Approval of the Minutes of the Previous Meeting. The Minutes of the previous meeting were -approved as mailed out. III. Murphree (New Member - did not vote) Members Absent: Ellis Walton Marcelline Giroir City Attorney: Lester McKinley December 21, 1981 Item No. 1 - Z-1626-A Owner: Walls Trimble Address: 2821 Youngwood Road Description: Long Legal (Kingwood Addition) Zoned: "R-2" Single Family Variance Requested: Relief from Section 5-1O1F2c&d to permit a carport in a side yard. Present Use of Property: Single Family Proposed Use of Property: Single Family STAFF RECOMMENDATION: The applicant proposes to construct a free-standing carport as shown on the sketch. Detached accessory structures are required to be 60' behind the front property line and 3' from side lines. This proposed structure is about 15' from the front and within 0.2' of the side. The location of the existing structures provides no conflict, and the most affected neighbor sold the land upon which the carport will be located with the knowledge of the applicant's intent. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Item No. 2 - Z-2892-A Owner: United-Bilt Homes, Inc. By Clinton Dearing Address: 6024 South University Ave. Description: Long Legal Zoned: "I-2" Light Industrial Variance Requested: Relief from Section 7-104.2e to permit a 5' side yard setback. Present Use of Property: Office (under construction) Proposed Use of Property: Office and Display Homes STAFF RECOMMENDATION: The proposal is to construct an office for United-Bilt Homes, Inc. (now under construction), and several display model homes. One of the models is proposed to be located within 5' of the south property line as shown on the sketch. No difficulties should arise from this arrangement. Staff recommends approval. BOARD ACTION: The applicant was present. There were no objectors. There was a brief discussion relative to the location of the various model structures. After the discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Item No. 3 - Z-3783-A Owner: Little Rock Motels No. 1, Ltd. By Don Chambers Address: Southeast Corner, Eastbelt Freeway and Jones Street Description: Long Legal Zoned: "C-3" General Commercial (in process) Variance Requested: Relief from Section 7-103.3d to permit a 55' building height. Present Use of Property: Vacant Proposed Use of Property: Holiday Inn STAFF RECOMMENDATION: The applicant has received clearance from the FAA for the proposed height. Holiday Inn will construct a Holidome on this site as shown in the sketch. Staff recommends approval. BOARD ACTION: The applicant was present and showed the site plans for the proposed Holiday Inn. There was a lengthy discussion relative to the various considerations. Finally, the Board moved to approve the application for a height variance with the provision that the ultimate height of the structure not exceed 350 feet mean sea level as approved by the FAA. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Item No. 4 - Z-3784 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: B. Frank Mackey, Jr. 5213 Grandview Road Lot 36, Grandview Addition "R-2" Single Family Relief from Section 7-101.2d to permit a 7.5' side yard setback for a carport addition Single Family Single Family STAFF RECOMMENDATION: The applicant proposes a second addition onto his home, which will have the same side yard setback as another addition previously approved by the Board of Adjustment. No conflicts exist with other structures. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. There was a brief discussion regarding the proposed construction. After the discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Item No. 5 - Z-3786 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Celestine Farmer By Tom Jones 1716 Green Meadow Drive Lot 62, Pine Forest Addition "R-3" Single Family Relief from Section 7-101.3d to permit a 21' rear yard setback. Single Family Single Family STAFF RECOMMENDATION: The applicant proposes to construct a small addition onto the rear of his home. The resulting rear yard setback will be approximately 221. Staff sees no problem with this proposal. Staff recommends approval. BOARD ACTION: The applicant was present. There were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Item No. 6 - Z-3787 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: W.C. McMinn 5501 Country Club Lot 1, Block 21, Newton Addition "R-2" Single Family Relief from Section 7-101.2d to waive the side yard setback requirements and permit a two-story garage Single Family Single Family STAFF RECOMMENDATION: All streets in this area have 80' rights -of -way, and this addition will be approximately 25' from the street. Staff recommends approval. BOARD ACTION: The applicant was not present. There were also no objectors present. In keeping with the Board's standing policy, the Board voted to defer this matter to the January 18, 1982, meeting. The vote - 4 ayes, 0 noes, 2 absent and 1 not voting. December 21, 1981 Other Action: The Board considered a request from Mary Davies Scott to extend the original variance approval granted in Case Z-3365-A in August 1979. The applicant stated that the variance had been granted and full intention of using it was present at the time. However,'some difficulties had arisen relative to an uncooperative contractor, and several other delays. Because of these delays, temporary abandonment of the project was required. She stated that they are now ready to begin construction again and find that the variance terms had expired and had been unaware that there was a set expiration date on them. There was a brief discussion of the various issues, and it was explained that some of the ordinance requirements now are different than they were in 1979 because of the adoption of the new ordinance. The Board moved to extend the variance and reconfirm the original site plan for a period of 90 days. That motion was passed - 4 ayes, 0 noes, 2 absent and 1 not voting.
