3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO
4 EXECUTE A SPECIAL WARRANTY DEED CONVEYING REAL
5 PROPERTY OWNED BY THE CITY OF LITTLE ROCK, ARKANSAS, AT
6 11903 KANIS ROAD TO CENTRAL ARKANSAS MORTUARY SERVICES,
7 INC.; AND FOR OTHER PURPOSES.

9 WHEREAS, the acquisition of right-of-way for the Kanis Road and Bowman Road improvement
10 projects was authorized by the Little Rock Board of Directors by Resolution No. 13,912 and Resolution
11 No. 15,031, and the City acquired a portion of the vacant property located at 11903 Kanis Road from the
12 Central Arkansas Mortuary Service, Inc., for the purpose of constructing a drainage outfall just east of the
13 intersection of Kanis Road with Bowman Road;and
14 WHEREAS,Central Arkansas Mortuary Service, Inc.,has made a request to buy back the property for
15 the full purchase price and to accept responsibility for maintenance of the drainage outfall.
16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS:
18 Section 1. That the Mayor and City Clerk are hereby authorized to execute, in a form approved by the
19 City Attorney, any and all deeds and conveyance documents and sales agreements required to convey the
20 strip of land acquired at 11903 Kanis Road back to Kenny Adams of the Central Arkansas Mortuary Service,
21 Inc., or its assigns,as described in Exhibit A,to this resolution.
22 Section 2. The sales price for the property is to be One Hundred Seven Thousand, Seven Hundred
23 Dollars($107,700.00), less the customary and appropriate amounts that may be required for closing costs,
24 title insurance or other associated fees or costs; with the net proceeds of the sale to be credited back to the
25 Bowman Road improvement project activity.
26 Section 3. The City Board of Directors hereby ratifies the execution of a sales agreement and all
27 amendments thereto and for the sale and conveyance of this property.
28 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
32 resolution.
33 Section 5. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with
34 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
