Kerr, Reporter for the Democrat George Bentley, Reporter for the Gazette The meeting was called to order and an advertised public hearing was held on the following dockets: Docket No. 18-61 Applicant: Rufus Givens Location: 1616 West 18th Street Description: Lots 4, 5, and 6, Block 37, Centennial Addition Classification: `°C" Two-family District Variance: From ti,e front and side yard provisions of Section 11 to permit existing carport con- structed in violation of the zoning ordinance. Rufus Givens was present. He said when he bought his automobile he asked the Public Works Department what size tile he would need for his driveway. He was told 41 x 41, so he bought three. When he asked for a permit to pour a concrete slab in the yard he was told no permit was necessary; then he called. Koolvent Awning Company and they came out and measured for his carport. He paid them50 down. He had some trouble with the neighbors concerning the closing of the alley. He said he tried to cooperate with the City in every way. The carport was put up in December of 1960. Mr. Meeks asked if Koolvent Company pur- chased a permit? Mr. Givens did not know. The Board asked Mr. Givens if he had paid them? He said it was .financed by the First National Bank and that he was paying on the note; .;340 in all. He said he had heard no objections from the neighbors and had re- turned the notice of hearing properly signed. rU Page 2 of 3 In executive session the Board discussed the possibility of put- ting the carport elsewhere on the lot. Mr. Breckling said there was room on the back of the lot. He said the alley is open legally, but closed physically. Mr. Breckling added that he had the the on the wrong side of the lot to permit a driveway to -the rear portion of the lot. Mr. Meeks moved that it be denied, Mr. Marak seconded and the motion carried unanimously. Docket No. 19-61 Applicant: Mrs. Niles Stevens by 'i;;s- Nunn Location: 7522 "L" Street Description: Lot "D" Cohlman°s Replat, Lots A. B, 16, and 17, Block 17, Riffel and Rho-ton°s Forest Park Highlands Addition Classification: ``A" One -family District Variance: From the rear yard provisions of Section 11 of that ordinance to permit construction of a house Mr. Nunn was present. This is an 83 foot lot, platted to face "L" Street. They want to build a house with a 17.2 foot rear yard and a 7 foot side yard. He said the neighbors had no objections. In executive session Mr. Marak moved it be approved provided the house is moved 5 feet to the east, Mr. Meeks seconded and the motion carried unanimously. Docket No. 20--61 Applicant: Mr. arja Mrs. John Naill Location: #6 Longfellow Place Description: Part of the east 1/2 of the northwest 1/4, southeast 1/4, Section 30, Township-l-North, Range 13 West Classification: "A" One -family District Variance: From the rear and front yard provisions of Section 11 to permit construction of a carport Mr. Robinson of Robinson Lumber Company was present. The re- quest was for permission to construct an addition for a double car- port. The driveway will be from the side on Longfellow -lace. It will be 22.5 feet from the street line. He said Mr. Naill has had a stroke or a heart attack and this will enable him to get into the house with a minimum amount of effort. There were ro objectors present. Thom Location: The northeast corner of 4th and Hi,-h Streets Description: Lot 4 and the east 1/2 of 5, the south 34- feet of 6, all of 7, 8, and 9, block 7, Deaf Mute Addition Classification: "E" Apartment District Variance: From the height and side yard provisions of Section 12 of that ordinance to permit the addition of 3 stories to existing building and to each end of the building This docket was postponed. Docket No. 22-61 Applicant: Jack A. Tucker Location: 1309 Lincoln Avenue Description: Lot 6, Week's SubdiviJsion of block 359, Original City Classification: "E-l" Quiet Business a -rid Institutional District Variance: From all applicable provisions of Section 5-A to permit extension of existing building Mr. Tucker wants to use the northeast corner of lot 6 to display a vacation type house. He was denied a permit to build it on this lot because it would constitute two structures on one lot. He explained that it will be for display purposes only and that it will not be occupied and will and will have no facilities in it. The property owner who lives next door to him on the i.,Test was present and said she had no objections as long as the display house is kept on the northeast corner of the lot. IIr. Tucker said he had about 90 to 135-40 feet for off-street parking. In executive session the Board agreed that 0_1at he needs is re- zoning and then perhaps a waiver. The Boardr:ed that this use was not accessory use to the office use allowed 1n the "E-1" District. Mr. Meeks moved it be denied -because it concerned rezoning and is outside the jurisdiction of the Board of Adjustment, Mr. Marak seconded and the motion carried unanimously.
