15484 1 RESOLUTION NO. 15,484 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH ROGUE TRAILS,LLC,IN AN AMOUNT NOT 5 TO EXCEED ONE HUNDRED THIRTY-SEVEN THOUSAND, NINE 6 HUNDRED SIXTY-TWO DOLLARS ($137,962.00), FOR THE 7 CONSTRUCTION OF MOUNTAIN BIKE TRAILS AT BOYLE PARK; 8 AND FOR OTHER PURPOSES. 9 10 WHEREAS, Boyle Park Mountain Bike Improvements was identified as a key development for the 11 City in the Parks Soft Surface Trail Plan developed in 2018; and, 12 WHEREAS,Recreational Trails Program Grant Funds are available from the Arkansas Department of 13 Transportation(ArDOT)Federal Funds Program; and, 14 WHEREAS, Parks and Recreation Staff has been working with numerous stakeholders interested in 15 seeing trail improvement for mountain bikes; and, 16 WHEREAS, the Construction Services of Rogue Trails, LLC, will provide Mountain Bike Trails in 17 Boyle Park; and, 18 WHEREAS,the total cost of the project will not exceed One Hundred Thirty-Seven Thousand,Nine 19 Hundred Sixty-Two Dollars ($137,962.00) and funding will come from ArDOT's Recreational Trails 20 Program and Grant Match Account No. 108129—S 10G041 with the City responsible for 20% of the total 21 project. 22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS: 24 Section 1. The City Manager is authorized to enter into an agreement with Rogue Trails,LLC, in an 25 amount not to exceed One Hundred Thirty-Seven Thousand, Nine Hundred Sixty-Two Dollars 26 ($137,962.00)to construct Mountain Bike Trails in Boyle Park. 27 Section 2. The Project will be funded from the Arkansas Department of Transportation's Recreational 28 Trails Program and Grant Match Account No. 108129—S10G041,and the City will be responsible for 20% 29 of the total project. 30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 34 resolution.
