said the City has two lines on this in that (1) normally the Planning Commission has required that the improvements be put in at the time of the development Page -3- hoard of Adjustment t'Anutes September 16, 1968 of the property; but generally speaking that is in a subdivision plat and it is in the Bill of Assurance so that if the property transfers hands, the purchaser is aware that he will have to put those in at that future date; (2) on a building permit, of course, normally these are on a lot of record and those are basic requirements at that time. I don't know how you would file it unless you could file some type of covenant that would run with the.land that these improvements would be put in at the time the rest of the street is widened. , Mr. Grundfest said he was not interested in putting it in at the time of develop- ment on a piece of property, but at the time that the City develops the street widening or adjacent curbs and gutters. Mr. Finley Williams said that the point we are getting at here is that this would apply on strips that are on the Master Street Plan that would be improved more than likely under a bond project so there would not be a repetition of putting in curbs and gutters, and then coming back in two or three years and -tearing it out aid rebuilding it to another grade. Possibly that money could be utilized to a better advantage. "This is something that a;e think the Board should take a hard look at because it is something that causes a lot of economic waste in development in some of these smaller tracts. On the larger tracts, I agree that the plans can be made'to fit those large improvements, where the smaller ones are just a loss." Mr. Farrell made a motion that this entire discussion be sumvnarized by the secretary and presented to the Board far its appraisal. The motion was seconded and passed.
