19383I 2 ORDINANCE NO. 19,383 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF 4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO 5 ENTER INTO A CONTRACT WITH MOTOROLA, INC. FOR THE 6 PURCHASE OF PORTABLE RADIOS FOR COMMAND AND CONTROL 7 PERSONNEL AND FIRST RESPONDERS WITHIN THE FIRE 8 DEPARTMENT, AND FOR OTHER PURPOSES. 9 10 WHEREAS, the Fire Department is in need of seventy -two (72) XTS5000 Model 11 2 Portable Radios for its Command and Control Personnel and First Responders, and 12 WHEREAS, a quote has been received from Motorola, Inc. to provide such 13 portable radios in the amount of Two Hundred Eighty -two Thousand, Five Hundred 14 Thirteen and 60/100 Dollars ($282,513.60) plus sales tax of Nineteen Thousand, Six 15 Hundred Fifty and 82/100 Dollars ($19,650.82), for a total of Three Hundred Two 16 Thousand, One Hundred Sixty -four and 42/100 Dollars ($302,164.42) , and 17 WHEREAS, competitive bidding should be waived and the contract for such 18 equipment awarded to Motorola, Inc. as the sole source provider of the type of radio 19 equipment required by the Fire Department 20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 21 OF THE CITY OF LITTLE ROCK, ARKANSAS: 22 Section 1. The Board of Directors finds that competitive bidding should be 23 dispensed with in the purchase of radio equipment for the Little Rock Fire Department, 24 as an exceptional situation exists and competitive bidding is impractical and infeasible. 25 Section 2. The City Manager is hereby authorized to dispense with competitive 26 bidding and to enter into a contract with Motorola, Inc. for the purchase of seventy -two [PAGE 1 OF 21 To waive bidding for Fire Department Radios 1 (72) portable radios in the amount of Three Hundred Two Thousand, One Hundred 2 Sixty -four and 42/100 Dollars ($302,164.42), for the Little Rock Fire Department. 3 Section 3. Funding for this purchase are available and were anticipated for such 4 expenses through FY03 II Secondary Grant Funds (700 -340- X065), with associated taxes 5 for the expense to be paid from bond funds. 6 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 7 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 8 unconstitutional, such declaration or adjudication shall not affect the remaining 9 portions of the ordinance which shall remain in full force and effect as if the portion so 10 declared or adjudged invalid or unconstitutional was not originally a part of the 11 ordinance. 12 Section 5. Repealer.
