3 A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF
4 LITTLE ROCK, ARKANSAS, TO PARTNER WITH THE ARKANSAS
5 DEPARTMENT OF TRANSPORTATION FOR JOB NO. 061706,
6 INTERSTATE 440 AND FOURCHE DAM PIKE INTERCHANGE
7 IMPROVEMENTS; AND FOR OTHER PURPOSES.

9 WHEREAS, Act 1 of the 90" General Assembly's Third Extraordinary Session established the
10 Arkansas Highway Improvement Plan of 2016, which provides funding to help address highway
11 construction needs of the State of Arkansas; and,
12 WHEREAS, a portion of Act 1 funding includes 25% of State Surplus Funds; and,
13 WHEREAS, the amount of State Fiscal Year 2019 State Surplus funds exceeded projections, which
14 resulted in additional funding being made available for highway improvements beyond what was
15 anticipated; and,
16 WHEREAS, in February 2020, the Arkansas Highway Commission passed Minute Order
17 No. 2020-004 authorizing the Arkansas Department of Transportation (ArDOT) to dedicate up to Fifteen
18 Million Dollars ($15,000,000.00) in Act 1 Surplus Funding received by ArDOT to be used to support
19 projects that promote economic development and economic competitiveness; and,
20 WHEREAS, the Arkansas Economic Development Commission, in conjunction with the City of Little
21 Rock, Pulaski County and the Little Rock Port Authority, requested that ArDOT One Million Dollars
22 ($1,000,000.00) of the Act 1 Surplus Funds to support infrastructure improvements that will be needed to
23 safely and efficiently handle increased traffic volumes associated with the new Amazon facility at the Port
24 of Little Rock; and,
25 WHEREAS, it has been determined that the City of Little Rock will be responsible for handling all
26 phases of the project; and,
27 WHEREAS, ArDOT will assist with any coordination necessary with the Federal Highway
28 Administration and other agencies as necessary; and,
29 WHEREAS, Arkansas Highway Commission Minute Order No. 2020-057 authorized ArDOT's
30 Director to commit One Million Dollars ($1,000,000.00) from the State Fiscal Year 2019 State Surplus
31 Funds for construction of this project; and,
32 WHEREAS, the City will be responsible for the costs associated with all other phases of the project
33 and any construction costs beyond the One Million Dollars ($1,000,000.00) provided by ArDOT.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, THAT:
Section 1. The City will participate in accordance with its designated responsibilities as described
above.
Section 2. The Mayor, or his designated representative, is hereby authorized and directed to execute
all appropriate agreements and contracts necessary to expedite construction of this project.
Section 3. The City pledges its full support and hereby requests that the Arkansas Department of
Transportation initiate action to assist in implementation of this project.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
resolution.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
