He stated that this property is located on the southeast corner of University and "H" Street which is roughly a half city block, 300' X 1401. The petition was filed by Gene Lewis, realtor, who was also present. Messrs. Dante Jacuzzi and Lyan,,Wallace were present representing the Jacuzzi Company who were present to answdr' questions of the Board members. 1&. Mr. Dover replied that the paragraph after the one Mr. Terry quoted says "the Board shall not permit as a variance any use in a district that is not permitted in this chapter." Mr. Terry replied that in their opinion the use is permitted, and that is what this Boardlis doing today - finding out whether or not this use should come under this provision of a clinic. This Board can construe what is a clinic.*' Mr. Dover asked "did you say this is a use permitted?" Mr. Terry replied in the affirmative. Mr. Dover then questioned the Staff as to whether or not the variance as stated in the agenda is a direct quote from the application which reads "requests a variance from the Use Provisions of Section 43-6 of the Code of Ordinances to permit a use in a District where not specifically permitted by Ordinance." He said "when I read that request and read the paragraph out of the ordinance, we do not have the power to permit a use as a variance, I am pretty well stymied in my own mind about our power to do what you are asking us to do." ' Mr. Terry said that perhaps they could amend the specific language of the application w to request a construction for this purpose into this ordinance. He said 'we do not admit for a minute that this purpose is not provided for in this Section or any other lesser section than "E-l" Quiet Business. We understand that the Staff feels that this use is not covered by "E=1" m that it per se does not object to this particular health center on that particular location. (ed: this is erroneous. The Staff has made no such statement). We think and understand that the Staff feels that if it were covered - that if the language "health center" were in there they would have no objection to that: and that is what we are here for today ;- to see whether or not it fits within the "E=1" classification or any other classification. There -is another section that we would like to call to the Board's attention n 43-4 "C"-TVo=family. (5) of that section provides for private clubs, fraternities, sororities.,and lodges, excepting those the chief activity of which is a service customarily carried on as a business". I am not quite sure what that means. This will be a club type operation where members pay dues in exchange for being permitted to use the faciliti. It will be carried on for a profit and perhaps that does exclude it from this section, but we still would like to call the Board's attention to that provision. We don't feel that the absence of these magic words "health studios"' in this Section "En1" in this old ordinance should prevent this type of development. When this ordinance was dawn, I am sure nobody heard of a health studio - nobody here in Little Rock has heard of one within the past four months. I read about one in the papers the other day - it is a new concept which we feel fits within the "E=1" Quiet Business classification." At this point Mr. Flake read the Staff's recommendation as follows: "The Staff recommends denial of this application. The petition does not specify the intended TIi use of the property. .However, the applicant did state that the intended use of the land is for a Health Club. This office advised the applicant that (1) this proposed --use does ,not fail within the category -of uses permitted in an "E-101 District; (2) the fact that it is called a Club is not material when in fact it is a profit making enterprise whose business is that of providing services associated with that type of activity. The chain originated in Nashville, Tennessee some lZ years ago and that is where I first became acquainted with the facilities, when I was over there in Vanderbilt University. He has had quite a bit of experience he has had none of these facilities "go under''. You will notice that it -is very much of a single purpose building and with a sizeable investment like this they would have to be sure that it would not turn into a so - balled "massage parlor". You would probably frond much cheaper structures to fit massage parlors in than this. It is on a membership basis, it is a private club, and you :have' to purchase a minimum of one year's membershipe It " is .excluded from someone on the outside coming in on a drop -in sort of basis. They do allow a' member to bring'a prospective member as a guq t one time, and this. ► ould be the only person outside of the members who could participate in this Club.O° When asked about the size of the membership a club of this size would support, he said this is a very unusual situation. In the Clubs in Memphis and Nashville, which are the ones he was familiar with, he said they will have as many as 1000 members in a cIub of this size. The building itself is akound 9000 square feet, but it is very peldom that there are more than ten people in there at amy- one time. The members come at various times of the day at their convenience - morning, noon, or evening, and it is not something where you would have something like a bowling tournament where- everybody comes at the same time. The traffic problem created by this would probably be less than -a doctors" clinic.- Mr. Lewis said the membership requirements are determined by the owner. Mr. Lewis said that it appears from the zoning ordinance that were this not operated on a profit basis it mould fall in the "C"=Two=family classification$,, but because there is a profit ,motive aaavolved it required "P"-Commercial zoning according to the Staff. He said "I was the one who filed the petition and I have been working on this since mid -September, and the Staff from the start has said this would fall in an "i'"=Commercial District and said outright that they would fight it being rezoned since there was no "F"=Commercial surrounding it. (eds The Staff did not use the term "fight", but did say rezoning of subject property to "P" Commercial would not be recommended). I don't know that in filing the application I could have been at fault in zot knowing exactly what to put down. I an sort of at then mercy of the Community Developaimt Department in filing this application, since it took finally Mr. Bowen --talking to Mr. Taylor to find out exactly what remedies we could havie to get a decision ass this, and his recommendation was that we cold come before you to appeal the Staff's decision which we feel this is. When I first received notice that this use would require an "P"-Commercial zoning, it was in a letter from Mr. Barber on October loth, and an attorney's opinion on it. The attorney's opinion from what I could gather stated that a massage parlor required "PI -Commercial. What we want to do is to dispel the idea that this is a massage parlor. This is a health studio, it is a health center, and there is some relevance in saying that the classification is not unlike a medical clinic since they do have trained physical therapists who do work with doctors and therefore it is not so far removed.- When questioned as to the manner in which this situation was resolved in other=v ities, Mr. Lewis said that in Memphis they had a zoning ordinance similar to ours which was somewhat old and outdated, and they;had to file for a particular property Mere they wanted to locate close. -to the hospitals there, and that Memphis had ruled that they would fail into a bstegory not unlike beauty shops, clinics, etc. This is the only other circumstance't'hat I know that they have had to appeal on the ordinance, he.said. Mr. Lewis stated that their position is that this is a medically related facility, and therefore could be included in that category called "clinic, medical or dental." Mr. Grundfest asked Mr. Lewis what his time schedule was on this facility, and he replied that they were asked -to submit a development plan which they do not have due to the fact that they did not know what the loam of Adjustment's decision would be.,- but it would take a minimum of 60 days to start construction. He said "we have been waiting since September and have wasted that much time." Mr. Grundfest said that he would like to have time to have the Staff investigate how these enterprises have been handled in other cities that have these facilities now. In his opinion this would possibly have some bearing. "One of our conceri4s is. the setting of a precedent of interpreting what goes in an "E-V Quiet Business District which we don't feel we have the ability to do or authority to do." Mr. Lewis stated that there is one thing about classifying all health studioa as Clinics - the other health studio which is under construction now does retail and does not have the therapy related programs that this one does. Actually it is two main structures, and only one is allowed." Mr. Dover said "that is why we are being asked for a variance", and asked how long that structure had been there as there has been some question as to whether,this is a rmw structure. Mr. McMinn said it is practically new. "There was a structure there but they moved it back and the first time I saw it was ofterhe had.made a deal for somebody to jack it up and fix: it. He had to practically re -work. -it." Mr-. Gtundfest asked if the building existed and was moved, or was it totally wrecked and then re -built in another location. Mr. McMinn said it was actually moved without being destroyed and re -built, was rem�r,,dele4 and added to. Mr. Venhaus commented that he did not think Mr. Grundfest°s question was completely answered as to whether or not the building was completely dismantled and completely rebuilt on anew foundation, or whether it was simply slid -over, and asked Mr. Roy Beard, the Director of Inspections, to enlighten the Board. Mr. Roy Beard stated that this building was relocated and encroached 4 feet into the right-of-way and was moved intact to a new location legally situated on the lot, and then substantial repairs were made to the building after relocating it, but it was a relocated building. Mr. Williams asked what the use of the structure was prior to its being moved. Mr. Beard said that Mrs. Johnson had indicated that it had been used as a dwelling in years past, but had not been used for anything other than storage for a number of years as it had completely decayed and was ip very bad condition. Mr. Beard said it did not have any pikmobing fixtures originally. Mr..Grundfes.t asked how did they happen to move- the building e how did it originally come about, Mr. Venhaus said he would imagine in connection with the Urban Renewal Project in the area. -they were told to move it by the Housing Authority, to dismantle it or repair it. Mr. Bill George of the Housing Authority was present and ,stated that this particular lot is within the Urban Renewal Project for the High Street area which project was approved by the City Board of Directors. He said "this particular situation originally came to our attention because of its dilapidated condition. We attempted to encourage the owner of the property to remove the build- ing because it was substandard and decayed. As a result of this original request, and our many attempts to have the property demolished, it eventually resolved into the situation as it is now.
