There being a quorum, the meeting was called to order at 2:00 P. M. The minutes of
the lastmeeting were approved as mailed.
Action was taken on the following applications for Variances: -
Item No. 1 v Z-1698
Applicant: Lewis S. Rauton
Location: 510 South Summit Street
Descriptions. Lot-10, Block 20, Foust's Addition
Classification: "EBl-Apartment District
Variance: Requests a Variance from the Use Provisions of
Section 43m21-(H-b) to permit parking in Front Yard
space, and the Rear Yard Provisions of Section
43-13m(2) to permit construction in Rear Yard Space
Mr. Lewis Rauton and Tommy Coyle were present to represent this application. There
were no objectors. In order to have adequate parking,it is necessary to move the
building back within 5' of the rear yard line which would line up with his other
apartment building adjacent to the north, and he intends to have the same garbage
and meter facilities serve the three buildings. He also stated that the construction
would meet the requirements of the City Building Code. A motion was made to approve
and was seconded and passed unanimously.

Variances. Requests Variances (1) from the Main Structure
Provisions to permit more than one structure on
a lot, (2) the Use Provisions to permit construction
in Front Yard Space, and (3) from the Area Per
Family to permit two units more than permitted on
tract
Messrs. Wythe Walker and Robert Robinson, Architect, were present. Mr. Walker said
in regard to the first Variance, that actually there are three lots 1500 x 1300
and rather than putting one building on each lot, he thinks a better plot plan
layout can be obtained by building two main structures longitudinally on the lot
and hence the Variance for two structures on one lot. The Front Yard Space
waiver comes about because of the desire to park the cars at the rear of the site
off of the alley as Mr. Walker thinks this is the most appropriate place for the
parking area, but this does not permit quite enough room on the lot without a
Variance of the Front Yard Setback. The third Variance was asked for since the
number of units in a "D"-Apartment zoning classification would permit only 16.36
units and he proposes to build 18 units. To make the buildings symmetrical, the
plans call for the construction of 9 apartments in each unit, which would have six
two-story units plus three ground floor basement units in each building. The three
apartments in the basement were designed so as to meet the Code requirement of
the City. Mr. Walker said that the alternating court yards make the layout more
attractive.
Four ladies appeared in oppositions Mrs. Durward Allen, 517 South Elm Street
representing the Baptist Student Center, 323 South Elm Street; Mrs. Harlan Hill,
Mrs. Mattie F. Harris, 400 Cedar, and Mrs. J. S. McCarty who stated that the area
is already quite congested because of the proximity of the Medical Center, and
parking is a problem since Cedar Street is a one-way street without parking privi-
leges. Mr. and Mrs. J. A. Myers, 424 South Cedar filed a letter of approval of
the application.
In Executive Session, a motion was made for approval of the Voriances for more
than one structure on a lot; to permit construction in the Front Yard space suffi-
cient to allow parking in the Rear Yard Space off the alley, but to deny the
construction of more than a maximum of 16 units, and that the parking areas, spaces
and access, meet with the approval of the Community Development Department.
The motion was seconded and passed. Mr. Farrell abstained.

Variance: Requests a Variance from the Use Provisions o f
the Code of Ordinances to permit parking in the

Mr. Fe Phillips was present in the interest of this application for Variance.
This property is located on 'All -Street which is unopened but a dedicated streets
LJ and he stated that it is highly unlikely that it will ever be opened because
0 due east is a very extensive ditch, but that he would like the use of the dedicated
W right-of-way for ingress and egress. Mr. de Noble stated that the Street would
C. have to be developed according to Ordinance No. 102808 and approval of the Public
cd Works Department.
Aimotion was made approving the Variance to permit parking in the Front Yard
Ce Setback provided parking areas and spaces in both the Front Yard and Rear Yard
