The remodeling will involve the replacement of the existing canopy over the pump islands and the new structure will be significantly taller than the present canopy, thereby reducing the visual encroachment. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. The applicant presented an enhanced site plan of the proposed remodeling, showed elevations of the project and showed some pictures of similar installations around the City. August 17, 1981 Item No. 2 - Z-2561-A Owner: Wengroup Companies By: George Wittenberg Address: University Avenue at I-630 (Circus Bazaar) Description: Long Legal Zoned: "C-3" General Commercial Variance Requested: Relief from Section 7-103.3C to permit a 125-foot height for an office building. Present Use of Property: Vacant (Abandoned Building) Proposed Use of Property: Medical Office Staff Recommendation: The proposal was to remove the existing "Circus Bazaar" structure and to construct a new office building on this site. The proposed new building is to be a maximum 125 feet tall; however, there is the possibility that a building of shorter dimension will be constructed. The "C-3" General Commercial District allows a maximum height of 35 feet. There were possibilities of rezoning this property to 110-2" Office and Institutional, or to 110-3" General Office, but in either case a variance would have been required. The lot affords more than sufficient setbacks to permit a building height as proposed. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. There was a lengthy discussion of the height considerations, reflective surfaces on the building and parking. After this discussion, the Board moved to approve the variance requested with the provision that no other variance be later requested for any other purpose. Fielder, Jr. Address: Unknown Description: Lot 1, Block 2, Riffel and Rhoten, Forest Park Highlands Zoned: "C-3" General Commercial Variance Requested: Relief from Section 7-103.3D to permit a four -foot side yard next to a residential use. Present Use of Property: Vacant (Abandoned Structures) Proposed Use of Property: Car Wash Staff Recommendation: Under this proposal, two existing structures will be removed and a new car wash constructed. The "C-3" District requires a 15-foot side yard next to a residential use. This relationship involves a parking lot for an apartment complex and provides for some 55 feet of separation between buildings. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. Description: Lots 1, 2 and 3, Block 28, C.O.Brack's Addition Zoned: "C-3" General Commercial Variance Requested: Relief from Section 7-103.3D to permit a five-foot front yard Present Use of Property: Vacant Proposed Use of Property: Accessory Storage for Kaufman Lumber Co. Staff Recommendation: These structures will be accessory storage and retailing facilities for the lumber company. The proposed location permits better vehicle access for offstreet loading and unloading. Alternate building locations would necessitate the use of public rights -of -way for part of the loading/unloading operation. Staff sees no hardship on any surrounding neighbor and recommends approval. Board Action: The applicant was unable to attend and, therefore, the Board deferred consideration of this item to the September 21 Board meeting. Single Family Same Staff Recommendation: This application represents the third or fourth such application in the past few months. It involves a property where a 25--foot platted building line is established on two sides of the property. The ordinance requires a 25-foot rear yard and does not specify any reduction for lots wherein two other 25-foot yards are present. As stated before, this is in the process of being changed. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve application as filed. August 17, 1981 Item No. 6 - Z-3741 Owner: Lloyd Schuh Address: 11 White Oak Lane Description: Lot 517, Kingwood Place Addition Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2D to permit a five-foot front yard encroachment for an open carport. Present Use of Property: Single Family Proposed Use of Property: Same Staff Recommendation: This request will permit the construction of an open carport projecting five feet into the required front yard. Staff sees no hardship upon any neighboring property owner. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed: 6 ayes, 0 noes and 1 absent. August 17, 1981 Other Business The Board was given a copy of a letter from Mr. Art Anderson, an attorney representing himself and a group of other people who are seeking to purchase a large home and live in it in a form of group home. Mr. Anderson is asking for an interpretation relative to this intended use in the "R-3" Zoning District. The Board was asked to review Mr. Anderson's letter, the City Attorney's brief opinion and the Zoning Ordinance for the purpose of consideration of this matter at the September meeting if Mr. Anderson decides to seek their interpretation.
