Mr, Collie was pre er.t, to represent his application, M-r. Cr:ll_e said he proposed.
a reduction in the apartments, from 144 units to 120 units; and reducing the
height `o 387! feet. Mr C-,11i-e presented the Board "'Nctes on Application for Waiver,
Northwest Corner Cantrell & Magnolia Streets",. These notes covered comments made by
adjoining property owners, the reduction of units in the apartment, proposed parking,
proposed. height of the building, etc,, The comments were notorized by John T.
Wil-iiams Attorney for Mr., Collie, Mro Collie also presented the board with a
Petition signed by 40 adjacent property owners. Twenty-six of these were neighboring
business men and 14 were neighboring homeowners, The petition stated that: the
apartment was .strongly recommended for approval,
l Mr, Wythe Walker said he. was not present to object to Mr, Collie's proposal for
construction of an apartment, He said. that Westriver Apartments was restrict.e to
10 floors and a penthouse, a.-d he felt that, Mr. Collie should be restricted the

Mr, Edgar K. Riddick, Jr, submitted a letter to the Board stating that he had
objected to the construction of the apartment above an elevation of 380 feet mean
sea level, At that time, he brought to the attention. of the Board the fact that a
maximum building height restriction was placed on the Greenbrier Subdivision,
limiting construction heights in such a manner as to avoid blocking the view of
the property immediately behind Greenbrier, A similar restriction was placed on
the construction of Westriver Apartments, and these two restrictions constitute the
establishment of a precedence which must be considered in evaluating Mr. Collie's
request, He felt that any construction above mean sea level elevation of 361 feet
would be detrimental to the sale value of his property, but in interest of compromise,
suggested a compromise maximum of 380 feet above mean sea level. He said he had
discussed the matter with Mr, Collie, and if he would agree with the Board of
Adjustment to limit his construction to a maximum elevation of 390 feet above mean
sea level that it would be acceptable with him,
Donald Keathley and Joe Gardner, property owners; were present. Both stated they
objected.
In executive session, Mr, Lyons made the motion to approve this application provided
the top elevation_ of the roof does not exceed 387 feet mean sea level, not to
exceed 11 floors; plus necessary elevator penthouses, and that a green strip with
the proper evergreen planting of 15 feet in width be provided along the north
property line and that a green strip not less than 25 feet in width be provided along
the South property line. That the parking layout be approved by the Comm -unity
Development. Department, and that the parking deck be built on the West property
line not closer than 15 feet of the North property line, all trash, garbage, etc„ be
contained within the building or on West side of proposed apartment,
