A motion was made for approval of the minutes as mailed, which was seconded and passed unanimously. Action was taken as follows: - Tract No. 1 - Z-2032 Applicant: Franklin T. Sipes Location: 1425 West 9th Street Description: Lots 1, 2, 3, and the East 50 feet of Lots 4, 5, 6, and the North 6 feet of the West 100 feet of Lot 5, and the West 100 feet of Lot 4, Block 404, Lincoln Addition Classification: "H"-Business District Variance: Requests a Variance from the Main Structure Provisions of Section 43-2-(5) of Code of Ordinances to permit more than one main structure on a lot Mr. Sipes, the petitioner, was present and stated that he has owned some old buildings at this location for a long time and the Housing Authority had suggested its improvement. He had finally made arrangements to construct a new building, mainly for his own use, but also desired to utilize some of the space for office use as a means to help finance it. He said the warehouse would be 160 feet in length with a display room, and seven individual offices upstairs. Board of Ad'ustment Minutes - November 21.19 n -2- Mr. Farrell indicated to Mr. Sipes that the parking requirements were different for an "E-1" classification (offices), and for "H" classification (wholesale) and that it appeared that 51 parking spaces were necessary to meet the requirements of both, and only 46 are available under the present plan. After considerable discussion of this matter with the applicant as to what he proposed to build and his requirements, a motion was made that the applicant resubmit a plot plan, with copy of elevations of the proposed structure, indicating the following: (a) the various intended uses within the structure and the total square footage allocated to each use. (b) provision be made for unloading dock (12' X 30' with 14 foot clearance) on the west side of the building with entry from High Street and have sufficient maneuver room within the property for large transport vehicles (c) an off-street parking layout to provide sufficient parking for the new structure and the commercial building located on the northwestern portion of the tract which parking layout will be provided on subject property and on any additional property which may be acquired to comply with the off-street parking provisions of the ordinance. (d) that the revised plot plan reflect both the property set forth in the applica- tion and any additional property acquired to meet the requirements of this development (e) construction of curb, gutter and sidewalks on 9th, loth and High Street sides of subject property and any additional property acquired to accommodate the requirements incident to the proposed construction (f) removal of the necessary structures existing on subject property as indicated on the development (g) that the requirements having been met to the satisfaction of the Staff, the Variances requested in this application are approved. The motion was seconded and passed unanimously. Tract No. 2 - Z-2017 Applicant: Jones -Murphy -Millard, Inc. Location: 5009 to 5017 West llth Street Description: Lots 9, 10, and 11, Block 26, Cunningham's Addition Classification: "B"-Residence District Variance: Requests a Variance from the Use Provisions of Section 43-3 of the Code of Ordinances to permit location of parking lot in residential zone Mr. Abner McGehee, attorney, representing the petitioner, was present who stated that Board of Adjustment Minutes - November 21, 1966 -3- the variance is requested to permit parking in a restricted zone on three lots on West llth Street. The applicant owns Lots 1, 2 and 3 facing on West 12th Street, which are south of the two lots (Lots 10 and 11) on which parking is being requested. The applicant proposes to build a doctors' clinic for their own use on Lots 1, 2, and 3, and use Lots 9,10, and 11 for parking for the clinic. Lot 9 is to be developed in the future. A plat has been filed showing the proposed use of these three lots and the location of the doctors' clinic. The City owns Lots 7 and 8 as well as Lots 4, 5, and 6. The property immediately north of the lots proposed for parking (Lots 9, 10, 11) has one dwelling on —it. The owner of Lot 12, who lives there, has no objection to Lots 9, 10, and 11 being used for parking purposes. Lt. Lloyd Haynes of the City Police Department lives at 5017 West llth (Lots 10 and 11) and was present. He stated that the City had moved Mr. Squires, Curator of the Little Rock Zoo into the house directly across the street from him, which he says faces Van Buren. A comment was made that a 25 foot front yard setback, as well as screening, would be required and shown on the development plan. Mr. Farrell asked Mr. Taylor if the City had any intention of developing land east and north of this property, to which he replied in the negative. A motion was made that the Variance be granted subject to (1) drainage, curb and gutters and screening to be approved by Public Works Department; (2) that written approval be obtained from the City Parks and Recreation Department, which motion was seconded and passed unanimously. NOTE: This Department has received a memorandum from the Director of Parks and Recreation Department of the City dated November 29,1966 regarding this case (Z-2017) which objects to the requested Variance as not being to the best interest of the public in allowing the parking lot to encroach into this residential district. The request for Variance is, therefore, denied. Tract No. 3 - Z-1465 Applicant: Location: Description: Classification: Variance: C. E. Boyd 4400 through 4800 New Benton Highway Long Legal 'IF" -Commercial District Requests that he be allowed (1 ) to use "F" Commercial zoned tract as permitted in Section 4307-0 5) of Code of Ordinances (to locate a new car dealership and public garage);(2) a variance from the Main Structure Provisions of Section 43-2-(5) of the Code. of Ordinances to permit more than one use on a tract; (3) a variance from the Rear Yard Provisions of Section 43-15 of the Code of Ordinances to permit construction of building in rear yard. Mr. Luke Quinn, realtor, and Mr. C. E. Boyd, the petitioner, were present. Mr. Quinn stated that the Variance is requested to make it possible to construct a new building which will house a new automobile agency on the property U acres). The zoning of the 100 foot strip Board of Adjustment Minutes - November 21, 1966 -4- of land in the rear (east) will be acted upon at the January Planning Commission meeting (application to rezone has been filed: ed). Mr. Quinn'displayed a set of plans for the development. All repair work will be done inside the building, and a used -car lot will be on the north side of the property adjacent to Rock Creek. The proposed.development will be a prestige type of dealership, he said, with improvements to range up to $300,000. The Staff recommended approval of this application due to its isolated location and the nature of the surrounding terrain. The proposed use is a practical, development of the land. A motion was made that the application be approved as submitted. The motion was seconded and passed unanimously. There being no further business, the meeting was adjourned at 3:45 P. M.
