A quorum was found to be present and the Vice Chairman called the meeting to order. The minutes of the previous meeting were approved as mailed. Action was taken on the following applications for Variances Item No. 1. - (Z-1608) Applicants West Side Baptist Church Locations 2717 West 7th Street Descriptions Lots 4, 5, 6, Block 11, Ferndale:Addition Classifications "BI'-Residence, and 'IF" -Commercial District Variances Requests a Variance from the non -conforming uses provisions of Section 43-11 of the Code of Ordinances and Section 10 of the Zoning Ordinance to permit expansion of Church and approval of a development plan Mr. E. G. Davis, Pastor of the Church was present. There were no objectors. He wants to build an educational unit for Sunday School and Training classes that will replace old structures that are now being used for Sunday School and Training purposes. This addition will not in any way increase the seating capacity which is 125;persons at the present time. A motion was made by Mr. Meeks that the Variance be granted subject to the removal of the two existing buildings when the present construction is finished, and that when the seating capacity of the Church is enlarged, sufficient off-street parking will be provided. Board of Adjustment -2- Minutes - April 20 1964 Item No. 2 - (Z-1637) Applicant: Southwestern Bell Telephone Company Location: 512 Brown Street Description: Lot 4, Block 1, C. 0. Kimbel and Bodeman's Addition Classification: "B"-Residence District Variance: Sec. 43-3 Code of Ordinances and Section 3 of the Zoning Ordinance to permit expansion of a utility in a residential zone, and more than one ;tructure on a lot Mr. R. F.Farrell, representing this application was present. There were no objectors. The proposed addition is a -building 1O'X10'. Mr. Meeks made a motion for approval, which was seconded by Mr. Farrell, and passed unanimously. Item No. 3 - (Z-1630) This application was withdrawn due to the fact that the required notices were not sent out by the applicant. Item No. 4 - (Z-1553) Applicant: Gene Mason Location: 2206 North Palm Street Description: Lots 3 and 4, except the south 1 foot of Lot 3s Block 7, Country Club Addition Classification: "A" -One -family District Variances Requests a Variance from the Side Yard provisions of Sec. 43-12 of the Code of Ordinances, and Sec. 11 of -the Zoning Ordinance to permit addition of a carport and storage room to an existing structure Mr. Gene Mason was present, and there were no 'objectors. Mr. Mason stated that what- ever was done by the contractor was at his instruction, and that he would like to leave the present construction as it is. A motion was made that the roof above the storage room must be.cut back to comply with the original plot plan as submitted which provided for a distance of 4' between the property line and the building; and that the roof overhang shall be in compliance with plans on file in the office of the Community Development Department. The motion was seconded and passed unanimously. Item No. 5 - (Z-1623) Applicant: Union Life Insurance Company Location: 5114 Kavanaugh Boulevard Description: Lots 10 and 11 of Block 26, Newton's Addition Classification: "F"-Commercial District Variance: Requests a Variance from the Rear -yard Provisions of Section 43-15-2 of the Code of Ordinances and Section 13 of the Zoning Ordinance to permit the construction of a commercial building. -3- L.R.Board of Adjustment Minites _ April 20,_1964 Item No. 5- _(continued) Mr. Guy Maris, Jr. was present to represent this application. He stated that he did not want the present "F"_zoning changed, but would like to get the Variance from the Rear -Yard Provisions to allow more parking in front. There were three objectors who own property on Stonewall Road to the north of this property. They object to the building set back to the property line. There no alley. Mr. Maris stated that the proposed structure would be one-story, but +e�.,.auld be two levels in the rear which would be used as a storage room downstairs. The front of the lot is level with the street. A motion was made that the Variance be approved provided the building will have no outside entrances to the building fr:w the rear except an em.:rger5cy door as required by the fire code, and provided that the remaining rear yard, only 5 feet in depth, be hard surfaced. Also that there be no garbage cans located et the outside of the building at the rear. The motion was seconded and passed unanimously. Item No. 6 - (Z1629) Applicants Calvary Baptist Church Locations 1901 North Pierce Street Descriptions Lots 13 through 17, Block 6, Mountain Park Addition Classifications °1AOI-One-family District Variance: Requests a Variance from the height and setback provisions of Section 43-12 of the Code of Ordinances and Section 11 of the Zoning Ordinance to permit construction of a Church to three stories and build to the property line on one side, and the rear There were no objectors. It was pointed out that it is the intention to build an educational building on the back of the three lots. Theyown one-half block except for one house and lot. Their plan puts the building closer to the boundary than requirements would permit. The part that is too close is a stairway on the back of the building. They will acquire property -to the south later on. A motion was made that this Variance be approved in that it is in line with the existing church building, and there is commercial property on the north side of the alley. The motion was seconded and passed unanimously. Item No. 7 - (Z-1626) Applicant: Walls Trimble Locations 2821 Youngwood Road Descriptions Long Legal Classification: 01A"-One Family District Variance: Requests a Variance from the Front and Rear Yard Provisions of Section 43-12 of the Code of Ordinances and Section 11 of the Zoning Ordinance to permit an addition to the existing structure re SOIL. R. Board of Adj ustment -4- ,'Minutes - April 20, 1964 Item No. 7 (continued) Mr. Walls Trimble was present. There were no objectors. Mr. Trimble said that he W had talked to the-iffinediate neighbors who had no objection. The addition will be of CL frame construction. The present house is brick -veneer but it will blend with the house. The back of the proposed structure will have no windows. The property behind this is up high and drops off to the back, and will not be objectionable to them. The Staff recommended approval of this application due to the shallow depth of the lot and that the lot hps a ditch along the rear and worth property line. A motion 0 was made for approval, which was seconded and passed unanimously. M Item No. 8 - (Z-1617) Applicant: T.H.B.Corporation Locations 1100 Block of Fair Park Boulevard Description: Lots 1 through 6, Block 1, Peay and WorthenDs Addn. Classification: BIF"-Commercial District Variances Requests a Variance from the main structure and lot area per family pro is �:.ns of Section 43-15-5 and Sec. 43-2-5 of the Code of Ordinances and Section 2 and Section 13 of the Zoning Ordinance to permit construction of an apartment house development and approval of a development plan. There were no objectors present. Mr. Harry McDermott was present to represent the owner. This area includes six lots in the 1100 Block of Fair Park Boulevard now being used by Harvill-Byrd Electric Company, an old building formerly used as a lumber yard, and later as a stable. This area is zoned 'IF" -Commercial, but this construction would only need "E"-Apartment zoning. Mr. McDermott said that this apartment house would upgrade the area and be an improvement over other buildings that are there at the present tirme, The new structure would include 54 units, ('')parking would be under the building which would be of fireproof construction. The w intention is to have a service area in the rear for trash and garbage pickup. The � structure would be of frame and brick construction. Stolzer Location: 4700 Marlborough Street Description: Lot 4, and the North 10 feet of Lot 5, Block 9, Pike Addition Classification: "A" -One -family District Variance: Requests a Variance from the Side Yard Provisions of Section 43-12 of the Code of Ordinances and Section 11 of the Zoning Ordinance to permit an addition to an existing structure. Mr. Stolzer was present. There were no objectors. The Staff could have approved this application for a building permit except for the fact that the proposed addition to the existing structure is within the setback area one foot.- A motion was made that this Variance be approved which was•: seconded and passed unanimously. ItemNo. 11 - (Z-1615) Applicant: Mrs. Katherine Meehan Location: 4201 West 21st Street Description: Lot 6, Block 6, Sam Welch Addition Classification: "B"-Residence District Variance: Requests a Variance from the Use Provisions of Section 3, and Section 10 of the Zoning Ordinance and Sections 43-3-1 and 43-11 of the Code of Ordinances t-o permit addition of a bathroom to an existing non -conforming duplex. Mrs. Meehan was present. There were no objectors. She stated that she wanted to add a bathroom on the west side which has been used as a duplex for 23 years. This property has never been zoned for. a duplex, and the bathroom is for the use of the tenant on the west side. A motion was made that the application for Variance be approved, which was seconded and passed unanimously. Item No. 12 - (Z-1638) Applicant: Church of the Open Beer Location: 4801 West llth Street Description: Lot 7, Block 28, Cunningham Addition Classification: 'IS" -Residence District Variance: Requests a Variance from the Rear Yard Provisions of Section 43-12 of the Code of Ordinances and Section 11 of the Zoning Ordinance to permit addition to existing Church -6- L. R. Board of Adjustment Minutes - April 20,_1964 Mr. Arvis W. Griggs, Pastor of the Church was present, along with two members of his congregation. He stated that they want permission to build to the alley which would be for an educational building directly behind the present auditorium to add more facilities for Sunday School classrooms and training units. They want to have a building comparable with the present auditorium, which seats about 140 to 200 people. This building would take care of growth for the next five years. They plan to install a kitchen in the new building. There were four objectors presents Mr. and Mrs. George Malczycki, 4811 West 11th Street; Mrs. Pauline R. Tucker, 4815 West 11th, and two other neighbors. Their objection mainly was to traffic and parking problems which would result. Also to the high wall of the church building to the next door occupant. The Church has contacted the National Food Store for permission to use their parking space, and submitted it to the Board in the form of a letter signed by the Manager of the Store. (Mr. Joseph Kemp advised in Executive Session that this was a "permission", and was nothing permanent). After much discussion, a motion was made that this Variance be denied, which was seconded and passed unanimously. Item No.(Z-1604) Applicant: Lillie Hines Location: 2621 Broadway Court Description: Lot 7, and the west 9.5 feet of Lot 8, Block 4, Retan's Addition Classification: "CI' -Two-family District Variance: Requests a Variance from the non -conforming Uses Provisions of Section 43-11 of the Code of Ordinances to permit addition of a bathroom to -non -conforming apartment house, and Section 10 of the Zoning Ordinance There was no one present to represent this application,nor any objectors. A motion was made for approval of this Variance as there is considerable apartment usage in this neighborhood. The motion was seconded and passed unanimously. IV■ OTHER MATTERS Z-1607 - Reconsideration from March, 1964 Applicant: Location: Description: Classification: Variance: Twin City Tool and Die Company 7411 Woodson Road Long Legal "A" -One -Family District - Requests a Variance from the non -conforming uses provisions of Sec. 43-11 Code of Ordinances and Sec. 10 of Zoning Ordinance to permit expansion of a non -conforming use. Mr. Alfred G. Miller and Bernard Diggs, partners, were present to represent this application. They want to extend the building 281 because they need additional space to provide tooling for Little Rock indjstries which they are now turning down for lack of facilities. The building is now to capacity with machines, and with the new addition they could add more machines and labor. They do not own the real estate, but lease it. It would require $50,000. to relocate, and this addition would allow them the time necessary to increase their capital to the point where they could invest in a building at another location. It was stated that Mr. Diggs' mother- in-law owned a building site on the New Benton Highway which would serve their present _7a L. R. They are now working two shifts and still can't satisfy the needs of the manufacturers. They: are doing 90% of the work of such firms as DowSmith Chemical Company, Curtis Mathes Company of Arkansas and others. They now employ four full time employees, and approximately 6 part-time employees. With additional space, they could add at least four or five more employees. Kearney Dietz, Vice President of the Union National Bank of L. R. stated that he had known these men for a few years, and he believes that they are doing a good job. It is a practically new business, having been doing business since last August. They are not asking for rezoning, but want only temporary relief by this expansion. There is no noise connected with this business as it uses quiet operating equipment for bench and hand work. Everything in the shop is paid for, and they don't want to overload themselves financially for another building location. Mr. Farrell asked if a lease could be worked out giving them permission to build a movable type building which could be dismantled when they vacate the property. Mr. Miller said he would have to give this serious considera- tion. Mr. Kemp informed the Board that it was his opinion that the Board would not have the power to require the removal of this addition from three to five years in the future. The Board stood by its previous decision to deny the application. Mr. Lyons did not vote. 2. A motion was made to defer action on the policy concerning the use of certain parcels along the East-West Expressway until the next meeting date. The motion was seconded and passed unanimously.
