3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH BMD BUILDERS,LLC,IN AN AMOUNT NOT
5 TO EXCEED TWO HUNDRED EIGHTY-ONE THOUSAND, EIGHT
6 HUNDRED EIGHTY-ONE DOLLARS ($281,881.00), FOR
7 CONSTRUCTION SERVICES FOR GROUNDS AND ANIMAL FACILITY
8 IMPROVEMENTS IN THE VELDT AREA AT THE LITTLE ROCK ZOO;
9 AND FOR OTHER PURPOSES.

11 WHEREAS, the Little Rock Zoo ("Zoo") requests upgrades for grounds and animal facility
12 improvements at the Veldt area; and,
13 WHEREAS,the Veldt area of the Zoo includes a multispecies habitat for Zebras,Ostriches, Secretary
14 Birds and Migratory Birds which includes a holding area downhill from the habitat that frequently floods
15 due to heavy rain; and,
16 WHEREAS, the Construction Services will provide upgrades for Grounds and Animal Facility
17 Improvements to alleviate the flooding in the holding areas while improving animal and keeper access to
18 habitats to improve health and safety of animals and keepers at the Veldt area; and,
19 WHEREAS,after a competitive bidding process,Bid No. 1182, it was determined that of the three(3)
20 bids received that BMD Builders, LLC, provided the lowest, most responsible bid in the amount of Two
21 Hundred Thirty-Four Thousand, Nine Hundred One Dollars ($234,901.00) from the total bids received;
22 and,
23 WHEREAS,the total cost of the project will not exceed Two Hundred Eighty-One Thousand, Eight
24 Hundred Eighty-One Dollars($281,881.00),which includes a contingency amount of Forty-Six Thousand,
25 Nine Hundred Eighty Dollars($46,980.00)and is allocated in the 3/8-Cent Capital Improvement Sales and
26 Compensating Use Tax Fund for Zoo Improvements,Account No. 326659-72504-TS65A32.
27 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
28 OF LITTLE ROCK,ARKANSAS:
29 Section 1. The City Manager is authorized to enter into an agreement with BMD Builders LLC, in an
30 amount not to exceed Two Hundred Eighty-One Thousand, Eight Hundred Eighty-One Dollars
31 ($281,881.00),which includes a contingency amount of Forty-Six Thousand,Nine Hundred Eighty Dollars
32 ($46,980.00)to provide Grounds and Animal Facility Improvements to the Veldt area at the Little Rock
33 Zoo.

1 Section 2. The Project will be funded from the 3/8-Cent Capital Improvement Sales and
2 Compensating Use Tax Fund for Zoo Improvements, Account No. 326659-72504-TS65A32.
3 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
4 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
5 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
6 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
7 resolution.
8 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
9 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
