THE APPLICANT IS TO RENOTIFY PROPERTY OWNERS. (3 ayes - 0 noes - 1 absent) Staff Recommendation: The Staff recommends approval of the requested waivers. We feel that the proposal presented to us adequately deals with building setbacks and livability space and in essence all that is being waived is the technical requirement of setbacks between units required because of the platting of individual lots. Overton 5300 Hawthorne Road Lot 1, Block 5, Newton Addition "A" One -family District Variance: Requests a variance from the Rear and Side Yard Setback provisions of the Code of Ord. of Sec. 43-12 to permit con- struction of addition to residence encroaching into side and rear yard BOARD OF ADJUSTMENT ACTION: THE BOARD OF ADJUSTMENT APPROVED THE VARIANCE REQUEST SUBJECT TO A MINIMUM OF 12 FEET BEING PROVIDED FOR REAR YARD SETBACK. (3 ayes - 0 noes - 1 absent) Staff Recommendations: The Staff recommends denial of the requested variance and recommends instead redesigning the proposed addition to give the applicant approximately the same square footage and at the same time retain a 12 to 15 foot yard setback as opposed to the 6 ft. setback in the proposal. There was an error in the applicant's survey which when corrected would allow approximately a 14 ft. rear yard and the applicant was therefore in agreement with the Staff's recommendation and the Board's action. There were no objectors present at the meeting. - 3 - Item No. 4 Case Number: Applicant: Location: Description: Present Classification: Z-2806-A Ione Colquette 9201 West Markham Street Long legal "E-1" Quiet Business District Variance: Requests permission under the provisions of Sec. 43-2 of the Code of Ordinances to permit parking lot for commercial use in an "E-1" zone BOARD OF ADJUSTMENT ACTION: THE BOARD OF ADJUSTMENT APPROVED THE VARIANCE REQUEST SUBJECT TO: (1) The deletion of the additional curb cut into this site. (applicant to utilize the previous 4 curb cuts approved by Traffic Department.) (2) The screening and planting as proposed on the plan on west property line to be installed. (3) The screening along Markham Street to be worked out with. the Staff so as to provide adequate sight distance at entries and exits. (4) All trees possible 8 in. or larger in caliper to be saved. A plan for tree protection and parking redesign to be reviewed by Staff. Applicant is to have right of appeal to Board if no agreement with Staff can be reached with no notice or fee required. (3 ayes - 0 noes - 1 absent) Staff Recommendation: The Staff recommends approval of this application. On March 8, 1974 the Planning Commission zoned this parcel "E-l" Quiet Business and a tract to the east "F" Commercial. The applicant plans to utilize this 100 ft. strip for 113 parking spaces which are not required by ordinance. The applicant proposes a 6 ft. masonry and wood fence and a 4 ft. planting strip along the west property line as a screen for the residential area to the west. The Staff is in agreement with this proposal. There were no objectors present and one letter of objection. - 4 - Item No. 5 Case Number: Applicant: Location: Description: Present Classification: Z-2827 United Artist Theatre Circuit, Inc. 5600 Kavanaugh Boulevard Long legal "A" One -family District Variance: Requests a variance from the Area and Use provisions of Sec. 43 of the Code of Ordinances to permit ex- pansion of a nonconforming use and structure (existing Heights Theatre building and adjacent restaurant Requests a variance from the Off-street Parking provisions of Sec. 43 of the Code of Ord. to permit less than required number of parking spaces BOARD OF ADJUSTMENT ACTION: THE BOARD OF ADJUSTMENT VOTED TO DENY THE VARIANCE REQUEST. (3 ayes - 0 noes - 1 absent) Staff Recommendation: The Staff recommends denial of this application until at least the ordinance requirement for parking can be met. We feel that 78 parking spaces is not adequate to serve even the existing use, and the proposed addition would only add to the problem. ( 3 ayes - 0 noes - 1 absent) Staff Recommendation: The Staff recommends denial of this application. The zoning ordinance requires 1.75 parking spaces for the Safeway Store alone but the Planning Com- mission accepted a plan showing 133 spaces. If the proposed structure were erected, it would eliminate 61 of those spaces now existing and add only 10 in return, for a total of 102 on the entire site. This means a deficit of 80 spaces from the zoning ordinance requirements would exist with this proposal. Luten 6600 Baseline Road Lots 1-R & 2-R of a replat of Tract 23, Arnolds High- land Acres "E-1" Quiet Business District Variance: Requests a variance from the Sign Area provisions of Sec. 43-6 of the Code of Ord. to permit sign area in excess of permitted BOARD OF ADJUSTMENT ACTION: THE BOARD OF ADJUSTMENT APPROVED THE VARIANCE REQUEST AS RECOMMENDED BY THE STAFF. (3 ayes - 0 noes - 1 absent) Staff Recommendation: This application is the result of a violation investigation by the Code Enforcement Division. The Staff recommends denial of this application in part. This property was involved in a sign variance request in December, 1972, at which time the Board approved the pole sign with 2 inserts at 2x2 ft. At that time there was one building mounted nameplate. The proposal at this time is the addition of a third panel 2x2 ft. on the pole sign for a total sign area of 12 sq. ft., plus 2 small signs 2x3 ft. freestanding at 12 sq. ft. total, plus other existing wall mounted signs. The Staff recommends 1 free standing sign be used at a maximum of 32 sq. ft. and 15 ft. high on the Baseline side and that each separate use within the complex be allowed 1 building mounted wall sign per street frontage -- maximum area to be 4% of the area of the facade it is mounted on. ROOF SIGN BE RELOCATED TO BE A WALL SIGN. THE BOARD NOTED THAT THIS VARIANCE WOULD ALLOW ONLY A 10 SQ. FT. ADDITION TO THE EXISTING POLE SIGN. (3 ayes - 0 noes - 1 absent) Staff Recommendation: The Staff recommends denial of this appli- cation in part. This property was previously involved in a sign variance on September 18, 1972, a:t which time the present pole sign at the southeast corner of this tract was approved by the Board. (1 pole sign with 4 faces 5x5 ft. and not to exceed elevation of top of building on property) The Staff recommends that only 1 free standing pole sign be permitted at a maximum area of 35 sq. ft. and 15 ft. height and all signing be located on this structure. The existing box sign on the corner could be utilized for this purpose. The Staff recommends the approval of the existing 3x5 ft. wall sign as located, and that each separate use within the complex be allowed 1 building mounted wall sign per street frontage - maximum area to be 4% of the area of the facade it is mounted on. - 9 - DEFERRED MATTERS: Item No. 1 Case Number: Applicant: Location: Description: Present Classification: Variance: Z-2579 B.C. (3 ayes - 0 noes - 1 absent) Staff Recommendation: This application was originally filed in 1972 as the result of a zoning violation investigation. The property lies within the Mills Freeway right-of-way, and at its meeting April 17, 1972 the Board deferred any action on the issue for a period of one year. T�:e owner was advised he would not be forced to comply with ordinance requirements. On April 1973 the Board ag._in considered the case and granted an additional one year deferral of a1.1 action.
