The minutes of the last meeting were approved, III. New Matters Item No. I o Z-1470 Applicant: Location: Description: Classification: V a r i fa,gc e: J. Griffon by Floyd Grey 2004 E. IOth Lot 7, Block 5r Clinton Park Addition "B" Residence Requesting a variance of more than one building on a lot and rear yard provisions of Sec. 43-2, 12 to permit repairs to existing building, Mr. Grey was present. He planned to remodel one of the buildings. There are two buildings on the lot. He obtained permit to remodel but removed some of the structure and therefore did have to ask for waiver. He would be willing to build a completely new structure. It would not increase the area, There have been no objections. The two small structures will be torn down leaving only two structures on the lot. The houses face IOth Street. The notices of hearing had not been received in the office. Mr. Grey will renotify property owners„ In Executive Session Mr. Lyons made a motion that the appli®tion be approved to permit two structures on one lot provided a new structure be constructed on the property 25 feet from Inex Street and the area of the new structure not exceed that of the structure being removed and that the two small storage houses be removed and that the new house meet all other requirements of the Zoning Ordinance. Mr. Marak seconded the motion. The motion carried unanimously. ISM Item No. 2 - Z-14711 Applicant - Location' Description: Classification: Variance° Earl Noble 205 E. 22nd Street - West 100' of Lots I, 2, & 3, Block 419, DuVall's Addition "D" Apartment Requesting a variance of side yard and parking provisions of Sec. 43-13, 21 to permit parking in front yard and construction of a new two story apt. building. Mr. Earl Noble was present. He plans to build an apartment building with ten units. He stated he would put screening up if necessary. Mrs. Lore was present and stated there is no alley in this block. She stated she was not there to oli'ject but is interested in the parking layout. Mr. Noble stated the drainage would be taken care of. Mr. Eichoff was present but did not object. In Executive Session a motion was made that this application be approved provided screening be placed along the east property line, that the utilities be grouped and trash pick ups be enclosed with a four foot brick wall and that no approval is granted for a swimming pool at this time. The motion was seconded and carried unanimously. Item No. 3 - Z-1472 Applicant: Ruth Washington by Seymour Tr i etman Location: 3201 Gaines Description- North 56 — of Lots I and 2, Block 9, Ebendale Addition Classification: "B" Residence Variance: Requesting a variance of front yard and lot area provisions of Sec. 43-12 to permit construction of a room. Mr. Seymour Trietman was present. He stated that the applicant needs another room added to the house very badly. There have been no objections. Mr. Lyons made a motion that this application be approved. Mr. Mark seconded the motion. The motion carried unanimously. Item No. 4 d Zt-1473 Applicant: Location: Description: Classification: Variance: Southwestern Bell Telephone 5806 W. 65th Street E. 200' of Plot 81 Eommonwealth Addition , "A" One -family Requesting a variance of all applicable provisions of Sec. 43-22 (I to permit expansion of a public utility in a residential zone. 3 Mr. Green was present. A motion was made that this waiver be granted provided the parking is in compliance with parking ordinance. The motion was seconded and carried unanimously. Item No, 5� - (Z-1474) Applicant- John Bullock Location- 5110 West Markham Description- Lot II, Block 7o Pfeifers Addition Classification: "E-I" Quiet Business Variance: Requesting a variance to allow driveway and parking in connection with a restuarant, of Sec. 43-22(4-D) of the Little %ck Code of Ordinances. Mr, John Bullock was present„ He stated this building will not be a restuarant. It will be a take home store. There are two lots there, one is zoned "F" Commercial and the other "E-I" Quiet Business. This driveway is planned to provide customers a safe place to drive. They will- not get out of the cars. It would tie the g affic up of he has to build on one I of p and would have to 'use the alley for the entrance. It will not be ,(Fi'l acktop parking !lot. Would be something that is attractive. Several people were present to object. Orvi I Wood, 5115 A Street, was present and stated that he had not been notified of the meeting. Mrs. Powell and daughter and Mrs. George Hart were present. Mr, Bullock stated he thought he had notified everyone within the required distance. He stated there would be curba and there would be no other way to drive in or out. Also, there would be a four foot wall. Mrs. Powell asked if they could use "E-I" in connection with "F" zoning, It was explained that this was the reason for the application, Mr. Bullock was asked to ren6tify the property owners for the September 16 meetings Item No. 6 a (Zm1475) Applicant: Union Building Corporation by Ray Branton Location- 1400 Cantrell -Road Description- Lot 8, Riverside Commercial Park Classification- "F" Commercial Variance: Requesting a variance from the rear yard provisions of Sec. 43- 15 to permit construction of a new building, Mr. Ray Branton was present. The house was turned this way to get more space. The building would be moved up to the property line if waiver is granted. Mr. Barber was present and pointed+ out that the Bill of Assurance is'on file which states there will be no building over easement-S. h' He stated they revised the:ir plans as a result of some of the buildings going in out there. Air conditioning equipment will be screened. If the building is moved six feet forward there is no problem for the Housing Authority. -4- In Executive Session Mr. Lyons made a motion that this waiver be denied,,in that t is is an undeveloped area qnd thot the Board might set a pro6Lent by allowing a waiver of rear yard in that all other property owners could conceivably request the same waiver and the area would develop with access only from the street side to the various buildings. Mr. Marak seconded the motion and it carried unanimouslyn Item No, ,7 - (Z-- 1476) Applicant: LOcationo Description: C[ass ification : riance: Norma Savery by John Wallace 1003-1009 High Street W. 100' of Lots I, 21 & 31 Block 405, Lincoln,�s Adds "F" Commercial Requesting a variance'of front yard and side yard requirements of Sec. 43-15'to pgrmit addition of a glassed in'por4ch and an aluminum canopy. Mr. John Wallace was present. He wants to remoahl the existing building. The present building will be a part of the'expressway, therefore they are needing a new location. The proposed chapel will se,ot about 46 people. They propose to buy the east 50 feet of these three lots. The top floor is divided into efficiency apartments and five rooms. In Executive Session Mr. Meeks made a motion that the application be approved providing the parking layout is approved by the Community Development Department and the building inspector approves the structure from a safety standpoint for the use intended. Mr. Kuehnert seconded the motion and it carried unanimously. IV. Continued Matters Item No, I Z-1450 Applicant: Forest Heights Business Men's Association Location: 5900 Cantrell Road Description: Lot 5 and part of Lot 6, Block 9, Mountain Park Addition Classification: "E-1" Quiet Business Variance: Requesting a variance as.a special exception to all applicable provisions of Sete. 43-15:to allow construction of a sign. Mrs. Bruce Bullion was present. They want to put a sign up at 5900 Cantrell in conjunction with American Security Savings and Loan.- There have been no objections. It would be about 7 or 8 feet back from'Cantrell. He stated there -is a covenant that should be filed that American Savings and Loan will file. He has met with Perry Whitmore, Assistant City Attorney. Mr. Young stated Mr. Whitmore was out of town and he was unable.to talk with him about his findings. There was some discussion as to whether or not the Board of Adjustment can grant the waiver -5- because of the items set forth by the Planning Commission and Board of Directors of "Criteria for Consideration in the Requests for Rezoning within the Forest Heights Shopping Center Area" and also waiver of "E-l" restrictions. This application was deferred until an opinion from the City Attorney can be obtained and forwarded to this Board. V. Other Matters Item No. I o Tanglewood Shopping Center Mr. George Dowling and Mr. Constance were present. Storm drainage is approved by the Public Works Department. Mr, Meeks made a motion to approve the development plan provided it meets with the parking requiremnts. Mr. Lyons seconded! the motion and it carried unanimously. Mr. Lyons made a motion that discussion of return receipts of notices of hearing being accompanied by a list from an abstract company within the given distance be brought up at the September meeting. Mr. Farrell seconded the motion and it carried unanimously. The meeting was continued pending decision of the City Attorney°s Office® at which time the Board will reconvene and conclude the business on this agenda.
