Staff Recommendations:
In January of 1977, this applicant was before the Board of Adjustment
asking variances to allow construction of the apartments now on this
site.
In the approval of -that request, the Board placed a requirement for a 4
ft. high board fence along the north property line.
The owner is at the point of constructing the fence, and has been asked
by the owner of the property to the north to seek a waiver. That owner
suggests that a solid fence along this line will create problems with
transients, vandals, etc.
The applicant is willing, within reason, to compromise on the issue
either no fence or something less than the 4 ft. required.
The.staff is sympathetic with the neighbor's -wishes. However, we feel
that a minimum of screening should be maintained adjacent to a parking
area. We suggest that the screening requirement be retained but that it
be permitted at 30 inches in height.
This will be sufficient for a headlight screen for automobiles maneuvering
in the parking area; and at the same time not be large enough to provide
cover for vandalism or intruders.

There were no objectors presento- Athalea Walrod was present and spoke
for the variance. jThe owner was- present.! The Board, approved, the request
for deletion of th6 screening,requicement entirely. :-The.-vote: 4 ayes,

Staff Recommendations:
This request is before the Board as the result.of a denied rezoning
application.. The owner is attempting to gain permission to separate
utilities on.the structure in order to use a third unit of questionable
origin.
The owner attempted to gain "D"" Apartment Zoning on the property at the
November Planning Commission Public Hearing. The staff and the Planning
Commission -felt that "D" zoning should not be introduced onto 13th
Street.
The owner was instructed that if he could show -th-at the third unit had
-been -in--exi-s-tence for a significant time then the Board of Adjustment
might -look -favorably on a meter split.
The staff will not present a recommendation in writing at this time, but
will respond in the meeting to such evidence as the owner may produce.
Board of Adjustment Action-:
There were no objectors present. The:owner was present and submitted
letters from persons supporting his position that the third unit has
been in place since 1969. The Board voted to approve the request as
fi-l-ed and -allow three meters. Vote: 4 ayes, 0 noes, 3 absent.

Staff Recommendations:
This request involves a room addition which will encroach into the rear
yard some 3.3 ft. The principle reason,for,the encroachment is the
extension.of a roof line to provide a covered area to the rear of the
room addition.
This area is to be open on three sides. Staff finds no.problem with the
request.as.no light and air obstruction will result from the proposal.
We 'would, recommend approval as filed.
Board of' -Adjustment Action:
There were no.objectors.present. The owner's representative was present.
The Board approved the request .as filed. The vote: 4 ayes, O noes, 3
absent.
