Staff Recommendation:
No adverse comments have been received from any reviewing
agency. The applicant proposes to add to an existing
carport in linear fashion so as to provide covered parking
for two vehicles. The proposed structure is a freestanding
carport which will be 10.5 feet wide and 40 feet long when
combined with the existing carport.
Three waivers are sought. An accessory structure in a
residential zone is required by Ordinance to be 60 feet from
the front property line, six feet from the principle
structure and three feet from the side property line. The
variances sought would allow this structure to be 53 feet
from the front line, one foot from the house and two feet
from the side line.
On -site inspection shows no interference with the
neighboring property, and staff recommends approval.
Board Action:
The applicant was present and there were no objectors.
After a brief discussion, the Board moved to approve the
application as filed. The motion was passed: 5 ayes,
0 noes and 2 absent.

Staff Recommendation:
No adverse comments have been received from any reviewing
agency. The applicant plans to construct a new warehouse
facility on this property. The owner is attempting to
acquire the remaining three lots in this half block and
expects over the long run to add on to this building to the
east retaining the 50-foot setback from Pepper Street and
E. Capitol.
Staff sees no hardship upon any adjacent land owner and
recommends approval.
Board Action:
The applicant was present and there was one objector. A
lengthy discussion was held concerning the proposal for the
development of the property and various alternatives of
setbacks and locations of the buildings and driveways were
discussed. After the discussion in which the applicant, the
objector and the Board all participated, the Board moved to
approve the application as filed, permitting a five-foot
rear yard and a ten -foot east side yard with the provision
of an eight -foot fence along the north boundary of the
property. The motion was passed: 4 ayes, 0 noes, 2 absent
and 1 abstention (Richard Yada abstained).

Staff Recommendation:
The Zoning Ordinance does not deal with accessory structures
within the "0-3" General Office District. The duplex is
occupied as a residence, and the proposed garage will serve
the funeral home rather than the residence. The duplex is a
nonconforming use in the 110-3" District.
If the property were zoned for the duplex and the garage
were being constructed to serve the duplex, then there would
be no issue and a permit would be granted. If the duplex
were being used as an office, then the accessory use would
require a multiple building site plan to be approved by the
Planning Commission, and there would be no zoning issue.
Also, if the property were zoned for the duplex and the
garage were for the duplex, then it could be built seven
feet closer to the west property line and two feet closer to
the south property line.
In Staff's opinion, the situation is unique to this
property and this circumstance. No particular precedent
would be set by any action of the Board of Adjustment. The
proposal will not damage the integrity of the Zoning
Ordinance.
Staff recommends an interpretation which permits the garage
as proposed by the applicant.

Staff Recommendation:
At issue here is the proposed maintenance of an existing
2.5-foot side yard encroachment. There is an existing
one-story projection into the north side yard, which is
proposed for the addition of a second story. The proposed
two-story addition to the rear of the house in part replaces
a part of the original one-story projection which has been
removed.
Staff sees no particular problem with the proposal and
recommends it be approved.

The applicant was present. There were no objectors. After
a brief discussion, the Board moved to approve the

Board Action:
The owner of Primm's Medical Service asked that this matter
be withdrawn, stating that they had purchased a new location
and would not be needing a variance or any addition to this
existing property. The Board moved to accept withdrawal of
the action. The motion passed: 5 ayes, 0 noes and
2 absent.

Staff Recommendation:
The church is having problems with vandalism and thefts, and
desires to have a resident security guard. In this case,
the security will be provided by the minister, who will live
in the mobile home. There are other instances when this
provision of the ordinance has been extended to include
church properties among those which can receive this special
consideration.
Staff recommends approval.
Board Action:
The applicant was present and there were no objectors.
After a brief discussion, the Board moved to approve the
application as filed, with the provision that the driving
and parking areas be paved as was required by an earlier
Board action. The motion passed: 5 ayes, 0 noes and
2 absent.
