There being a quorum present, the meeting was called to order by Mr. Lyons, Vice Chairman in the absence of Mr. Kuehnert, at 2:00 P. M. A motion was made for approval of the minutes as mailed which was seconded and passed unanimously. Action was taken on the following applications for Variance: - Item No. 1 - Z-1725 Applicant: Miriam Roots Crawford Location: 923 Scott Street Description: Lots 5 and 6, Block 25, Original City Classification: "E"-Apartment District Variance:- Requests a Variance from the Use Provisions of Section 43-5 of the Code of Ordinances to permit parking lot in residential zone. Mr. W. S. Mitchell, Attorney, was present to represent this application. There were no objectors. Mr. Mitchell stated that there were no specific plans for this lot other than to demolish the building presently located there to make a parking lot although no negotiations are under way for an operator, that all property owners with- W, the prescribed distance have given their approval. A motion was made for approval of this application provided a compact evergreen screen is erected and maintained on the south side of this property - along loth Street, which shall be 30" high for the first 50 feet from front of lot, and the remainder four feet high as provided in Section 43-21(H) of the Code of Ordinances and that front yard space of 25-' be waived. The motion was seconded and passed unanimously. --2-- Board of Adjustment Minutes - 11-16-64 Item No. 2 - Z-876 Applicants Longview Baptist Church Location,. 1723 West 23rd Street Descriptiono Allof Lots 7, 8, 9, 10, 11, and 12 of Block 15, Fleming and Bradford Addition Classification- "CII-Two-family District Variances Requests a Variance from the Rear Yard Provi- sions of Section 43-12 of the Code of Ordi- nances to permit construction in Rear Yard Space Mr. W. P. Nabors, Agent was present to represent this application. The area north of the Church building has been used as a parking lot and the Church would like to construct a one-story educational building, 481 X 941 as they areparticularly in need of this addition, and this is the onlyspace available that could be used for this purpose. The property to the east could be used for temporary parking until the two-story structure to the east could be torn down within the next two years, graded d,,,wn to the proper level and paved for off-street parking. the proposed building is required to be 251from the center of the alley, and they need about 81 more than that and are consequently asking for a Variance of that amount. The sanctuary seats 220 people, and when the property is graded down to the east, it will provide twenty-two parking spaces. He stated that the Church doesn't want to put in a permanent pavement at present, but the work will be douse within two years. Mr. R. A. Walsh, 1721 West 22nd, was present in opposition and read a statement he had prepared which is on file. Also he read a letter from an adjacent property owner, Mr. George Arendt, 2300 Wolfe Street, whose opposition mainly was because he thought it would add to congestion, noise, and traffic problems on surrounding streets which are narrow, and also in his opinion the Church should solve the off-street parking situation first. Mr. Walsh also stated that he thought the property values in the surrouanding area would be down -graded, particularly his property which is across the alley to the north. Mr. Charles E. Lawrence, Pastor of the Church, said that he had called on every- one in the vicinity and that they all expressed approval of the project, stating that they were proud to have the attractive building in the neighborhood, and that he was surprised that any objection had been presented. He also stated that when the old structure is torn down within -two years, it will p€-ovide an area 3000 X 150° for parking. (Actually the area would approximate 115° X 175° - ed.) In Executive Session, a motion was made that any action be delayed until such time as the applicant files a revised plot plan showing the permanent 22 parking spaces with the grades included. W. gate Locations 2210 South Valentine Street Description: Lot 22, Block 5, Chesterfield Square Addition Classifications '"BB' -Residence District Variances Requests a Variance from the Side Yard Provisions of Section 43-12 of the Code of Ordinances to permit addition to Structure There was no one present to represent this application, and no objectors. A motion was made for approval of this Variance whidh. was seconded and passed unanimously. Item No. 4 - Z-1360 Applicants Geyer Springs Apartments, Inc. Locations 5900 West 53rd Street Descriptions Long Legal Classifications BBD"-Apartment District Variances Requests a Variance from the Main Structure Provisions of Section 43-2-(5) Code of Ordi- nances to permit more than one structure on a lot Mr. Edward L. Wright, Jr. attorney, was present to represent this application. He stated that it is a four acre tract facing West 53rd Street at the intersection of Geyer Springs Road and 53rd Street. It is proposed to build a garden -type apart- rrlent building, and all sidewalk, curb and gutter along West 53rd Street and Geyer Springs Road. A motion was made for approval of this application provided the off -site improvements such as curb and gutter and sidewalks are installed on both the 53rd Street side and the Geyer Springs Road extended as shown on the plot plan and the dedication of the applicant's portion of Geyer Springs Road, and compliance with the City's off-street parking requirements. ':The motion was seconded and passed unanimously. Mr. de Noble asked the Board to decide vh?,ther or not to reconsider a previous application of Lewis Rauton (Z-861) requesting certain Variances, filed March 18, 1963, which was approved provided that the meters and garbage racks be placed on the west end of the building. A motion was made to reconsider,which was seconded and passed unanimously. On October 19, 1964, the Board was requested to approve a similar Variance at 510 South Summit Street, Case Z-1698, at which time a condition was made that the same garbage and meter facilities would serve the three buildings. Mr. Rauton explained that approval was granted in March, 1963, and construction was held up for about fourteen months as the property was included in an Urban Renewal area and there was doubt as to whether or not it would be taken. He said that several arrange- ments were worked out with the Arkansas Power & Light Company, but finally the -47 Board of Adjustment Minutes 11-16-64 Power & Light Company determthed that it could not service the meters in the rear of the buildings and would have to service them from the front. The building is nearing completion now, and two meter boxes have been installed on the south side of the building which should have been installed on the west side. There is a retain- ing wall on the south side, plus a four foot fence which would serve as a screen for the meters. The north side is the street side and he believes that tall shrubs would screen this if the arrangement is satisfactory. Theproblem of one garbage container for the three buildings was discussed as to feasibility of service, and Mr. Marak suggested that the Staff and Curtis Woods of the Sanitation Department work out a satisfactory solution. A motion was made as follows; (1_) that electric meters are to be set where leads are stubbed out now and electrical supply to be by underground service lines; (2) that meters on structure on Lot 10 are to be placed on north side facing Lot 11; (3) that plot plan of Lot 10 be revised placing parking on south side of lot, there- by permitting close access for garbage pickup from individual garbage cans located in the northwest corner of Lot 10; that garbage containers for apartments located on Lots 11 and 12 be placed in the southwest corner of Lot 11 (close to cans for Lot 10); or as an alternate that garbage bin (for pickup by fork lift) be located in the front, and on the line between Lots 10 and 11, properly screened. Any such arrangement which is worked out must be satisfactory to the Sanitation Department, Messrs. Henry de Noble and John L. Taylor of the Community Development Department. The motion was seconded and passed unanimously. A proposed calendar of meeting dates for the Board of Adjustment for 1965 was presented and approved.
