3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER
s TO ENTER INTO A CONTRACT WITH MOTOROLA, INC. FOR THE
6 PURCHASE OF 44 MOTOROLA HPD MODEMS AND ACCESSORIES
7 FOR THE LITTLE ROCK FIRE DEPARTMENT MOBILE DATA
s COMPUTER PROJECT; AND FOR OTHER PURPOSES.

10 WHEREAS, the Little Rock Fire Department is committed to improving response
I capabilities and the service that is provided to the citizens of Little Rock, and
12 WHEREAS, in order to accomplish this goal, the LRFD must incorporate new
13 and proven technologies to their response system, and
14 WHEREAS, after careful research and consideration, the LRFD has chosen a
15 technologically advanced system that will provide a voiceless /visual image dispatch
16 display, a GIS routing and mapping display software system with functionality and
17 capacity required for the LRFD environment, and automatic vehicle location (AVL)
18 capability, and
19 WHEREAS, competitive bidding should be waived and the contract awarded to
20 Motorola, Inc. as the sole source provider of the system upgrade, as Motorola
21 application software is proprietary and the only radio equipment that is fully and
22 reliably compatible with our current radio system infrastructure.
23 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
24 OF THE CITY OF LITTLE ROCK, ARKANSAS:
25 Section 1. The Board of Directors finds that competitive bidding should be
26 dispensed with in the purchase of 44 Motorola HPD modems and accessories as a part
27 of the LRFD Mobile Data Computer Project.

To waive bidding for Motorola modems for LRFD
I Section 2. The City Manager is hereby authorized to dispense with
2 competitive bidding and to enter into a contract with Motorola, Inc. for the purchase of
3 44 Motorola HPD modems and accessories for the LRFD, in the amount of One
4 Hundred Twenty -Seven Thousand, Eight Hundred Eighty -one and 69/100 Dollars
5 ($127,881.69).
6 Section 3. Funds for this purchase are available as follows: 70% ($392,280.00)
7 through a 2004 FEMA Assistance to Firefighters Grant; and 30% ($168,120) match
8 through the City's Grant Matching Account #210 - 340 -Z021.
9 Section 4. Severability. In the event any title, section, paragraph, item,
1 o sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
11 or unconstitutional, such declaration or adjudication shall not affect the remaining
12 portions of the ordinance which shall remain in full force and effect as if the portion so
13 declared or adjudged invalid or unconstitutional was not originally a part of the
14 ordinance.
15 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which
16 are in conflict with any provision of this ordinance are hereby repealed to the extent of
17 such conflict.
