City Attorney There being a quorum present, the meeting was called to order by the Chairman at 2:00 P.M. A motion was made for approval of the minutes as mailed, which was seconded and passed unanimously. Action was taken as follows: Tract No. 1 - Z-2286 Applicant: D. H. Daugherty, Jr. Location: 3118 Foxcroft Road Description: Lot 62, Foxcroft Subdivision Classification: "A" -One -family District Variance: Requests a Variance from the Yard Area Setback Provisions of Section 43-12 of the Code of Ordinances to permit addition to existing residence Mr. Daugherty, Jr. was present. There were no objectors. Mr. Daugherty stated that he plans to extend his carport which is connected to his residence in order to provide a sheltered area both for vehicles and people to and from cars; also for the aesthetic value of the house. He said the house could not be located much differently on this lot and provide the 25 foot rear yard space. The contour is not adaptable to that and would destroy a number of trees, he said. A motion was made for approval of the requested Variance, which was seconded and passed. Board of Adjustment Minutes June 16,1969 OTHER MATTERS Tract No. 1 - Z-2279 Applicant: South Highland Baptist Church Location: 2701 South Elm Street Description: Lots 1 thru 5, and South Half of Lot 6, Block 13, R. C. Butler's Addition Classification: "B"-Residence District Variance: Requests reconsideration of Variance denial concerning sign size There was no one present to represent the applicant. Mr. Venhaus explained that he had had a telephone conversation with the pastor and the chairman of the Board of Deacons and advised them of the Board of Adjustment policy for a reconsideration of this matter. At that time they had not decided whether or not to pursue the case, and apparently they chose not to request reconsideration. Pursuant to the policy of the Board of Adjustment, since there was no representa- tive of the Church present, reconsideration of the matter was automatically declined. Tract No. 2 - Z-1143 Applicant: Location: Description: Classification: Variance: G. L. Dishongh 1516 Cumberland Street Long legal "E-1-A" Nursing Home, Lodging and Undertaking District Requests reconsideration of case concerning properties at 1516 Cumberland Street used for nursing home This matter was considered by the Board of Adjustment on September .16,-1968. Mr. Dishongh, who operates the Cumberland Nursing Home at 1516-20 Cumberland Street, and the petitioner, was present. Mr. George Wimberly, owner of the Buice Drug Store, was also present in the interest of this application. The applicant stated that his plan includes the building of an addition which would accommodate twelve additional patients, and the tearing down of an old unsightly house now on the property. Mr. Dishongh informed the Board that'he owns the whole half block fronting on Cumberland Street from 15th to 16th Street, and his present capacity is for 75 patients, and that he has two or maybe three off-street parking spaces at the present time. The addition would house the office of the operation. He contended that there is no necessity for additional parking space as there has always been adequate parking for the few visitors who visit the home. Mr. Wimberly confirmed this fact as he, being a druggist, had delivered drugs at all hours and had never had any difficulty finding a parking place in front of the main entrance. He also said that there is a concrete ramp on the main entrance area where people could park, and if permitted, could extend that concrete ramp north arid:provide 5 or 6 more spaces Page -2- Board of Adjustment Minutes -- June 16,1969 which would be ample for the extra rooms in the addition. The zoning ordinance requires a minimum of 18 spaces, he was told. He added that it would be an improvement to the neighborhood and there had been no objection from the neighbors. The Chairman entertained a motion for reconsideration, but none was made. Mr. Grundfest then informed the applicant that apparently the Board of Adjustment members felt that the original motion should stand and did not wish to reconsider the case at this time. ADDENDUM MATTER Applicant: William Lowry Location: 301 E. Roosevelt Road Description: Lot 5, Block 1, Pettifer's Addition Classification: "F"-commercial District Variance: Requests a Variance from all applicable provisions of Section 43 of the Code of Ordinances to allow construction of Drive - In This case was withdrawn by the applicant prior to the meeting.
