City Attorney Jerry Dhonau Action was taken as follows: - Tract Now 1 - I-1874 Applicant: Location:, Description: Classifications Variance: 9 MINUTES "2:00 P. M. George L. Cook. 3815 Kavanaugh Boulevard Tract "B"-Allsopp Valley Subdivision "D"-Apartment District Requests Variance from the Main Structure Provisions of Section 43-2-(5) of Code of Ordinances to permit more than one main structure on a lot. Mr. George L. Cook, the applicant, was present.., and stated that this was the second phase of a three phase apartment project of 160 units to be built at 3800-15 Kavanaugh.. This plan is a continuation of the two present buildings, will be in line with the buildings and 75-80 feet east of them. There is no outlet from these buildings to Kavanaugh Boulevard, and access will be from the original drive which is 40 feet wide. The third phase will be behind these buildings facing.North Lookout and the alley will be used as an access from Lookout. Mr. Cook was asked about a turn -around drive at the east and of the buildings and he stated that a problem has been created by vandals and young speeders using the drives to circle the two buildings now constructed causing disturbance and annoyance to the tenants. Board of Adjustment Minutes - 8-16-65 -2- He stated that the tenants have ample room to park and back out as the proposed spaces are 11 feet wide (only 9 feet being required by the Ordinance). These buildings will be the same type of structure except that the units are larger by 25 feet than the existing units. Mr. Cook was asked about the drainage problem which.he said would be taken care of either by channeling it down (Cavanaugh Boulevard with the City's permission, and by extending curb and gutter all the way up 20 feet past the-east;line on to Allsopp Park property, or piping it off some way, whichever is most practical, but that he was aware of the problem and would have to take care of it some way. The proposed buildings will be within 6 feet of the east property line (Allsopp Park) which Mr. Cook said was the best utilization of the land as it is adjacent to Allsopp Park property which is a wooded area. He also stated that there is roughly 14 feet of trees between the two developments which would be saved. In Executive Session a discussion was had as to,th a feasibility of the construction of these buildings and various reasons were given by the members of the Board for denying this Variance. Mr. Meeks stated that in his opinion it was an over- development of the property,and also should have a driveway around them. Another opinion was voiced that the area is too congested, and that the access is not adequate, and that the petitioner should submit another proposal correcting these undesirable features, cutting density down to about one-half, that sufficient space should be provided for tenants to get in and out, and that this development would only compound an already bad situation. A motion was made that the request for Variance be denied, which was seconded and passed unanimously. Tract No. 2 - Z-1871 Applicant: Joseph Kaufman Location: 5901 "H" Street Description: The West 70 feet of Lots 19 and 20, Block 7, Lincoln Park Classification: 110-Two-family District Variance: Requests a Variance from the Use Provisions of Section 43-4 of Code of Ordinances to permit construction of parking lot. Mr. Kaufman was present in the interest of this application, and stated that this property lies 300 feet east of University Avenue and that he proposes to construct a one-story solid brick 11E-1" office building, and that it is his intention to construct a parking lot across the alley and adjacent to the office building. The two lots that the building will occupy were purchased in 1952. Two years ago he purchased two lots to the east of this property on which he built a duplex for income purposes. Since then it has been determined that there is a problem of an illegal subdividing of these lots that the duplex occupies- 80 feet of Lot 20 and 60 feet he retained which he is now proposing to use as parking space for the office building. He has since sold the duplex to Charles Fox. The west 60 feet of Lots 19 and 20 would provide 12 parking spaces for the office building. He has attempted to work out the subdivision of the two lots with Mr. Fox who was Board of Adjustment Minutes - 8-16-65 -3- the second buyer of the property. The alley is open and it is the only access to the apartments behind it, the Town House. Grant Street to the east has never been opened but is being used by the apartment occupants. The building is to be used .f.or-. of.f..ice space for an orthodontist, and an allergist in the other two spaces, and would be similar to the Storthz building across University. Mr. M. R. Godwin was present in opposition representing Charles Fox, :owner of the duplex on the east 80 feet of Lots 19 and 20. He stated that the subdivision requirements were being circumvented and should be worked out with Mr. Kaufman rather than granting the Variance. In Executive Session, it was the feeling of the Board that action should not be taken until the matter of the ille al subdivision of Lots 19 and 20 is resolved and that parking be denied on the west 60 feet of these lots. A motion was made that action be postlaaned until such time as the Board has been notified by the City Attorney's office that the legal problems have been taken care of. The motion was seconded and passed unanimously. Tract No. 3 - Z-1876 Applicant: Broadmddr Builders, Inc. Location: 1123 South University Avenue Description: Lot 2 and Tract "A" University Commercial Subdivision Classification: "F "-Commercial Di -strict Variance: Requests a Variance from the Height Provisions of Section 43-15 of the Code of Ordinances to permit construction of office building Mr. A. B. Speights of Fausett and Company, Inc. representing the applicant, was present. He stated that they propose to build an eleven story office building, ten stories above ground, for a total height of 141 feet and that an "F"-Commercial District oiy allows a height of, 75 feet. 184 parking spaces will be provided and only 11f6 are required. Mr. Spei ghts commented that th i s building Will be a wonderful addition to the City, and will beautify the corner of 12th and University Avenue. It will be an 80' X 80' building on a plot 2651 deep by 470' long. A motion was made for approval of the Variance requested, which was seconded and passed.. Mr. Farrell disqualified himself and did not vote. Tract No. 4 - Z-1860 Applicant: Ted H. Brewer Location: 1401 South Buchanan Street Description: The•North 1/2 of Lot 21, and all of Lot 22, Block 7, Oak Forest Gardens Addition Classification: PA" -One -family District Variance: Requests a Variance from the Side Yard Setback Provisions of Section.43-12 of Code of Ordinances to permit addition to existing structure. Board of Adjustment Minutes a .- 36-b5 -4- There was no one present to represent the applicant, and no objectors. A motion was made for aI r� of the Variance provided that off-street parking is provided in the rear yard space. Mr. Wm. Finley Williams, a new member of the Board replacing W. H.
