Staff Recommendation: The existing structure on this lot is
nonconforming due to insufficient yard space separation between
the carport and the east property line (Ord. requires 8',
existing 3'). The applicant's request is to construct another
nonconforming addition located 7' from the west property line.
The variances as requested involve first, approval for an
addition to a nonconforming structure and second, said addi-
tion be allowed to encroach into a side yard space requirement.
Given the relationship of this structure to structures on
adjacent lots, the staff feels there is adequate separation
between buildings to warrant a recommendation of approval of
the variances as requested.

BOARD OF ADJUSTMENT ACTION: THE BOARD OF ADJUSTMENT VOTED
TO APPROVE THE VARIANCE AS REQUESTED SUBJECT TO BOARD OF
DIRECTORS NOT PURCHASING THE SITE DUE TO MASTER -STREET
PLAN ISSUE.(5 ayes - 0 noes)
Staff Recommendation: The structure on this lot is noncon-
forming. Any addition would necessitate a Board of Adjustment
approval. Also, the proposed addition is located within the
rear yard setback area requiring an additional waiver from the
Board. In reviewing this application, the Traffic Dept. had a
negative response to the issue citing several obvious problems
such as: inadequate curb, gutter and sidewalk, length of exist-
ing curb cuts on east and west sides of subject property (Ord.
12,501 places maximum curb cut at 40', existing is 80') and the
proximity of the pump island to the property line (Ord. requires
15' distance, existing is 10' and 11.5'). The Planning staff
notes additional existing problems such as: the size of the
lot, the absence of off-street parking and the location in
general. These items, along with the fact that subject property
lies within the master street plan (which issue needs to be
reviewed by the Board of Directors), leads the staff to the
conclusion that any additional improvements would only compound
the problem of congestion and confusion resulting from the
entering and exiting traffic of the service station and that
said improvements would also increase the value of the property
necessitating additional public funds if and when acquisition
is required. Therefore, our recommendation is denial of this
variance request.

BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE
VARIANCE AS RECOMMENDED BY THE STAFF. (5 ayes - 0 noes)
Staff Recommendation: This variance request involves a rear
yard setback waiver for a drive-in bank. The staff recognizes
the existing retaining wall on the east property line as an
asset to this application as its elevation adequately pro-
vides a visual separation between the proposed encroachment
and adjacent properties. In reviewing the requested variance,
the Traffic Dept. showed considerable interest in congestion
on Kavanaugh Boulevard. Their comments included questionable
ingress and egress, maneuvering, parking and stacking of the
autos generated by this use. The staff sees no problem with
the requested yard variance and recommends approval of the
application contingent upon the applicant and the Traffic
Dept. meeting and working out the aforementioned concerns.
There were no objectors present. There were several letters
in support of the variance.

BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO DEFER THE
CASE UNTIL THE REGULAR DECEMBER MEETING. (5 ayes - o noes)
Staff Recommendation: This application originally involved
a 2 sq. ft. sign variance (Ord. permits 8 sq. ft., proposed
10 sq. ft.). Staff inspection revealed a total of six signs
on subject property totalling approximately 27 sq. ft. The
staff recommends approval of the variance request and reten-
tion of all existing signs, except the ground mounted
address sign, subject to moving the exit sign 3 ft. + to the
west in order to alleviate the sight problem the motorist has
with south bound traffic on Chester Street when leaving
subject site. The staff suggests that the numerals indicating
the location be placed either on the building or on the brick
base of the principal sign. The staff also notes that Sec.
43-6 (9) restricts signs in this zoning classification to
indirect lighting. The principal sign on this sight has
interior lighting which we feel is not objectionable and would
recommend approval of a variance from this restriction as well.
There was no one present to represent the application. The
policy of the Board is to defer the application 30 days under
this circumstance.
