Lyons, II, Chairman Bruce Anderson William R. Meeks Miss Emily Penton ME14BERS ABSENT: W, H. Marak STAFF PRESENT: Henry M. De Noble, Director Julius Breckling, Planner Melba Lawing, Secretary A quorum was found to be present and the chairman called the meeting to order. An advertised public hearing was held on the following dockets: Docket No.. 7-61 Applicant: M. D. Springfield Location: 3325 Roosevelt Road Description: Long legal Classification: "F" Commercial District Variance: From all applicable provisions of Section 139 Ordinance No. 5420, to permit construc- tion of addition to existing building No one was present to represent Mr. Springfield. Mr. Breokling explained the application and showed the Board the location and land use on the Sanborn Map. He said the reason for the request is that Mr. Springfield has three buildings on one lot. He added that they are in fair shape. . In executive session, after a short discussion, Miss Penton moved that it be approved, Mr. Anderson seconded and the motion carried unanimously. Docket No. 8-61 Applicant: Mr.'...W. Benpett Location: 2821 COonfederate Boulevard Description: The south 1/4 of lot 20 block 79 WatkinA Addition Classification: "D" Apartment District Variance: From the side yard provisions of Section 12 Ordinance No. 5420 to permit construction of a bathroom. Page 2 of 4 This apartment house was constructed too close to the property ,line and this is the reason for the request. It will have to be built to within 18 inches of the property line. No one was present for or against this application. In executive session Mr. Meeks moved that it be approved, Miss Penton seconded and the motion carried unanimously. Docket No. 9.61 Applicant: Gerald Neal Location: 3417. West 12th Street Description: Lbts 4 and 5, block 16, Jones and Worthen Addition Classification: "F" Commercial District Variance: From the front yard provisions of Section 13, Ordinance No. 5420, to permit construc- tion of store front on existing apartment house Mr. Neal was present. He explained that he wants to erect a .- store front on the existing house, which will come to within 16 feet of the front property line. He said this is an average building line in the block. It will comme one foot and eight inches closer to the property line than the parch that is already there. In executive session Mr. Meeks moved that it be approved, Mr. Anderson seconded and the motion carried unanimously. Docket No. 10-6 Applicant: E. C. Conner Location: Southwest corner of Hughes Street and Highway No. 10 Description: Lots 1 and 20 block 3, White City Addition Classification: "F" Commercial District Variance: From the rear.yard provisions of Section 139 Ordinance No. 5420, to permit emistruc- 6t 9=46titl store building Mr. Conner was present. He said he needs to go to the rear property line in order to have parking in front of the proposed building. Loading wil be along Hughes Street. The proposed layout for parking more than meets the requirements of the ordinance. In executive session Miss Fenton moved that it be approv6d, Mr. Meeks seconded and the motion carried unanimously. •= Page 3 of 4 Docket No-11-61 Applicant: W. M. O'Quin Location: 5304 Maryland Avenue Description: The west 46 and 1/3 feet of lots 1, 2, and 3, block 81, Perry Heights Addition Classification: "B" Residence District Varriance; From the side yard provisions of Section 11 Ordinance No. 54209 to permit repaire:,to.-._ existing carport. Mr. O'Quin was present. He said his carport was constructed to within 4 feet of the property line and that he contracted with Mr. L A. Horn in November of 1960 to build it. At that time he asked Fir. Horn if he could legally put the carport on the west end of the house and he was told he could so he left it up to him. He did not secure a permit and built it one foot too close to the line. Mr. O'Quin discovered this when he attempted to purchase a permit to repair Storm damages to the carport. When asked about the type of carport he had he answered that it was an open one made of alumipum. In executive session there was discussion about contractors not getting permits and not checking the yard space requirements before beginning construction. The staff was instructed to write a letter and explain this to Mr. Horn. Mr. Anderson moved that th*s be approved Miss Penton seconded and the motion carried unanimously. They felt Mr. O'Quin was not at fault and should not be penalized. HE EST FOR AMENDMENT Docket No. 56- Applicant: Pulaski Heights Baptist Church by Harry E. McDermottt Jr. Location: Northwest corner of Cedar Street and Kavanaugh Boulevard Description: SE 1/4, SW 1/4, Section 32, T-1-No A-12-V Classification. "A" One -family District Variance: From all applicable provisions of Sections 11 & 2-A of Ordinance No. 5420, to permit construction of an educational building Mr. Breckling explained that the reason for this request was that the footing for the building was placed 2 1/2 inches from the property line instead of 1 foot as approved for the rear yard and 4 inches instead of 6 inches as approved for the side yard by the Board on November 16, 1959. Mr. Anderson moved that this amendment be approved, Miss Penton seconded and the motion carried unanimous3:,. Wage 4 of 4 Mr. Meeks felt that a letter should be suggesting to them that they try to buy more the time is not far off when parking will be which is a heavily traveled street. LETTER OF OBJECTION written to the church, land for parking; that removed from Kavanaugh, A letter had been received from Mrs. Ruth Boensch,-objecting to the use of the parking lot of ';the Central Church of Christ by the Pleubel Funeral Homes. She wanted to know why she and her neighbors were not consulted before permission was given to allow the funeral - home to :use it? In executive session Mr. Breckling said this was the only letter of objection which had been received. The Board felt that the parking situation in this area is very bad and is expected to get worse when the Baptist Hospital expanas. Mr. Lyons asked if a public heari'ag on this would be necessary? Mr. Breckling said he did not think it would be necessary just to amend the original decision. Mr. Lyons instructed the staff to notify Mrs. Boensch that the final disposition of this matter would be made at the next meeting on April 17, 1961 and that she and the other property owners were invited to attend.
