Wilcox Riddick Riffel, City Attorney Members absent: None 6-21-76 Item No. 1 - NEW MATTERS Case Number: Z-1629-A Applicant: Dwayne Fischer for Calvary Baptist Church Location: 1901 North Pierce Street Description: Lots 13 through 17, Block 6, Mountain Park Addition Present Classification: "A" One -family District Variance: Requests a front yard setback variance from provisions of Sec. 43.12(4) of the Code of Ord. to permit a 4 ft. front yard setback rather than 25 ft. BOARD OF ADJUSTMENT ACTION: THE 'BOARD VOTED TO APPROVE THE APPLI- CATION AS FILED AND FURTHER DIRECTED THE APPLICANT TO PROVIDE WRITTEN AGREEMENTS WITH OTHER PROPERTY OWNERS NEARBY FOR THE REQUIRED PARKING SPACES FOR THE TOTAL SEATING CAPACITY. THIS AGREEMENT IS TO BE PRESENTED WITH APPLICATION FOR BUILDING PERMIT (55 spaces required). (5 ayes - 0 noes - 0 absent) Staff Recommendation: In 1964 the Board acted to permit a three- story building and building up to the north and east property lines. At that time, plans showed a proposed 15 space parking lot proposed in the southeast quarter of the property. This parking was not provided at that time. Staff can not document but it is our understanding that parking was provided on the Kroger property across the street to the west. The staff sees two issues in this application. First is off- street parking which should be provided on this site or others nearby at a ratio of one to ten, based on seating capacity. It has been suggested that Pulaski Bank which is building on the Kroger site may provide the spaces. Second is street inter- section sight distance. Elevations of the patio and planters should be altered, if necessary, to provide a safe intersection sight distance at Pierce and "R" Streets. Subject to the above, the staff recommends approval. Donald Lee Thomas for Gospel Lighthouse Pentecostal Church 619-621 East 21st St. Lot 6 and the N90 ft. of Lot 7, Block 28, Bragg's 2nd Addition Present Classification: 110 Two-family District Variance: Requests a variance from the rear yard setback provisions of Sec, 43.12 (2) of the Code of Ord. to permit a rear yard of 7 ft. rather than 25 ft. Requests a variance from the front yard setback provisions of Sec. 43.12 (4) of the Code of Ord. to permit a front yard of 19 ft. rather than 25 ft. BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS RECOMMENDED BY THE STAFF. (5 ayes - 0 noes - 0 absent) Staff Recommendation: This application was brought about by a request for a building permit to add educational floor space. The applicant has stated that: (1) the addition will not in seat- ing capacity (2) 4 or 5 unimproved parking spaces are available on site, the balance is on -street (3) the addition will, tie the church to the frame.dwelling on the adjoining lot (4) use of the addition will be principally as education area. With the given information, the staff recommends approval of both yard waivers since the front addition is to the interior of the property, and the rear yard functions as a side yard relative to the adjacent property. Approval should be subject to staff verification of provision of additional off-street parking on this site or on nearby commercial lots which are'not used evenings or Sundays. There were no:objectors present. The Pastor of the church was present and spoke in behalf of the request. He stated that the church is removing the garage from the rear yard of this site in order to provide 8-10 spaces for cars and the possibility,of buying the lot adjacent on the west and using it for parking. MM 6-21-76 Item No. 3 - NEW MATTERS Case Number: Z-3037 Applicant: Nancy W. Chitwood Location: 9808 Snider Court Description: Lot 119, Treasure Hill Subdivision Present Classification: "All One -family District Variance: Requests a variance from the side yard setback provisions of Sec. 43.12 (3) of the Code of Ord, to permit a 2.7 ft. side yard setback rather than 7.1 ft. BOARD OF AD.TUSTMENT ACTION: AFTER A BRIEF DISCUSSION, THE BOARD VOTED TO DENY THE APPLICATION AS RECOMMENDED BY THE STAFF. (5 ayes - 0 noes - 0 absent) Staff Recommendation: The wood deck now in place may have been. built under a policy which permits decks and patios to occupy required side yard to the property line, provided they are no more than 18 inches above ground level, There is no indication that a permit was issued for this deck. Applicant proposes to remove this deck and reconstruct it following construction of the proposed addition. The addition is to be of conventional construction to match the rest of the house, presumably with a normal eave projection. A 5 ft. utility easement also occupies this side yard and would conflict with 2.3 ft. of the addition. The staff recommends denial due to questions of legality, con- sistency and safety. The deck as existing (and proposed) may be illegal. The addition, with a 2 ft. eave, would extend within 8 or 9 inches of the property line. Permanent improvements can not be built on an easement. Access for fire fighting might be unduly limited. The owner was present and spoke in behalf of the request. There were no objectors present, There were 3 letters presented in support of the request.
