153631 7 RESOLUTION NO. 15,363 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 14,769 (APRIL 17, 2018) TO AMEND THE AGREEMENT WITH 5 AMERICAN STRUCTURE, INC., TO INCREASE THE TOTAL 6 CONTRACT AMOUNT BY EIGHTEEN THOUSAND, THREE HUNDRED 7 FIFTY-TWO AND 60/100 DOLLARS ($18,352.60) TO COMPLETE 8 CONSTRUCTION OF THE COLOBUS/SERVAL EXHIBIT AT THE 9 LITTLE ROCK ZOO; AND FOR OTHER PURPOSES. 10 11 WHEREAS, Little Rock, Ark., Resolution No. 14,769 (April 17, 2018) approved the Little Rock Zoo 12 Contract with American Structure, Inc., for a total amount of One Million, Three Hundred Sixteen 13 Thousand, Two Hundred Forty and 40/100 Dollars ($1,316,240.40), to build a new Colobus/Serval Exhibit 14 which met current standards of the Association of Zoos and Aquariums, and that is an interactive exhibit 15 that both meets animal needs and also tells a story of wildlife conservation; and, 16 WHEREAS, as the Little Rock Zoo neared completion of the construction of the Colobus/Serval 17 Habitat, additional requirements were identified that exceed the previously -approved contract amount; and, 18 WHEREAS, the Little Rock Zoo requests the contract with American Structure, Inc., be amended to 19 include the survey and installation of additional in -ground and roof posts for netting, indoor animal holding 20 pens, and additional concrete work for the amount of Eleven Thousand, Three Hundred Eighty Dollars 21 ($11,380.00) and outstanding landscaping, French drains, and landscape walls for the amount of Six 22 Thousand, Nine Hundred Seventy -Two and 60/100 Dollars ($6,972.60), for a total amount of Eighteen 23 Thousand, Three Hundred Fifty -Two and 60/100 Dollars ($18,352.60); and, 24 WHEREAS, the anticipated cost to complete the project is the type of capital expenditure of a public 25 nature authorized by the %-Cent Capital Improvement Sales and Compensating Use Tax levied in Little 26 Rock, Ark., Ordinance No. 20,450 (July 11, 2011), and which also meets the intent for the use of such tax 27 proceeds as set forth in Little Rock, Ark., Resolution No. 13,343 (July 11, 2011). 28 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 29 OF LITTLE ROCK, ARKANSAS: 30 Section 1. The City Manager is authorized to amend the agreement with American Structure, Inc., to 31 include the survey and installation of additional in -ground and roof posts for netting, indoor animal holding 32 pens, and additional concrete work, and to complete the outstanding landscaping, French drains, and 33 landscape walls to increase the contract amount to include an additional amount of Eighteen Thousand, 34 Three Hundred Fifty -Two and 60/100 Dollars ($18,352.60) to Purchase Order No. 144214. Funding for this project is from the %-Cent Capital Improvement Sales and Compensating Use Tax Funds, Special Project Account No. 326659-72504-TS65A90. Section 3. Little Rock, Ark., Resolution No. 14,769 (April 17, 2018) authorized the City Manager to provide additional funds up to 20% of the amount set forth in Section 1 of Resolution 14,769, i.e., One Million, Ninety -Six Thousand, Eight Hundred Sixty -Seven Dollars ($1,096,867.00), in an amount not to exceed One Million, Three Hundred Sixteen Thousand, Two Hundred Forty and 40/100 Dollars ($1,316,240.40), if such monies were necessary to complete this project. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency including, but not limited to, Little Rock, Ark., Resolution No. 14,769 (April 17, 2018).
