3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO SUBMIT TO COMPETITIVE SELECTION; TO AUTHORIZE THE
5 CITY MANAGER TO ENTER INTO A CONTRACT WITH THE
6 ARCHITECTURAL FIRM OF ROARK, PERKINS, PERRY &
7 YELVINGTON FOR ARCHITECTURAL DESIGN AT THE 12TH STREET
8 STATION, TO PROVIDE FOR THE USE OF SPACE BY PHILANDER
9 SMITH COLLEGE, SOUTHERN BANCORP AND THE UNIVERSITY OF
10 ARKANSAS FOR MEDICAL SCIENCES; TO DECLARE AN
11 EMERGENCY; AND FOR OTHER PURPOSES.

13 WHEREAS, construction of the 12`1' Street Station, which currently houses offices of the Little Rock
14 Police Department, was intended to include space for other non-City uses in order to help redevelop the
15 12th Street Corridor of the City; and,
16 WHEREAS,the City has been approached by Philander Smith College regarding the use of a portion
17 of this structure for a Criminal Justice Program, by Southern Bancorp to provide Financial Development
18 Services and Retail Bank Branch Services and by the University of Arkansas for Medical Sciences as Retail
19 Food Distribution and a Retail Food and Beverage Services Program; and,
20 WHEREAS, prior to agreements being reached for these three (3) developments, the City had
21 permitted Philander Smith College to pursue design work for the development of a Criminal Justice
22 Program, which would have utilized more of the space that is currently under consideration; and,
23 WHEREAS, it is impractical and unfeasible to enter a competitive selection process after the fact for
24 Architectural Services and still utilize the cost savings from the work already completed by the
25 Architectural Firm of Roark, Perkins, Perry & Yelvington; and,
26 WHEREAS, it is also the desire of all of the parties to get the work on these modifications completed
27 as quickly as possible.
28 NOW,THEREFORE,BE ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
29 LITTLE ROCK,ARKANSAS:
30 Section 1. The Board declares that it is impractical and unfeasible to bid for Architectural Services to
31 design the modifications to the 12th Street Station to accommodate the uses by Philander Smith College,
32 Southern Bancorp and the University of Arkansas for Medical Sciences.
33 Section 2. In light of the work it has already performed, the City authorizes the City Manager to enter
34 into a contract with the Architectural Firm of Roark, Perkins, Perry& Yelvington, provided the agreement

1 does not solely utilize AIA documents, to complete the design work needed for use of portions of this
2 structure by the City, Philander Smith College, Southern Bancorp and the University of Arkansas for
3 Medical Sciences. In addition, the City will have the benefit of any architectural design that has already
4 been completed on the 12t Street Station building by Roark, Perkins, Perry& Yelvington.
5 Section 3. Funds for this work are available from accumulated 3/8-Cent Sales Tax interest earnings
6 in Accounting Unit 326259-TS25A33.
7 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
8 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
9 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
10 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
11 ordinance.
12 Section 5. Repealer. All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
13 the provisions of this resolution, are hereby repealed to the extent of such inconsistency including, but not
14 limited to Little Rock, Ark.,Ordinance No. 21,700(March 5, 2019).
15 Section 6. Emergency Clause. The ability to complete the additional work on 12th Street Station as
16 expeditiously as possible without undue disruption to functions of the Little Rock Police Department is
17 essential to the public health, safety, and welfare; an emergency is, therefore, declared to exist and this
18 ordinance shall be in full force and effect from and after the date of its passage.
