City Attorney Doug Smith, Gazette Reporter There being a quorum present, the meeting was -called to order at 2:00 P. M. by the Chairman. A motion was made for approval of the minutes of the last meeting as mailed, which was seconded and passed unanimously. Action was taken as follows. Tract No. 1 - Z-1928 Applicant: Kenheth Starnes Location: 2504 East 12th Street Description.- Lots 7 and 8, Block 10, Fairgrounds Addn. Classifications °1I"=Light Industrial District Variances.- Requests Variances.- (1) From the parking space provisions of Sec. 43-21 of the Code of Ordinances to permit less than required number of parking spaces (2) From the yard area setback provisions of Sec. 43-16 of Code of Ordinances to permit construction in setback area Mr. John T. Williams, Attorney representing Kenneth Starnes were bath .presernt-in the interest of this application. Mr. Williams stated that Mr. Starnes proposes to construct on the two lots a 39 unit motel for overnight transient private aircraft operators who would fly into Little Rock, -and leave their aircraft with the Starnes Aviation Service Board of Adjus-tment: MinLAeJs— Meeting December 20,1965-2- over night which is at the north end of the municipal airport. There will be no automobiles - hence no need for parking space. This is to be strictly a sky -travel motel service similar to those on existence at other airports. There will be avail- able upon these two lots 7 parking spaces, which will .be more than sufficient for loading and unloading and such other parking -as might be necessary. He said these facilities will not be used to any extent by motorists. There is to be a small restaurant primarily to cater to the guests of the motel whose hours of arrival or departure would be before or after those of the airport restaurant, and that there would be no kitchenettes in the motel -rooms. The garbage and trash accumulation will be picked up daily by the City and there will be adequate egress and ingress into the area for this purpose. The building is to be immediately adjacent to Starnes Aviation Service shop and office - almost a part of the same .building- and believe it would be a very compatible use, in Mr. Starnes opinion. He thinks that this new facility would attract people from other areas, and that the Airport Commission receives 6� a gallon plus 70% of parking fees on the ramp, and that a guest will spend from $25.00 to as high as $400. to $500. for fuel, etc. during his stay in Little Rock. Mr. Bob Crisp, Manager of t.h.e Airport, was present -to -get information about the applica- tion for Variances, wheth.er that was the- primary. consideration before the Board and if the operation of the motel would relate to the Airport in any way, and if the Board grants the requested variances would the applicant be permitted to construct the facility with no further hearing. He was informed that the request before the Board concerned only the Variances, that there would be no parking on the airport facility at all, and if the variances were granted the building permit could be issued as the zone classification of the property permitted such use. Mr. S. J. Beauchamp, a inember of the Airport Commission, Was present in opposition stating that the Commission had received a report on proposed airport expansion from an engineering firm•'and that- the -engineers recommended that the Airport build its own hotel. He stated that the area was not large enough for two mot,els. y Mr. Starnes argues that the; p.roposed construction :Af the Airport which Mr. Beauchamp was talking about could. not be finalized for a period of from three to five years, as it would entail a bond issue. A motion was made that the Variances requested be Rproved, which was seconded and passed unanimously. Tract No. 2 - Z-1907 Applicant: Marbar Wright Enterprises Location: 825 Main Street Description: Lots 5 and 6, Block 9, Original City Classification: ➢'Ha'-$vsiness District Variance: Requests a Variance from the Parking and Loading Requ.i..rem.ents. of Section 41-21 of Code of Ordinances to permit construction of a building Mr. Robert Shults, Attorney representing the applicant, was present who stated that this was the same application which the Board heard in October and since then they Board of Adjustmen-tKin-utes— December 20,1965 -3- have attempted to develop a plan which would be mare -acceptable to all concerned. They have modified the original plans so as _to: provride..loading facilities, and are now working out a lease arrangement with the First Presbyterian Church to provide for 32 parking spaces immediat-ei•y-adra�eent on the .east of the property involved which would be solely,for the use of customers of this business. The lease agreement for the parkin spaces would cover a five year period at which time they would negotiate a renewal or extension with the Church. Mr. Yandell Johnson, 113 East 9th Street, was present in opposition, who stated that in h-is opinion adequate parking area was not being provided because the ordinance set our requirements for 500 public parking -Spaces within a 600 foot radius and that apparently only 116 are available. Mr. Lyons explained to Mr. Johnson that this was an "either/or" situation - either 32 spaces would-be provided by the applicant on or adjacent to his property,or there were 500 public spaces in and out available within 600 feet. Mr. Longstreth, who owns.parking lots in the area on a monthly rental basis, has indicated his will i.ngness . to convert his parking spaces to "in and out" parking when the demand makes it feasible. A motion was made for approval, of the requested- Variance, subject to 'the applicant furnishing the Board of Adjustment secretary a. copy of. the lease for 32 parking spaces for a period of 5 years with an option to renew on re -negotiation from the First Presbyterian Church prior to the issuance of a building permit. The motion was seconded and passed unanimously. Tract No. 3 - Z-1925 Applicant: Skeets Dickey Location: 2422 Country Club Lane Description: Lots 11 and 12, Block 11, Country Club Re•i gh,t;s Addition Classification: "A" -One -family, District Variance: Requests. ay ua.ri ance f roan the Yard Area Setback Previsions of Section 43-12 and Section.43-2042)(e) of the Code of Ordinances to permit addition to existing structure Mr. Dickey was present and stated that when he bought thi s; house they thought they wanted another combination family room and bathroom. After the plans were drawn up, and they found they did not have a place to park their cars, they added a carpert, also a storage room for yard equipment, and desired to -6nclose- the 'front porch which is only 19 feet from the property line. His neighbors, -he said,had no objection to this construction. A motion was made for approval of the Variances,requested, which was seconded and passed unanimously. Board of adjustment Minutes December 20,1965 -4- Tract No. 4 - Z-1661 Applicant: W. S. Rogers Location: 5420 Kavanaugh Boulevard Description: All of Lots 8, 9, 10, 11 of Block 23 Newton's Addition Classification: "E-1" Quiet Business District Variance: Requests Variances (1) From the Rear Yard Setback Provisions of Sec. 43-14 of Code of Ordinances to permit construction of office building (2) From the Front Yard Open Space Provisions of Sec. 43-21-(H)(b) of Code of Ordinances to permit parking in Front Yard Space Mr. Raymond Block, Sr., was present representing the petitioner, who also was present. Mr. Rogers stated that the Post Office Department wishes to construct a building on th ese.four lots and would like to have a waiver of yard space, front and rear so as to arrange the building on the property to the best advantage. Mr. Farrell asked Mr. Rogers that if the application were approved would the large trees be preserved. Mr. James W. Swaim, real estate officer for the Post Office Department, was present who stated that his Department had requested 'these variances from the property owner -in order that the best possible utilization could be made of the property now and for futdre expansion. Mr. Swaim was asked if the north and east sides of the building would have windows or any other openings, and he replied that the plan calls for windows but they are not necessary except for ornamental purposes. Mr. Swaim also stated that they need parking space for permanently located trucks as well as space for patrons using the facilities of,the post office, for relatively short periods of time. As to the proposition of saving the trees, he stated that he had no authority to make such a commitment but that he would make an overture to the proper authorities that we would like to maintain as many trees as possible. Mr. Farrell stated that we would like the trees along the periphery of the property maintained - those which border the residential property. A motion was made for approval of the Variances providing (1) an effort is made to preserve the maximum number of trees now existing on the property - especially those on Kavanaugh Boulevard side of the property, (2) that appropriate screening be provided as required by the zoning ordinance, (3) and that curbs, gutter and sidewalks be provided where needed. The motion was seconded and passed unanimously. Tract No. 5 - Z-1926 Applicant: John Lipsmeyer Location: 1122 North Tyler Street Description: Lot--1, Block 7, Hollenberg Addition Classification: "All -One -family District Variance: Requests a Variance from the Side and Front Yard Setback Provisions of Section 43-12 of Code of Ordinances to permit addition to existing structure Mr, and Mrs. Lipsmeyer were present in the interest of this application. This Board of Adjustment Minutes Decembef 20,1966 -5- request involves a porch on the north side of the house (Evergreen Street) which extends 3 feet into the street right-of-way, which they stated they would remove but would need a little -time -to complete theproject as they would have to move a washing machine, a dryer and hot water tank to the proposed addition at the back of the house. A motion was made for approval of the Variances provided the rear porch now exist- ing be removed within a period of 25 months (by January, 1968). The motion was seconded and passed unanimously. IV. OTHER MATTERS 1. Approval of 1966 ca.lenda.r. A motion was made for approval of the 1966 calendar which was seconded and passed unanimously.
