A motion was made that the minutes of the last meeting be approved. The motion was seconded and carried unanimously. 3. New Matters• (Advertised) Item ^Nv. I (Z- 1382) Applicant: Richard A. Webber Location: 5112 W. Markham Street Descriptionr.: Lot 12, Block 7, Pfeifer's Addition Classrification: "E-I" Quiet Business Variance: Requesting a variance from the side yard provisions of Section 43-14 and waiver of one parking space Section 43-21 of the Little Rock Code of Ordinances (Sec. 12A & 2A Zoning Ord.) to permit construct i o'n' of a new building Mr. Webber was present to represent his application. He plans a two story office building for use as a real estate and insurance office. This calls for ten parking spaces. Due to size of the of and other requirements in "E-I" there is only room for 9 parkin i spaces. Iry order to stay within the front yard requirements he is ;n need of a waiver of one parking space. In rder to allow proper floor space he would need also a side yard waiver on the east. There were six obJectors present. Mrs. Orville Woods, 5115 "A", ob.i-ects because she would not like to have something right up against the alley and the other side too. She does not feel this would be ample parking space. Mrs.10xon, 5117 "A", does not want `- a lot of little businesses going in right in back of her. It would 2 lower property values. Mr. George Hart, 5111 "A" was present„ He can see no reason why they -should give him anything that is out of line with the zoning ordinance requirements. He said Mr. Webber knew what size the lot was when he bought it. He also wanted to know who could ask for a waiver. He said he did not believe Mr.'Webber has bought this property yet. Mr. Webber stated that he has a binding contract with the property and the owner and the real estate man are aware of this application. The property is already zoned "E-1 and that is not the question. Mary Powell and Mrs. Walter Powell, 510-9 "A" Street do not ab,iect too much to the business. They,are drinking of the future. She stated the lot next to his property has a lease for 10 years and at this time has nothing ')uilt on i-b�. This area is in danger of going commercial. In r-ontractinq�there is large equipment and this is all right if he stays within his area but she feels they would not. Mrs. Powell said they gave enough traffic now. If you keep giving waivers it will be very hazardous for children and everyone. Mr. Webber said in talking with the neighbors and property owners, if you attbmpt to purchase their property the price would indicate this property is very valuable. Then when you attempt to get the use from the cost of the land then the owners have a different tune. Mr.-Sebber• said he certainly thinks this is an equitable request and that you must get full use of your property. Mary Powell stated they do not want t o- se+l their property therefore he could not get a selling price from them. Mr. Hart said let him conform to regulations as they are made. Mitchell Location: 30th and Ware Description: All of Block 5 of Hamilton & Brack's Addition and the south 20' of W. 29th Street (Closed) adjacent -n Block 5 Classification- "A" One -family Variance: Requesting a variance for more than one building on a lot and parking of Section 43-2-21 of the Little Rock Code of Ord. (Sec. 2, 2A Zonirg Ord.) to permit new construction W. S. Mitchell was present to represent this application. The alley has bee-n closed and the proposed building plan of development has been filed with the Board of Adjustment. There will be two buildings on parts of. Lot 12 which made this request necessary. They asked for a waiver of parking lots in accordance with regulations. This parking lot, would not be complete until the end of their building, but would have adequate parking during the different stages of work. They also asked for a waiver of curbs, gutters and side- walks. Rev. David Johnson was present and stated that he had ade-a growth rate study up to five years. He feels that at least 2 of the parking area and curbs and gutters should be completed within that time. In Executive Session Mr. Lyons made a motion that the development plan be approved and that the waivers be denied Mr, Meeks secorvde,d the motion. The motion carried unanimously. The Board of AcIjustment has no authority to wive curbs and gutters, and sidewalks. The building is not permanent.. The people who own the building plan to tear it down.and would like to keep the classification in an "F" Commercial zone. They do not do body and fender work and it is for foreigru__ cars only. Mr. Lyons made a motion that this application be approved for the present tenants only Mrs Meeks seconded the motion. Mr. de Noble explained the change to the Board of Adjustment Ordinance as made by the City Manager's Office, The §o and of Adjustment felt that the Building inspector should still have the decision or determination of the enforcement of this chapter of the Zoning Ordinance as originally set out, Mr, Farrell wrote a letter to the Board of Directors to this effect.
