Mr. Jerry Wilcox left meeting after hearing Item 4 which was called first. 7-19-76 Item No. 1 - NEW HATTERS Case Number: Z-2908-A Applicant: C. B. Pugh Location: 5908 West 19th Street Description: Lots 11 and 12, Block 24, Batsman's Subdivision of Cherry & Cox Addition Present Classification:"F" Commercial and "B" Residence District Variance: Requests a rear yard variance from Sec. 43-15 (2) of the Code of Ord. to permit a rear yard setback of 2 ft. rather than 25 ft. BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS RECOMMENDED BY THE STAFF, (4 ayes - 0 noes - 1 absent) Staff Recommendation: The history of the development on this site is short as the existing car wash was constructed in 1975, The original construction involved a variance to utilise the eastern- most of these 2 lots as drive access and parking. The Board at that -time required certain screening and landscaping to be done along the east line of the property. This has been done in a sat- isfactory manner and, in fact, the property is well maintained. The variance now before the Board involves extension of the build- ing 23 ft. on the north side; thereby, leaving 2 ft. of rear yard setback, The existing 6 ft. fence on the north, required by the Board previously, is approximately 4 £t. from the building. The staff feels that moving this fence to the north and extending the eastern 6 ft. fence will present little visual change from off site, The staff would recommend approval of the request subject to extending the existing east fence and moving the fence on the north side of the development to the north property line. There were several objectors present. The applicant was present. - 1 - 7-19-76 Item No. 2 - NEW MATTERS Case Number: 2-3045 Applicant: Mrs. Connie Holitik Location: 63 Edgehill Description: Lot 4, Edgehill Addition Present Classification:"A" One -family District Variance: Requests a variance from Sec. 43-12 (J) of the Code of Ord, to permit a wall (fence) of 8 ft. to 10 ft. in height rather than 6 ft. in a required yard area BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS FILED. (4 ayes - 0 noes - 1 absent) Staff Recommendation: This variance involves a masonry wall around a new pool area to provide better security and privacy. There are adjacent properties with fences, walls and hedges in excess of 6 ft. The adjacent residential structures are sited on large lots with good separation from this use area. The staff finds no problem with the proposal and would recommend approval as filed. There were no objectors present. The owner/applicant was present 2 - �7-19-76 Item No. 3 - NEW MATTERS Case Number: 2-3046 Applicant: Charles Galloway for Porter Briggs Location: 1507, 1515 and 1523 Cumberland Description: Long legal Present Classification:"D" Apartment District Variance: Requests a fence height variance in Sec. 43-21 (J) of the Code of Ord. to permit 6 ft. to 7 ft. variable rather than 4 ft. in a required front yard setback BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS FILED. (4 ayes - 0 noes - 1 absent) Staff Recommendation: The fence involved in this request is in place and varies from 6 to 7 ft. in height due to variations in grade of the lots. This block at Cumberland St. is one of older structures, some converted to multi -family, but with the appearance uniform. That is, good setbacks, normally in excess of 25 ft.. large trees on private property and street right-of-way. The bulk presented by this fence so close to the street impacts the structural relationships in a manner which suggests commercial intrusion. It has been suggested that security is the principal reason for the height waiver. Although this is probable justifica- tion, the staff feels that security could be maintained and an improvement in appearance if the fence were set back to the building line. The staff would, therefore, recommend denial of the request. There were no objectors present. There were several persons present in support of the request. 3- 7-19-76 Item No. 4 - NEW MATTERS Case Number: 2-3047 Applicant: Cromwell Firm Location: 200 Block E. Markham Description: Lots 7 through 11, part of Lots 4 and 6, Block 34, Original City of Little Rock Present Classification: "GB" General Business District Variance: Requests a Conditional Use Permit to permit a transportation (bus) terminal BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE CONDITIONAL USE PERMIT AS RECOMMENDED BY THE STAFF. THE APPLICANT STATED THE STAFF RECOMMENDATION WAS ACCEPTABLE. (3 ayes - 0 was - o absent - 2 abstained) (Sam Anderson and M. R. Godwin abstained) Staff Recommendation: Due to the involved nature of this request, the staff will attempt to relate the history significant to the case. This block is within the Central Little Rock Urban Renewal Project and at the time of adoption of the zoning plan for Central Little Rock, this block and several others were rot rezoned but included in the boundaries of proposed street realignment projects. The ordinance creating C.LR. zoning provided that these unzoned lots would, if developed, assume the zoning of adjacent property. The predominate adjacent zoning is "GB" General Business; thus, this property is assumed to be "GB". A review of the C.L.R. Ord, reflects that the use proposed, transportation terminal, is not permitted as a use by right, but, a Conditional Use Permit is required. Thestructureof the ordinance is such that transportation terminal is not a permitted use, but the property could be used for sales, service, or repair of equipment or ticket sales for such uses. The staff, in reviewing this issue, can find no significant problem that is not already being reviewed by other public agencies. The principal concern at this time is a request before the Board of Directors for waiver of a Master Street Plan requirement for LaRarpe/I-30 con- nection, which requirement would render the site unusable for the pro- posed use. The Board of Directors will consider that waiver at its July 20th meeting. The staff would reco®end approval of Conditional Use Permit subject to owner/applicant working with Community Services Dept. and Ark. Highway Dept. for some form of alternate improvements on LaHarpe to improve the turning movement (this could include dedication/reserva- tion of right-of-way,improvements constructed in conjunction with the building permit or a combination of the above.) - 4 - 7-19-76 Z-3047 - (Continued) The applicant was present, There were no objectors. A.M, Keith was present and asked questions relative to site access. The applicant presented a site plan and traffic movement plan and stated that plans have been drawn to provide a proper LeHarpe exit from the site. This includes cutting the curb return back some 13 ft. and converting the catch basin to a flat grate and leaving in place. 5 - 7-19-76 Item No. 5 - NEW NATTERS Case Number: 2-3048 Applicant: Joe Johnson, Cromwell Firm for John Cobb Location: 4800 Club Road Description: Lot 1, Block 1, Country Club Heights Addition Present Classification:"A" One -family District Variance: Requests a variance from rear yard setback provisions of Sec. 43-11 (2) of the Code of Ord. to permit an 11.3 ft, rear yard .setback rather than 25 ft. Requests a variance from the side yard setback provisions of Sec. 43-12 (3) of the Code of Ord, to permit 4.4 ft, side yard rather than 5 ft. BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS FILED. (4 ayes - 0 noes - 1 absent) Staff Recommendation: This proposal has no significant problems as the adjacent structures have good separation. The grade change on the property lessens the effect of a 2-story addition on the high aide of the house, The staff would recommend approval of the variance. There were no objectors present.
