Willis and Verna Willis 316 N. Summit Lot 12, Block 2, Virginia Heights Addition "R-3" Single Family Relief from Section 5-101.F to permit an accessory building within 53 feet of the front line, one foot of the house and two feet of the side property line. Single Family Same Staff Recommendation: No adverse comments have been received from any reviewing agency. The applicant proposes to add to an existing carport in linear fashion so as to provide covered parking for two vehicles. The proposed structure is a freestanding carport which will be 10.5 feet wide and 40 feet long when combined with the existing carport. Three waivers are sought. An accessory structure in a residential zone is required by Ordinance to be 60 feet from the front property line, six feet from the principle structure and three feet from the side property line. The variances sought would allow this structure to be 53 feet from the front line, one foot from the house and two feet from the side line. On -site inspection shows no interference with the neighboring property, and staff recommends approval. Board Action: The applicant was present and there were no objectors. October 19, 1981 Item No. 2 - Z-3757 Owner: Twin City Beverage Company By: R.S. McFarlane Address: Northeast Corner - E. Capitol and Pepper Street Description: Lots 10, 11 and 12, Block 15, Garland's Addition Zoned: "I-3" Heavy Industrial Variance Requested: Relief from Section 7-104.3D to permit a five-foot rear yard and a 10-foot side yard. Present Use of Property: Vacant Proposed Use of Property: Warehouse Staff Recommendation: No adverse comments have been received from any reviewing agency. The applicant plans to construct a new warehouse facility on this property. The owner is attempting to acquire the remaining three lots in this half block and expects over the long run to add on to this building to the east retaining the 50-foot setback from Pepper Street and E. Capitol. Staff sees no hardship upon any adjacent land owner and recommends approval. Board Action: The applicant was present and there was one objector. A lengthy discussion was held concerning the proposal for the development of the property and various alternatives of setbacks and locations of the buildings and driveways were discussed. After the discussion in which the applicant, the objector and the Board all participated, the Board moved to approve the application as filed, permitting a five-foot rear yard and a ten -foot east side yard with the provision of an eight -foot fence along the north boundary of the property. The motion was passed: 4 ayes, 0 noes, 2 absent and 1 abstention (Richard Yada abstained). October 19, 1981 Item No. 3 - Z-1850-A Owner: Ruffin and Jarrett Funeral Home By: Ms. Johnnie L. White Address: 1015 West 12th Street Description: East 1/2 of Lots 1, 2 and 3, Block 268, Original City of Little Rock Zoned: "0-3" General Office Variance Requested: Interpretation of the Ordinance to permit accessory parking for the funeral home on a residential property which is zoned for office use. Present Use of Property: Duplex Residence Proposed Use of Property: Duplex Residence with accessory parking Staff Recommendation: The Zoning Ordinance does not deal with accessory structures within the "0-3" General Office District. The duplex is occupied as a residence, and the proposed garage will serve the funeral home rather than the residence. The duplex is a nonconforming use in the 110-3" District. If the property were zoned for the duplex and the garage were being constructed to serve the duplex, then there would be no issue and a permit would be granted. If the duplex were being used as an office, then the accessory use would require a multiple building site plan to be approved by the Planning Commission, and there would be no zoning issue. Also, if the property were zoned for the duplex and the garage were for the duplex, then it could be built seven feet closer to the west property line and two feet closer to the south property line. In Staff's opinion, the situation is unique to this property and this circumstance. No particular precedent would be set by any action of the Board of Adjustment. The proposal will not damage the integrity of the Zoning Ordinance. Staff recommends an interpretation which permits the garage as proposed by the applicant. October 19, 1981 Item No. 3 - Continued Board Action: The applicant did not appear. The Board deferred the item on a vote of 5 ayes, 0 noes and 2 absent. October 19, 1981 Item No. 4 - Z-3758 Owner: Drew Kumpuris, MD By: Frank Grobmyer Address: 1911 Shadow Lane Description: North 25 feet of Lot 124 and all of Lot 125, Shadowlawn Addition Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2D to permit a five-foot side yard for an addition. Present Use of Property: Single Family Residence Proposed Use of Property: Same Staff Recommendation: At issue here is the proposed maintenance of an existing 2.5-foot side yard encroachment. There is an existing one-story projection into the north side yard, which is proposed for the addition of a second story. The proposed two-story addition to the rear of the house in part replaces a part of the original one-story projection which has been removed. Staff sees no particular problem with the proposal and recommends it be approved. Board Action: The applicant was present. There were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed: 5 ayes, 0 noes and 2 absent. October 19, 1981 Item No. 5 - Z-3761 Owner: Primm's Medical Service By: Bill Gordon Address: 1612 South University Avenue Description: South 1/2 of Lot 2 and all of Lot 3, Block 5, Cox's Subdivision of Taylor and Bodeman's Addition to the City of Little Rock Zoned: 11C-3" General Commercial Variance Reauested: Relief from Section 7-103.3D to permit a five-foot rear yard for an addition. Present Use of Property: Commercial Proposed Use of Property: Same Staff Recommendation: At issue here is the proposed continuation of the existing five-foot rear yard setback. No side yard is required for this property. There is a 20-foot grade separation between this property and the property to the west. Staff recommends approval. Board Action: The owner of Primm's Medical Service asked that this matter be withdrawn, stating that they had purchased a new location and would not be needing a variance or any addition to this existing property. The Board moved to accept withdrawal of the action. The motion passed: 5 ayes, 0 noes and 2 absent. October 19, 1981 _ Item No. 6 - Z-3764 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Jim and Dawne Docking By: Tom F. Lovett 5800 Edgewood Lot 7, Prospect Terrace #4 "R-2" Single Family Relief from Section 7-101.2D to permit a 6.7-foot side yard for a carport addition. Single Family Residence Same Staff Recommendation: The rear 62 feet of this property lies within a massive drainage easement which also contains the sanitary sewer line as shown on the graphic. The proposed encroachment is less than two feet. Staff recommends approval. Board Action: The applicant was present and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed: 4 ayes, 0 noes, 2 absent and 1 abstention (Marcelline Giroir abstained). Leigh and R.C. Butler Acres Zoned: "R-2" Single Family Variance Requested: Permission under Section 40-15 to permit a mobile home for security purposes. Present Use of Property: Church and Related Facilities Proposed Use of Property: Same Staff Recommendation: The church is having problems with vandalism and thefts, and desires to have a resident security guard. In this case, the security will be provided by the minister, who will live in the mobile home. There are other instances when this provision of the ordinance has been extended to include church properties among those which can receive this special consideration. Staff recommends approval. Board Action: The applicant was present and there were no objectors. After a brief discussion, the Board moved to approve the application as filed, with the provision that the driving and parking areas be paved as was required by an earlier Board action.
