THIS VARIANCE REQUEST. (4 ayes - 0 noes - 1 absent)
Staff Recommendation: This application was filed as the
result of a zoning violation investigation. The Staff
recommends the approval of this variance request. The
request is for two signs, one building mounted and one
ground mounted and is in line with the provisions of
the proposed sign ordinance now under development. The
sign height and areas are both within the allowable
under the proposed ordinance.

BOARD OF ADJUST LNT ACTION: THE BOARD VOTED TO APPROVE
THE VARIANCE AS REQUESTED. (4 ayes - 0 noes - 1 absent)
Staff Recommendation: The Staff recommends the approval
of this variance request. The applicant proposes to
construct an open canopy over an existing concrete patio.
The terrain is such that a 5 ft. intrusion into the rear
yard would not affect adjacent property owners. The
owner indicated the canopy would help solve a drainage
problem at the rear of his residence.

BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO DENY THE
VARIANCE REQUEST. (4 ayes - 0 noes - 1 absent)
Staff Recommendation: The Staff recommends approval of
the requested variance. The Staff in reviewing this
issue has determined that the proposed sign will in the
future be located in public right-of-way as the access
drive to this development is to be dedicated. The Staff
takes no issue with the sign location or its size or
design, only that some provision should be made to
guarantee the maintenance of the structure and traffic
island after dedication. Applicant should work with the
City Attorney to draw up a satisfactory maintenance
agreement. The Traffic Engineer's office has indicated
that the proposed location should not present site
distance problems.

BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE
THE (NON_ ILLUMINATED) BUILDING MOUNTED SIGN AND DENY THE
FREE STANDING SIGN. (4 ayes - 0 noes - 1 absent)
Staff Recommendation: The Staff recommends approval of
requested variance. The two signs as proposed would be
in line with the proposed sign ordinance as to area and
height. It has been indicated by the persons involved in
this request that these are the only signs to be allowed
on subject property. The Staff feels that with one tenant
occupying all allowable sign spaces, additional variances
may be requested in the future. Although we cannot deal
with sign copy, it should be noted that the new ordinance
will allow no additional signing on this tract except for
"0" Street frontage (one free standing sign). The appli-
cant should consider this in committing their entire sign
copy to one tenant.
There were 5 persons who spoke in opposition and a petition
containing 57 signatures of objectors was placed on file.

BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO WITHDRAW
THE VARIANCE REQUEST BECAUSE THE APPLICANT FAILED TO ATTEND
THIS MEETING OR THE PREVIOUS MEETING. THE APPLICANT MUST
REFILE HIS APPLICATION IF HE DESIRES TO PURSUE THE MATTER
FURTHER. (4 ayes - 0 noes - 1 absent)
Staff Recommendation: This application was deferred from May
20th meeting due to applicant's failure to have representa-
tion at the meeting. This application is the result of a
rezoning application for "H" Business on these lots. The
Staff recommended "E-l" as office uses were to be developed
and the area in general is being developed in that manner.
The Staff recommended that the Planning Commission defer the
case to provide the applicant an opportunity to file for Board
of Adjustment review of his proposal prior to the Planning
Commission recommendation on the zoning. The Staff feels that
the proposal as presented is in line with development in this
block and recommends approval of the variance as applied to
Lots 1 and 11. The 3rd lot in this request is owned separately
and the proposal is to add to the building on the lot to the
west. The Staff recognizes that whatever disposition is made
of this 3rd lot, waivers are probably going to be necessary,
but we would suggest that since there is almost no additional
parking available, no waiver should be granted this lot until
a specific proposal with parking can be submitted. The Staff
suggests however that if the Board decides to deal with this
lot at this time, that the maximum floor area be limited to
that which on site parking will support, as the existing build-
ing has minimum parking provided.

The Board approved the appointment of Mr. Finch as
secretary.
