3 AN ORDINANCE TO ABANDON A PORTION OF ARNOLD
4 STREET, CONNER STREET, AND TWO ALLEYS LOCATED IN
5 BLOCK 35 OF THE JOSEPHINE PANKEY'S EXTENSION OF HER
6 THIRD ADDITION SUBDIVISION, IN THE CITY OF LITTLE
7 ROCK, AS A PUBLIC RIGHT -OF -WAY; AND FOR OTHER
8 PURPOSES.

] 0 WHEREAS, a request was made to abandon a portion of Arnold Street, Conner
11 Street and two alleys located in Block 35 of the Josephine Pankey's Extension of her
12 Third Addition Subdivision, pursuant to the City's general police power authority
13 under Ark. Code Ann. § 14 -54 -104;
14 WHEREAS, the Board has determined that the abandoning of this public right-
15 of -way will not have an adverse impact on the adjacent property owners nor the local
16 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed
17 for corporate purposes except as otherwise noted below.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
19 OF THE CITY OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors hereby releases, vacates, and abandons the
21 public right -of -way for a portion of Conner Street located adjacent to Lots 1, 2 and 3;
22 Arnold Street located adjacent to Lots 1 and 16; and two alleys located adjacent to Lots
23 1, 2, 15 and 16 and adjacent to Lots 2 through 15; all located in Block 35 of the Josephine
24 Pankey's Extension of her Third Addition Subdivision, together with the right of public
25 in general, in the City of Little Rock, Pulaski County, Arkansas.

I Section 2. The City specifically reserves the public utility easements within the
2 former right -of -way.
3 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed
4 in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of
5 Pulaski County, Arkansas.
6 Section 4. Severability. In the event any title, section, paragraph, item,
7 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
8 or unconstitutional, such declaration or adjudication shall not affect the remaining
9 portions of the ordinance which shall remain in full force and effect as if the portion so
10 declared or adjudged to be invalid or unconstitutional was not originally a part of the
11 ordinance.
12 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same
13 that are inconsistent with the provisions of this ordinance are hereby repealed to the
14 extent of such inconsistency.
