3 A RESOLUTION TO SET DECEMBER 7,2021,AS THE DATE OF PUBLIC
4 HEARING ON THE REQUEST TO ABANDON THE FIFTY (50)-FOOT
5 WIDE WEST 2ND STREET RIGHT-OF-WAY, BETWEEN SOUTH
6 BATTERY STREET AND THE ALLEY RIGHT-OF-WAY WITHIN
7 BLOCK 5, UNION DEPOT ADDITION, AND THE SOUTH NINETY-ONE
8 (91) FEET OF THE FOURTEEN (14)-FOOT WIDE ALLEY RIGHT-OF-
9 WAY LOCATED WITHIN BLOCK 5, UNION DEPOT ADDITION,
10 LOCATED EAST OF THE INTERSECTION OF WEST 2ND STREET AND
11 SOUTH BATTERY STREET IN THE CITY OF LITTLE ROCK,
12 ARKANSAS(G-23-479); AND FOR OTHER PURPOSES.

14 WHEREAS, a petition has been filed with the City Clerk requesting that the Board of Directors
15 abandon the fifty (50)-foot wide West 2°d Street right-of-way between South Battery Street and the alley
16 right-of-way within Block 5,Union Depot Addition,and the south ninety-one(91)feet of the fourteen(14)-
17 foot wide alley right-of-way within Block 5,Union Depot Addition,located east of the intersection of West
18 rd Street and South Battery Street.
19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS.
21 Section 1.The hearing on the notice of the request to abandon the above-mentioned right-of-way shall
22 be held at a meeting of the Board of Directors that will start at 6:00 PM on the 7d'day of December 2021,
23 at The Centre at University Park,6401 West 12th Street,Little Rock,Arkansas.
24 Section 2. The City Clerk is hereby directed to give notice of such hearing in the manner prescribed
25 by law by publication once a week for two (2) consecutive weeks in a newspaper published in Pulaski
26 County,Arkansas,and having a general circulation in the City of Little Rock,Arkansas.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
31 resolution.
32 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with this resolution are
33 hereby repealed to the extent of such inconsistency.
