Approval of the Minutes of the Previous Meeting. The minutes of the previous meeting were approved as mailed out. III. Description: Lots 1, 2 and 3, Block 28, C.O.Brack's Addition Zoned: "C-3" General Commercial Variance Requested: Relief from Section 7-103.3D to permit a five-foot front yard and a 20-foot exterior side yard. Present Use of Property: Vacant Proposed Use of Property: Accessory Storage for Kaufman Lumber Co. Staff Recommendation: The applicant was unable to attend the August meeting because he was involved in a traffic accident and unable to arrive at City Hall until 30 minutes after the meeting ended. These structures will be accessory storage and retailing facilities for the lumber company. The proposed location permits better vehicle access for offstreet loading and unloading. Alternate building locations would necessitate the use of public rights -of -way for part of the loading/unloading operation. Staff sees no hardship on any surrounding neighbor and recommends approval. Board Action: The applicant was represented by Bob Watkins, and he was present. There were no objectors. All Electric Supply Company Same Staff Recommendation: No adverse comments have been received from any reviewing agency. The applicant is seeking to omit the placement of an opaque screen around his outside storage. This stored material is mostly stacked against the building under a roof overhang or in some instances in neat piles out in the yard. The applicant's reason for seeking this waiver is his concern for the security of the materials from theft. Given a reasonable barrier to sight of this storage area, thieves could empty_ the yard in a matter of minutes because of the nature of the materials. Staff sees no reason that screening should be in place and recommends approval of the variance requested. Board Action: The applicant was present, and there were no objectors. The proposed expansion and setback from the neighboring property is consistent with other similar cases recently approved. No adverse relationship with any property results from the proposal. September 21, 1981 Item No. 4 - Z-3749 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: L.T. Willis and Verna Willis 316 N. Summit Lot 12, Block 2, Virginia Heights Addition "R-3" Single Family Relief from Section 5-101.F to permit an accessory building within 53 feet of the front line, one foot of the house and two feet of the side property line. Single Family Same Staff Recommendation: No adverse comments have been received from any reviewing agency. The applicant proposes to add to an existing carport in linear fashion so as to provide covered parking for two vehicles. The proposed structure is a freestanding carport which will be 10.5 feet wide and 40 feet long when combined with the existing carport. Three waivers are sought. An accessory structure in a residential zone is required by Ordinance to be 60 feet from the front property line, six feet from the principle structure and three feet from the side property line. The variances sought would allow this structure to be 53 feet from the front line, one foot from the house and two feet from the side line. on -site inspection shows no interference with the neighboring property, and staff recommends approval. Board Action: The applicant failed to appear for the meeting, and the matter was deferred to the October 19 Board of Adjustment meeting. The motion to defer was passed: 5 ayes, 0 noes and 2 absent. September 21, 1981 Item No. 5 - Z-3753 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Martha Matthews By: Clark McGothim 1806 N. Monroe The north 37.5 feet of Lot 52 and the south 27.5 feet of Lot 53, Shadowlawn Addition "R-2" Single Family Relief from Section permit a side yard for a carport. Single Family Same Staff Recommendation: 7-101.2D to setback of two feet No adverse comments have been received from any reviewing agency. The applicant plans an attached carport of wood construction which will be open on both ends but partially screened by lattice work on the south side (nearest the property line and the neighbor's house). We checked with the City's Building Code Department and found that no prohibition of this project exists in the Building Code. The height of the new structure proposed is such that no significant reduction of light to the neighbor's windows should occur. Staff finds the zoning considerations in this case to be consistent with earlier similar requests which have been approved by the Board of Adjustment. There will be reasonable separation between structures, and much of the screening effect is already present because of an existing hedge. Staff recommends approval with the condition that proper measures be taken to assure that water from the flat roof of the carport is not permitted to run at random from the carport structure. It is suggested that guttering be provided along the south edge of the roof to facilitate proper channelization of runoff. Staff support of this request is dependent upon no opposition from the neighbor to the south. September 21, 1981 Item No. 5 - Continued Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed with the provision that adequate drainage facilities be provided to prevent random runoff from the roof structure proposed. September 21, 1981 Item No. 6 - Z-3757 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Twin City Beverage Company By: R.S. McFarlane Northeast Corner - E. Capitol and Pepper Street Lots 10, 11 and 12, Block 15, Garland's Addition "I-3" Heavy Industrial Relief from Section 7-104.3D to permit a five-foot rear yard and a 10-foot side yard. Vacant Warehouse Staff Recommendation: No adverse comments have been received from any reviewing agency. The applicant plans to construct a new warehouse facility on this property. The owner is attempting to acquire the remaining three lots in this half block and expects over the long run to add on to this building to the east retaining the 50-foot setback from Pepper Street and E. Capitol. Staff sees no hardship upon any adjacent land owner and recommends approval. Board Action: Lee Stephens, representing the applicant, was present. There was one objector. The objector, Charles Bowers, representing Alice Brown, stated that Ms. Brown, his mother, was opposed to the five-foot rear yard. Ms. Brown owns a lot which is located at the southeast corner of 4th and Pepper Streets which is adjacent to part of the property associated with this application. There was considerable discussion about various setback alternatives and design alternatives for the driveway. After the discussion continued for a period of time, the Board asked the applicant to come back to the October 19 Board meeting with a more concise site plan indicating how traffic would be handled around the building proposed. There was a motion to defer this application to October 19. That motion was passed: 5 ayes, 0 noes and 2 absent. September 21, 1981 Item No. 7 - Z-3752 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Nabisco, Inc. By: Henry L. Johns 405 Shall Street Long .Legal "I-3" Heavy Industrial Relief from Section 7-104.3D to permit waiver or rear yard and side yard setbacks. Nabisco Plant Same Staff Recommendation: No adverse comments have- been received from any reviewing agency. The expansion proposed is compatible with the neighboring area and prior to the new ordinance's adoption, no variance would have been required for this expansion. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. After a brief dicussion, the Board moved to approve the application as filed. A motion was passed: 5 ayes, 0 noes and 2 absent. September 21, 1981 Other Business The Board directed the Planning staff to formulate a resolution from the Board of Adjustment to the Board of Directors citing their concern for the fact that quite often in recent months they have been asked to approve applications on projects which have been under construction prior to applications for variance from the Board of Adjustment.
