1536701 0 RESOLUTION NO. 15,367 3 A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF 4 LITTLE ROCK, ARKANSAS, TO PARTNER WITH THE CITY OF 5 NORTH LITTLE ROCK AND THE ARKANSAS DEPARTMENT OF 6 TRANSPORTATION TO RELOCATE PORTIONS OF THE ROCK 7 REGION METRO STREETCAR INFRASTRUCTURE; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, Job CA0602 (30 Crossing) is scheduled to widen and reconstruct portions of Interstate 30 11 and replace the Interstate 30 Bridge over the Arkansas River between the Interstate 30 and Interstate 530 12 Interchange and the Interstate 40 and Highway 67 Interchange; and, 13 WHEREAS, Rock Region Metro (METRO), in order to serve the cities of Little Rock and North Little 14 Rock, has constructed a trolley line including rail, catenary system, a transformer site, and other 15 infrastructure, part of which is located on the State Highway System and on Arkansas Highway 16 Commission lands; and, 17 WHEREAS, the current airspace agreement between the Arkansas Department of Transportation 18 (ArDOT) and METRO states that all costs associated with any required modifications to the Metro Streetcar 19 on Arkansas Highway Commission rights-of-way will be the responsibility of METRO; and, 20 WHEREAS, the modification of the streetcar infrastructure is considered a utility relocation related to 21 this project and will be achieved in two (2) phases; and, 22 WHEREAS, the METRO Streetcar was partially funded by grants through the Federal Transit 23 Administration (FTA), which has a remaining interest in the METRO Streetcar System; and, 24 WHEREAS, METRO is obligated to return the Streetcar System to its original working condition 25 while there is remaining FTA interest; and, 26 WHEREAS, the METRO Streetcar is funded equally by Pulaski County, the City of Little Rock, and 27 the City of North Little Rock; and, 28 WHEREAS, ArDOT, METRO, Pulaski County, the City of Little Rock and the City of North Little 29 Rock desire to pursue the safest and most economical method of returning the Streetcar System to its 30 original working condition; and, 31 WHEREAS, Pulaski County, the City of Little Rock and the City of North Little Rock have proposed 32 a partnership with ArDOT to assist with the required costs associated with relocating the infrastructure for 33 the METRO Streetcar; and, [Page 1 of 41 I WHEREAS, Highway 70, Section 12 (University Avenue), from Highway 5 (Colonel Glenn Road) to 2 its termination south of Interstate 30, at the Interstate 30 Frontage Road ramps, in the City of Little Rock, 3 Pulaski County, will be accepted by the City of Little Rock into the City Street System, as shown in 4 Exhibit A, which is attached hereto; and, 5- WHEREAS, the City of Little Rock agrees to accept the transfer of property rights and all 6 responsibility for the maintenance of the portion of Highway 70, Section 12, from Highway 5 to its 7 termination south of Interstate 30 at the Interstate 30 Frontage Road ramps, in the City of Little Rock, in 8 accordance with Arkansas Code Annotated § 27-65-109; and, 9 WHEREAS, acceptance of the proposed change and transfer is practical and will be in the best interest 10 of the City of Little Rock and the public. 11 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 12 OF LITTLE ROCK, ARKANSAS, THAT: 13 Section 1. The City of Little Rock will form a partnership with the Arkansas Department of 14 Transportation, Pulaski County, and the City of North Little Rock in order to assist with the required costs 15 associated with relocating the infrastructure for the Rock Region Metro Streetcar System. 16 Section 2. The City of Little Rock agrees and accepts Highway 70, Section 12 (University Avenue), 17 from Highway 5 (Colonel Glenn Road) to its termination south of Interstate 30 at the Interstate 30 Frontage 18 Road ramps, in the City of Little Rock, Pulaski County, Arkansas, into the City Street System, as shown in 19 Exhibit A, which is attached hereto. 20 Section 3. The City of Little Rock will accept the transfer -of property rights and all responsibility for 21 the maintenance of the portion of Highway 70, Section 12, from Highway 5 to its termination south of 22 Interstate 30 at the Interstate 30 Frontage Road ramps, in the City of Little Rock, in accordance with 23 Arkansas Code Annotated § 27-65-109. 24 Section 4: The Mayor and the City Manager, or their designated representatives, are hereby authorized 25 and directed to execute all appropriate agreements and contracts necessary to expedite this project. 26 Section 5. The City of Little Rock pledges its full support and hereby requests that the Arkansas 27 Department of Transportation initiate action to assist in implementation of this project. 28 Section 6. A copy of the resolution duly certified by the City Clerk shall be fled in the Office of the 29 Recorder of Pulaski County, Arkansas, and recorded in the deed of Pulaski County, Arkansas. 30 Section 7. Due to the necessity of continuing the reconstruction of Interstate 30 and the replacement 31 of the Interstate 30 Bridge, and to avoid delay to this project for the benefit and safety of the public, this 32 resolution shall take effect and be in force immediately after the portion of Highway 70, Section 12, in the 33 City of Little Rock, is removed from the State Highway System by the Arkansas State Highway 34 Commission. A copy of this resolution shall be submitted to the Arkansas Department of Transportation for their records. Section 9. Severability. In the event any portion of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this resolution. Section 10. Severability. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this resolution are hereby repealed to the extent of such conflict.
