Taylor Ellen Mandel Elaine)Brasfield Linda Vacarri 13THERS PRESENT Perry Whitmore, Assistant City Attorney ITEM No. I - Z-1475 Applicant: Union Building Corporation Location: 1400 Cantrell description: Lot 84, Riverside Commercial Park Classification: "F" Commercial Variahge: Requesting a variance from the rear yard provisions of Sec. 43--15 to permit construction of a new building (Zoning Ord. Sec. 13) This waiver was denied at the August 19 meeting in that this is an undeveloped commercial area and that the Board might set a precedent by allowing a waiver of rear yard in that all other property owners could conceivably request the same waiver and the area would develop with access only from the street side to the various buildings. Ray Branton was present. Mr. Lyons made 6 motion that the case be reconsidered. Mr. Meeks seconded the Motion; The motion carried unanimously. Mr. Branton stated he planned the building the way he thought was right. He wants the Board to look at the whole.drawing and consider it. He felt that this is a unique property situation. He stated he has an amendment to theBill of Assurance signed by 60% of the property owners and wil file this if this waiver is granted. He stated this amendment pertai.ss only to Lot 8. The Housing Authority has approved what he has±asked for. He had a letter from the Housing Authority. Out of -the total of six property owners only two have not signed the waf.ver of the Bill of Assurance and could not be reached. was stated that consideration should be given to the balance 'f t the area as well as to th i,s lot. This would set a precedent 'if this is allowed. Mr. Meeks made a motion that this waiver be granted with the la out as submitted provided that nothing is built in the six (6� foot area between the easement and the back of the building other than I-andscaping. Markham and Item No. 3 - z-1450 -Forest Hei hts Business Men's Assoc ;A00 Cant re Mr. Meeks made a motion that the Board accept the opinions that have been received from the Assistant City Attorney and that the applicant be notified as to the content of the opinion that has been received and that we have accepted these opinions and they may take such other action as they so desire. Mr. Kuehnert seconded the motion. The motion carried unanimously. There was some discussion of the proof of notice of hearing. The meeting adjourned at 3:00.
