15602 1 RESOLUTION NO. 15,602 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO APPROVE 4 AN INCREASE TO THE PROFESSIONAL ENGINEERING SERVICES 5 CONTRACT WITH FTN ASSOCIATES, LTD., IN AN AMOUNT NOT TO 6 EXCEED SIXTY-EIGHT THOUSAND DOLLARS ($68,000.00), FOR THE 7 YORKWOOD NEIGHBORHOOD DRAINAGE IMPROVEMENT 8 PROJECT; AND FOR OTHER PURPOSES. 9 10 WHEREAS, Resolution No. 15,524 (August 17, 2021), was adopted by the Little Rock Board of 1 1 Directors, made a Three Million Dollar ($3,000,000.00) allocation of American Rescue Act Funds for 12 Water and Sewer Infrastructure Improvement Projects; and, 13 WHEREAS, Staff has identified currently designed, eligible projects in Wards 1, 3 and 7, including 14 improvements to Smith Creek in the Yorkwood Neighborhood(Ward 7); and, 15 WHEREAS, FTN Associates, Ltd., was previously selected through an Annual Statements of 16 Qualifications Process, Bid No. 17201 for Professional Services and contracted to perform preliminary 17 design analysis of proposed improvements to Smith Creek in the Yorkwood Neighborhood; and, 18 WHEREAS, it is desirable to increase the contract ceiling price for FTN Associates, Ltd.,to provide 19 for additional design services including completion of a detailed design including provisions for obtaining 20 the appropriate Corps of Engineers Permit(s)for the project. 21 NOW, THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 22 CITY OF LITTLE ROCK, ARKANSAS: 23 Section 1. The City Manager is hereby authorized to execute an amendment to the contract with FTN 24 Associates, Ltd., in an amount not to exceed Sixty-Eight Thousand Dollars ($68,000.00) for an amended 25 contract price not to exceed amount of Two Hundred Fifty-Four Thousand, One Hundred Dollars 26 ($254,100.00). 27 Section 2. Funding for the contract increase is from funds allocated from the American Rescue Act 28 for Water and Sewer Infrastructure Improvement Projects pursuant to Resolution No. 15,524. 29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 32 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 33 resolution.
